HomeMy WebLinkAbout96-137 CC Resolution RESOLUTION NO. 96-137 A RESOLUTION OF THE CITY COUNCIIL OF THE CITY OF TFALECULA ORDERING, CALLING AND GIVING NOTICE OF A MUNICIPAL ELECTION TO BE HELD IN THE CITY ON TUESDAY, MARCH 4,1997, FOR SUBMISSION TO THE VOTERS OF A M[EASURE RELATING TO THE LEVY OF A SPECIAL TAX TO FINANCE THE OPERATION, MAINTENANCE AND SERVICING OF PUBLIC PARKS AND RECREATIONAL FACILITIES, RECREATIONAL AND COMMUNITY SERVICES PROGRAMS, MIEDIAN LANDSCAPING, ARTERIAL STREET LIGHTS AND TRAFFIC SIGNALS THE CITY COUNCH, OF THE CITY OF TEMECULA HEREBY FINDS, RESOLVES, DECLARES, DETERM@ AND ORDERS AS FOLLOWS: Sectio@ Pursuant to the requirements of Article XIIIA, Section 4 of the California Constitution, there is hereby called and ordered to be held in the City on Tuesday, March 4, 1997, a municipal election for the purpose of submitting to the qualified voters of the City a proposition authorizing the City to impose a special tax within the City to finance the operation, maintenance and servicing of public parks and recreational facilities, median landscaping, arterial street lights and traffic signals commencing with fiscal year 1997-98. Sectio@ The proposition to be submitted to the voters shall be substantially as follows: PARKS, RECREATION, LANDSCAPING AND LIGHTING REPLACEMENT TAX: Shall Ordinance No. of the City of Yes Temecula be adopted which would replace, at the same rate, the existing Temecula Community Services District Rates and Charges for the maintenance, operation and servicing of public parks, recreational No facilities, recreational and community services programs, median landscaping, arterial street lights and traffic signals with a special tax 11 at the same existing rate which shall only be used for those purposes? I Sectio@ The text of the proposed ordinance to be submitted to the voters is attached hereto and incorporated herein by reference. The type of tax, the rate of tax, and the method of collection are stated therein. 96-137 1 Sectio@ The polls for the election shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day when the polls shall be closed, except as provided in Elections Code Section 14401. Sectio@ In all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding City elections. Sectio@ Notice of the time and place of holding the election is hereby given and the City Clerk is hereby authorized, instructed and directed to give further or additional notice of the election, in the time, form and manner as required by law. Sectio@ The Registrar of Voters of the County of Riverside is hereby authorized to canvass the returns of the municipal City election. Section-& Pursuant to Elections Code Section 10002, the Board of Supervisors of the County of Riverside is hereby requested to issue instructions to the County Registrar of Voters and all County officers charged with duties pertaining to the statewide election to take any and all steps necessary for the holding of the consolidated election, including the preparation of necessary materials. Sectio@ The City shall reimburse the County of Riverside for services performed when the work is completed and upon presentation to the City of a properly approved bill. Sect*o@ The City Council hereby directs the City Clerk to transmit a copy of the measure to the City Attorney. The City Attorney shall prepare an impartial analysis of the measure showing the effect of the measure on the existing law and the operation of the measure. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. Sectio@ The City Council, the officers and staff of the City and the City's legal counsel are hereby authorized and directed to take such further action as may be necessary or appropriate in preparing for and conducting the election. 96-137 2 PASSED, APPROVED AND ADOPTED by the City Council of the City of Temecula this 26th day of November, 1996.
