HomeMy WebLinkAbout012593 PC MinutesMINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA PLANNING COMMISSION JANUARY 25, 1993 A regular meeting of the City of Temecula Planning Commission was held Monday, January 25, 1993, 6:00 P.M., at Vail Elementary School, 29915 Mira Loma Drive, Temecula, California. The meeting was called to order by Chairman Linda Fahey. PRESENT: 5 ABSENT: 0 COMMISSIONERS: Blair, Chiniaeff, Ford, Hoagland, Fahey COMMISSIONERS: None Also present were Attorney Mary Jo Shelton-Dutcher, Planning Director Gary Thornhill, Senior Planner John Meyer and Minute Clerk Gail Zigler. PUBLIC COMMENT None COMMISSION BUSINESS Approval of Agenda It was moved by Commissioner Blair, seconded by Commissioner Ford to approve the Agenda as mailed. 2. Minutes 2.1 Approval of minutes of November 23, 1992 Planning Commission meeting. Commissioner Chiniaeff requested corrections on Page 5, paragraph 5, "Nayree Davis, representing the Los Ranchitos Homeowners Association"; and Page 6, paragraph 1 1, "Commissioner Chiniaeff stated that he was still concerned that in special and unique areas, Specific Plans that have non-standards, development standards should be considered". It was moved by Commissioner Hoagland, seconded by Commissioner Chiniaeff to approve the minutes of November 23, 1993 as amended. The motion carried as follows: AYES: 5 COMMISSIONERS: Blair, Chiniaeff, Ford, Hoagland, Fahey NOES: 0 COMMISSIONERS: None PC M I N ~/25/93 -1- 2~8~93 PLANNING COMMISSION MINUTES JANUARY 25, 1993 2.2 Approval of minutes of December 7, 1992 Planning Commission meeting. Commissioner Ford requested the following correction on Page 6, Request 44, "The overall consensus of the Commission was to approve the business park, modifying the park/open space area by moving it closer to the existing multi- family to the south and the future alignment of the Western Bypass Corridor .... " It was moved by Commissioner Blair, seconded by Commissioner Ford to approve the minutes of December 7, 1992 as amended. The motion carried as follows: AYES: 5 COMMISSIONERS: Blair, Chiniaeff, Ford, Hoagland, Fahey NOES: 0 COMMISSIONERS: None PUBLIC HEARING 3. Final Environmental Impact Re~ort and General Plan John Meyer presented the staff report. The overall consensus of the Commission was to recommend the modifications to the Environmental Impact Report: Page 6,second paragraph: Delete "of" from the first sentence. Page 11,last paragraph: Correct to read 10' x 5' in third sentence. Chairman Fahey declared a recess at 6:40 P.M. to allow the Commission the opportunity to review a letter submitted to the Commission by the School District. The meeting reconvened at 6:45 P.M. Attorney Mary Jo Shelton-Dutcher stated that the City Attorney's office stands by its decision regardless of the letter submitted by the attorney representing the school district. Commissioner Hoagland stated he could not support the recommendation by the City Attorney which he feels does not address whether or not adequate schools are built, and moved that the Commission not approve the changes indicated on Page 6-25 of the goals and policies of the General Plan; however, recommended the school district be allowed to act as another infrastructure/utility and allow the school district to make the decision and set the condition by which a development will mitigate its impact on schools. He added that if the Commission did not want to make this change, then he would recommend that a finding be added stating that schools will not be adequate PC M I N ~/25/93 -3- 2/8/93 PLANNING COMMISSION MINUTES JANUARY 25, 1993 based on the proposals in the planning document and the E.I.R. The motion was seconded by Commissioner Blair. Commissioner Chiniaeff stated that he did not approve of going against the advice of the City Attorney. Commissioner Chiniaeff added that school districts are like other utilities and have the ability to place requirements on developments in accordance with state law. Commissioner Chiniaeff stated that he can not support the motion to go against the recommendation by the City Attorney or amend the findings. Commissioner Blair stated that unless the City controls the impacts of development on adequate schools the quality of life will be negatively impacted. Commissioner Ford stated that the Commission has not seen the documentation which demonstrates that the impact on schools cannot be mitigated; therefore, he could not support the motion. Chairman Fahey stated that she is not in favor of going against the opinion of legal counsel but does not feel that the impact on the schools has been adequately mitigated in the General Plan and should be added to the E.I.R. Chairman Fahey opened the public hearing 7:00 P.M. Eric Doering, 4920 Campus Drive, Newport Beach, attorney representing the school district, clarified points of SB1 2-87 and the city's authority to require full mitigation of impacts on schools. Lettie Boggs, representing the Temecula Valley Unified School District, reiterated that the school district feels it is imperative that the General Plan state what the education plan will be for the City of Temecula and to exercise every precaution to ensure the quality of the educational program at the standards that the school district wants and that can be implemented to the extent the law allows. Commissioner Hoagland clarified that his motion was to make the conditions for school district input the same as for the other utilities (i.e. water district, etc.) as approved at the meeting of January 4, 1993. AYES: 2 COMMISSIONERS: Blair, Hoagland NOES: 3 COMMISSIONERS: Chiniaeff, Ford, Fahey It was moved by Commissioner Chiniaeff, seconded by Commissioner Ford to adopt the goals and policies as presented and including the recommendation by the City Attorney relative to the opinion on the school district issue. AYES: 3 COMMISSIONERS: Chiniaeff, Ford, Fahey PC M I N 1/25/93 -4- 2/8/93 PLANNING COMMISSION MINUTES JANUARY 25, 1993 NOES: 2 COMMISSIONERS: Blair, Hoagland It was moved by Commissioner Hoagland, seconded by Commissioner Blair to approve the Final Environmental Impact Report with the addition of a Finding 3.7 on Page 42 as follows and allow staff to review to ensure internal consistency throughout the document: "The proposed General Plan contains policies that impact educational facilities, however due to the current limitations of school facility funding in the study area, implementation of the proposed General Plan has a significant unmitigated impact." The motion carried as follows: AYES: 5 COMMISSIONERS: Blair, Chiniaeff, Ford, Hoagland, Fahey NOES: 0 COMMISSIONERS: None Ernie Egger, TPC, 27447 Enterprise Circle West, Temecula, representing Old Vail Partners, addressed Table 2, Specific Plan Area Z-1,2,3, requested clarification that open space reference related to Temecula Creel<. Mr. Egger stated that the three properties should be able to proceed on their own with a specific plan, without being linked to the other properties. It was moved by Commissioner Chiniaeff, seconded by Commissioner Ford to recommend to the City Council certification of the Final Environmental Impact Report with changes, approval of the Mitigation Monitoring Program and the Draft General Plan. The motion carried as follows: AYES: 5 COMMISSIONERS: Blair, Chiniaeff, Ford, Hoagland, Fahey NOES: 0 COMMISSIONERS: None PLANNING DIRECTOR'S REPORT Gary Thornhill discussed the following: * Director Thornhill requested the Commissioners advise of availability to attend the March 10 - 12, 1993, Planning Institute in Monterey, California. * Director Thornhill advised that the General Plan is scheduled for its first Public Hearing by the City Council on February 16, 1993. PC M I N 1/25/93 -5- 2/8/93 PLANNING COMMISSION MINUTES JANUARY 25, 1993 Director Thornhill suggested that two Commissioners be appointed to act as liaison to work with staff on problem projects. After discussion the Commission agreed to work on a rotating basis. Director Thornhill advised that the current project workload does not require the Commission to meet twice a month. After discussion, the Commission agreed to keep the first Monday of the month as the regular meeting date and the third Monday to be used for special issues and workshops. Director Thornhill asked that the Commission provide input on workshop ideas and training sessions. PLANNING COMMISSION DISCUSSION None OTHER BUSINESS None ADJOURNMENT It was moved by Commissioner Blair, seconded by Commissioner Hoagland to adjourn at 7:45 P.M. The motion was unanimously carried. The next regular meeting of the City of Temecula Planning Commission will be held on Monday, February 1, 1993, 6:00 P.M., at Vail Elementary School, 29915 Mira Loma Drive, Temecula, California.
