HomeMy WebLinkAbout19-24 CC Resolution RESOLUTION NO. 19-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA APPROVING THAT CERTAIN AGREEMENT ENTITLED LICENSE AGREEMENT FOR WIRELESS INSTALLATIONS ON PUBLIC STRUCTURES BETWEEN LOS ANGELES SMSA LIMITED PARTNERSHIP, DB/A VERIZON WIRELESS AND CITY OF TEMECULA, AND FINDING THE ACTION EXEMPT FROM CEQA THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY RESOLVE AS FOLLOWS: Section 1. ADDroval of Agreement. The City Council of the City of Temecula approves that certain agreement entitled License Agreement for Wireless Installations on Public Structures between Los Angeles SMSA Limited Partnership,D/B/A Verizon Wireless and City of Temecula. The Mayor is hereby authorized to execute the License Agreement on behalf of the City. A copy of the final License Agreement, when executed by the Mayor, will be placed on file in the office of the City Clerk. Section 2. City Manager's Authority. The City Manager(or his designee),is hereby authorized, on behalf of the City, to take all actions necessary and convenient to carry out and implement the License Agreement, and to administer the City's obligations, responsibilities and duties to be performed under the License Agreement, including but not limited to, approval and execution on behalf of the City of necessary documents to implement the License Agreement, including but not limited to,minor amendments or corrections as needed. Section 3. Environmental Analysis. Pursuant to the California Environmental Quality Act of 1970, Public Resources Code §21000, et seq., as amended and implementing State CEQA Guidelines,Title 14,Chapter 3 of the California Code of Regulations(collectively,"CEQA "), the adoption of the License Agreement is not considered a "project" pursuant to CEQA Guidelines Section 15378 and Public Resources Code Section 21065. The adoption of this type of an agreement is not the sort of activity that may cause a direct or reasonably foreseeable indirect physical change to the environment. In the alternative,the License Agreement is exempt pursuant to Section 15061(b)(3) of the CEQA Guidelines, in that there is no potential that the License Agreement may have a significant effect on the environment. Moreover, any site-specific future projects subject to the License Agreement would necessitate further environmental review on a case-by-case basis. Accordingly, no further environmental review is required. Section 4. Certification. The City Clerk shall certify the adoption of this resolution.
