HomeMy WebLinkAbout98-075 CC ResolutionRESOLUTION NO. 98-75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA, CALIFORNIA, AMENDING THE CITY'S GENERAL PLAN LAND USE MAP FOR PROPERTIES IDENTIFIED AS ASSESSOR'S PARCEL NUMBERS 914-811- 001,914-811-002, 914-811-003, 914-811-004, 914-811-005, 914- 811-006, 914-811-007, 914-812-001, 914-812-002, 914-812-003 AND 914-812-004 FROM VL (VERY-LOW DENSITY RESIDENTIAL .2-.4 DWELLING UNITS PER ACRE) TO LM (LOW-MEDIUM DENSITY RESIDENTIAL 3-6 DWELLING UNITS PER ACRE) WHEREAS, on November 9, 1993, the City Council of the City of Temecula adopted the General Plan; WHEREAS, the City has identified a need to amend the City's General Plan Land Use Plan; WHEREAS, notice of the proposed Resolution was posted at City Hall, the County Library, Rancho California Branch, the U.S. Post Office and the Temecula Valley Chamber of Commerce; WHEREAS, the Planning Commission considered Planning Application No. PA98-0170 (General Plan Amendments), on May 20, 1998, at a duly noticed public hearing as prescribed by law, at which time the City staff and interested persons had an opportunity to and did testify either in support or in opposition to this matter; WHEREAS, at the conclusion of the Commission hearing, and after due consideration of the testimony, the Commission recommended approval of Planning Application No. PA98-0170 (General Plan Amendments); and WHEREAS, the City Council considered Planning Application No. PA98-0170 (General Plan Amendments), on July 14, 1998, at a duly noticed public hearing as prescribed by law, at which time the City staff and interested persons had an opportunity to and did testify either in support or in opposition to this matter; THE CITY COUNCIL OF THE CITY OF TEMECULA, STATE OF CALIFORNIA, DOES ORDAIN AS FOLLOWS: Section 1. Findings. findings: That the Temecula City Council hereby makes the following R:resos.98-75 1 A. That Section 65350 of the Government Code provides for the preparation, adoption and amendment of general plans and their elements; B. That there is a need to amend the City's General Plan Land Use Plan to protect the public health, safety and welfare; and C. That this Resolution complies with all applicable requirements of State law and local ordinances. Section 2. The General Plan Land Use Plan is hereby amended to read as follows: A. Properties identified as Assessor's Parcel Numbers 914-811-001, 914-811-002, 914-811-003,914-811-004, 914-811-005,914-811-006, 914-811-007,914-812-001,914-812-002, 914-812-003 and 914-812-004 shall be amended from VL (Very-Low Density Residential .2-.4 dwelling units per acre) to LM (Low-Medium Density Residential 3-6 dwelling units per acre). Section 3. Environmental. An Initial Study prepared for this project indicates that although the proposed project will not have a significant impact on the environment, and a Negative Declaration, therefore, is hereby granted. Section 4. Severability. The City Council hereby declares that the provisions of this Resolution are severable and if for any reason a court of competent jurisdiction shall hold any sentence, paragraph, or Section of this Resolution to be invalid, such decision shall not affect the validity of the remaining parts of this Resolution. Section 5. The City Clerk shall certify the adoption of this Resolution. R:resos.98-75 2 PASSED, APPROVED, AND ADOPTED, by the City Council of the City of Temecula this 28th day of July, 1998.
