HomeMy WebLinkAbout91-004 CC ResolutionRESOLUTION NO. 91-04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA ADOPTING PROCEDURES FOR REVIEW OF SOLID WASTE TRANSFER FACILITIES WHICH ARE DESIGNED TO RECOVER FOR REUSE OR RECYCLING LESS THAN 15 PERCENT OF THE TOTAL VOLUME OF MATERIAL RECEIVED BY THE FACILITY AND SERVING ONLY ONE JURISDICTION. WHEREAS, the City of Temecula must divert 25 % of all solid waste from landfill or transformation facilities by January 1, 1995, and 50% by January 1, 2000; and WHEREAS, the City of Temecula may establish procedures for the review of the siting of certain solid waste facilities that will assist the City to achieve these goals; and WHEREAS, section 5000 (d) of the California State Public Resources Code requires counties and the majority of the cities in the county containing a majority of the population of the incorporated area of the county to resolve by February 1, 1991, which review process will be followed for solid waste transfer facilities which are designed to, and, as a condition of their permits, shall, recover for reuse or recycling less than 15 percent of the total volume of material received by the facility and which serve only one jurisdiction; and WltEREAS, it is in the best interest of the City of Temecula to adopt a process empowering the cities of the County to review all prospective sitings that serve only one jurisdiction; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the County and each City within the County should have the authority to review and approve/disapprove all prospective sitings of said transfer facilities that serve more than one jurisdiction.
