HomeMy WebLinkAbout19-15 CC Ordinance ORDINANCE NO. 19-15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMECULA AMENDING SECTION 12.04.190 OF THE TEMECULA MUNICIPAL CODE REGARDING CITY PARK HOURS THE CITY COUNCIL OF THE CITY OF TEMECULA DOES ORDAIN AS FOLLOWS: Section 1. Section 12.04.190 (City park hours.) of Chapter 12.04 (Park and Recreation Area Use Regulations of Title 12 (Streets, Sidewalks and Public Places) is hereby amended in its entirety to read as follows: "12.04.190 City park hours. A. No person shall be in or remain in any city park, other than a community park, between the hours of 9 p.m. and 5 a.m. of the following day without permission of the director. The provisions of Sections 12.04.250 and 12.04.260 shall govern the granting or denial of such permission. B. Except as otherwise set forth in this Section, no person shall be in or remain in any community park between the hours of 10 p.m. and 5 a.m. of the following day without permission of the director. The provisions of Sections 12.04.250 and 12.04.260 shall govern the granting or denial of such permission. The following parks are designated as community parks for purposes of this subsection: • Harveston Community Park • Margarita Community Park • Pala Community Park • Paloma Del Sol Park • Patricia H. Birdsall Sports Park • Any other parks that are designated as community parks by City Council resolution. C. No person shall be in or remain in the Ronald Reagan Sports Park, Monday through Friday, between the hours of 10 p.m. and 8 a.m., or Saturday and Sunday between the hours of 10 p.m. to 5 a.m., without the permission of the director. The provisions of Sections 12.04.250 and 12.04.260 shall govern the granting or denial of such permission. D. No person shall be in or remain in the Redhawk Community Park, Monday through Sunday, between the hours of 9 p.m. and 8 a.m., without the permission of the director. The provisions of Sections 12.04.250 and 12.04.260 shall govern the granting or denial of such permission." Section 2. The proposed Code Amendment is exempt from the requirements of the California Environmental Quality Act ("CEQA") and the City's CEQA Guidelines pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the proposed Code Amendment, revising park hours will have a significant effect on the environment. Section 3. Severability. If any provision, clause, sentence or paragraph of this Ordinance or the application thereof to any person or circumstances shall be held invalid, such invalidity shall not affect the other provisions of this Ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this Ordinance are hereby declared to be severable. Section 4. Certification. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted in the manner required by law. Section 5. Effective Date. This Ordinance shall take effect thirty (30) days after passage. PASSED, APPROVED, AND ADOPTED by the City Council of the City of Temecula this 12th day of November,2019.
