HomeMy WebLinkAbout10-032 CC Resolution RESOLUTION NO. 10 -32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA TO OPPOSE PROPOSITION 16: THE TAXPAYERS RIGHT TO VOTE ACT, WHICH IS A PROPOSED CONSTITUTIONAL AMENDMENT SCHEDULED FOR THE JUNE 2010 BALLOT THAT WOULD REQUIRE COMMUNITIES TO REACH A TWO - THIRDS CONSENSUS VOTE IN ORDER TO FORM A COMMUNITY CHOICE AGGREGATION AND WOULD REQUIRE THE SAME LEVEL OF SUPPORT FOR EXPANDING MUNICIPAL UTILITIES THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, Proposition 16, a Constitutional Amendment, has qualified for the June 8, 2010 statewide ballot (the "Initiative "); and WHEREAS, the Initiative would require a public electricity provider to obtain a two- thirds voter majority in both existing territory and proposed territory expansions prior to spending funds for utility system expansion; and WHEREAS, the Initiative would effectively overturn AB 117 (2002), which authorizes local jurisdictions to join coalitions known as Community Choice Aggregation ( "CCA ") in order to procure and provide electricity to residents and businesses in a less costly and more environmentally sensitive manner; and WHEREAS, the City of Temecula ( "City ") does not currently provide electricity, nor are there plans to provide electricity to its residents and businesses in the future; and WHEREAS, the Initiative would make it more difficult for the City to join a CCA in the future; and NOW, THEREFORE, BE IT RESOLVED by the City Council of Temecula, California, that the City of Temecula opposes the passage of Proposition 16, a proposed constitutional amendment.
