HomeMy WebLinkAbout10272020 CC Action Minutes ACTION MINUTES TEMECULA CITY COUNCIL REGULAR MEETING COUNCIL CHAMBERS 41000 MAIN STREET TEMECULA,CALIFORNIA OCTOBER 27,2020-7:00 PM IMPORTANT NOTICE REGARDING THIS MEETING This meeting was conducted utilizing teleconferencing and electronic means consistent with State of California Executive Order N-29-20, dated March 17, 2020, regarding the COVID-19 pandemic. The live stream of the meeting may be viewed on television and/or online. Details can be found at temeculaca.gov/tv. In accordance with Executive Order N-29-20,the public may only view the meeting on television and/or online and not in the Council Chamber. Submission of Public Comments: For those wishing to make public comments at this Council meeting, please submit your comments by email to be read aloud at the meeting by the City Clerk. Email comments must be submitted to the City Clerk at randi.johl@temeculaca.gov. Email comments on matters not on the agenda must be submitted prior to the time the item for Public Comments is called. Email comments on agenda items must be submitted prior to the time public comments are closed on the agenda item. All email comments shall be subject to the same rules as would otherwise govern speaker comments at the Council meeting. Electronic comments on agenda items for this Council meeting may only be submitted via email and comments via text and social media (Facebook, Twitter, etc.) will not be accepted. Reading of Public Comments: The City Clerk shall read all email comments, provided that the reading shall not exceed three (3) minutes, or such other time as the Council may provide, consistent with the time limit for speakers at a Council meeting. The email comments submitted shall become part of the record of the Council meeting. CLOSED SESSION-6:00 P.M. CONFERENCE WITH REAL PROPERTY NEGOTIATORS. The City Council convened in closed session pursuant to Government Code Section 54956.8 regarding the acquisition of real property owned by Tilak Chopra, consisting of approximately 325 square feet located near Butterfield Stage Road and Nicolas Road(APN: 957-130-003). The negotiating parties are the City of Temecula and Tilak Chopra. Negotiators for the City of Temecula are: Aaron Adams, Greg Butler, Pat Thomas and Peter Thorson. Under negotiation are price and terms of the acquisition of this property. CONFERENCE WITH LEGAL COUNSEL—POTENTIAL LITIGATION.The City Council convened in closed session with the City Attorney pursuant to Government Code Section 54956.9(d)(4) with respect to one matter of potential litigation. A point has been reached where, in the opinion of the City Attorney,based on existing facts and circumstances,there is a significant exposure to litigation involving the City. Based on existing facts and circumstances, the City Council will decide whether to initiate litigation. Approved the Staff Recommendation(4-0): Motion by Schwank, Second by Naggar. The vote reflected unanimous approval. I. Waive Reading of Standard Ordinances and Resolutions Recommendation: That the City Council waive the reading of the text of all standard ordinances and resolutions included in the agenda except as specifically required by the Government Code. 2. Approve Action Minutes of October 13, 2020 Recommendation: That the City Council approve the action minutes of October 13, 2020. 3. Approve List of Demands Recommendation: That the City Council adopt a resolution entitled: RESOLUTION NO. 2020-67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA ALLOWING CERTAIN CLAIMS AND DEMANDS AS SET FORTH IN EXHIBIT A 2 4. Approve City Treasurer's Report as of August 31, 2020 Recommendation: That the City Council approve and file the City Treasurer's Report as of August 31, 2020. 5. Approve Fourth Amended and Restated Joint Powers Agreement for the Southwest Communities Financing Authority(Animal Shelter) Recommendation: That the City Council approve the Fourth Amended and Restated Joint Powers Agreement between the County of Riverside and the cities of Canyon Lake, Lake Elsinore, Menifee, Murrieta,Temecula, and Wildomar, for the Southwest Communities Financing Authority(Animal Shelter). RECESS: At 7:25 PM, the City Council recessed and convened as the Temecula Community Services District Meeting. At 7:28 PM,the City Council resumed with the remainder of the City Council Agenda. RECONVENE TEMECULA CITY COUNCIL BUSINESS 7. Introduce Ordinance Amending Chapter 8.20 of the Municipal Code to Include Provisions Regarding Recyclables and Organics Collection Recommendation: That the City Council introduce and read by title only an ordinance entitled: ORDINANCE NO. 2020-09 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMECULA, CALIFORNIA, AMENDING CHAPTER 8.20 OF THE MUNICIPAL CODE TO INCLUDE PROVISIONS REGARDING RECYCLABLES AND ORGANICS COLLECTION Approved the Staff Recommendation (4-0): Motion by Naggar, Second by Rahn. The vote reflected unanimous approval. JOINT MEETING-COUNCIL/CSD BUSINESS 8. Approve Fiscal Year 2020-21 Budget Adjustments Recommendation: That the City Council approve the recommended adjustments to the Fiscal Year 2020-21 Annual Operating Budget and Fiscal Years 2021-2025 Capital Improvement Program Budget by adopting the following resolutions entitled: 3 RESOLUTION NO. 2020-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA, AMENDING THE FISCAL YEAR 2020-21 ANNUAL OPERATING BUDGET RESOLUTION NO. CSD 2020-06 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE TEMECULA COMMUNITY SERVICES DISTRICT OF THE CITY OF TEMECULA AMENDING THE FISCAL YEAR 2020-21 ANNUAL OPERATING BUDGETS RESOLUTION NO. 2020-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA AMENDING THE CAPITAL IMPROVEMENT PROGRAM FISCAL YEARS 2021-2025 AND AMENDING THE CAPITAL IMPROVEMENT BUDGET FOR FISCAL YEAR 2020-21 Approved the Staff Recommendation (4-0): Motion by Naggar, Second by Rahn.
