AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TEMECULA AMENDING SECTION 8.28.210 OF THE
TEMECULA MUNICIPAL CODE REGARDING
STORMWATER DISCHARGES
THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Subsection (A)(12) of Section 8.28.210 (Exempted discharges.)of Chapter
8.28 (Stormwater and Urban Run Off Management and Discharge Controls)of Title 8 (Health and
Safety) of the Temecula Municipal Code is hereby deleted, and the remaining Subsection shall be
renumbered accordingly.
Section 2. The City Council hereby finds, in the exercise of its independent judgment,
that this Ordinance is exempt from the requirements of the California Environmental Quality Act
("CEQA") and the City's CEQA Guidelines pursuant to CEQA Guidelines Section 15061(b)(3)
because it can be seen with certainty that there is no possibility that the Ordinance, which clarifies
that runoff from irrigation water is a prohibited discharge will have a significant effect on the
environment. The City already prohibits runoff from irrigation water, and is now clarifying that
this prohibition also applies to runoff from irrigation water from a potable water source.
In addition, the adoption of the Ordinance is exempt from CEQA pursuant to CEQA
Guidelines Sections 15307 and 15308 as the City is taking action to protect, maintain, restore and
enhance natural resources and the environment. Staff is hereby directed to prepare and post a
notice of exemption pursuant to CEQA Guidelines Section 15062.
Section 3. Certification. The City Clerk shall certify to the passage and adoption of
this Ordinance and shall cause the same to be published or posted in the manner required by law.
Section 4. Effective Date. This Ordinance shall take effect thirty (30) days after
passage.
