HomeMy WebLinkAbout16-10 CC Resolution RESOLUTION NO. 16-10 ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA DELEGATING TO THE CITY MANAGER CERTAIN AUTHORITY TO PROCESS AND SETTLE WORKERS' COMPENSATION CLAIMS AND LITIGATION THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council hereby finds, determines and declares that: A. The City of Temecula is now legally self-insured for the payment of its obligations under the Workers' Compensation Law, Labor Code Section 3200 et. seq. B. The City Council desires to provide for the prompt, efficient and economical handling and settlement of Workers' Compensation claims against the City and therefore intends by this Resolution to delegate to the City Manager certain limited authority for the settlement of these claims. Section 2. The City Manager of the City of Temecula is hereby authorized to take all actions required for the processing, investigation and management of Workers' ' Compensation claims filed against the City under the Workers' Compensation Law, Labor Code Section 3200 et. seq., and any actions filed with the Worker's Compensation Appeals Board under the Workers' Compensation Law, including without limitation the authority to contract with attorneys, doctors, investigator, and other consultants as necessary to process the claims. Section 3. The City Manager of the City of Temecula is hereby authorized to settle, allow, compromise or pay any claim filed against the City under the Workers' Compensation Law, Labor Code Section 3200 et. seq., and any actions filed with the Workers' Compensation Appeals Board under the Workers' Compensation Law, in an amount not to exceed fifty thousand dollars ($50,000.00) per claim or action, provided however, that money to settle such claims and actions has been appropriated by the City Council and money is available within such appropriation for the settlement, allowance, compromise or payment of the claim or action by the City Manager. Section 4. The City Clerk shall certify to the adoption of this Resolution.
