HomeMy WebLinkAbout00-07 CC OrdinanceORDINANCE NO. 2000-07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEiVIECULA AIVIENDING SECTION 2.04.050 OF THE TEMECULA iVIUNICIPAL CODE REVISING THE SALARY FOR COUNCIL IVIEiVIBERS TO FIVE HUNDRED DOLLARS PER I~IONTH AS PROVIDED IN GOVERNEvIENT CODE SECTION 36516 AND PROVIDING FOR REIMBURSEIVIENT OF NECESSARY EXPENSES. THE CITY COUNCIL OF THE CITY OF TEI~IECULA DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Temecula does hereby find, determine and declare that: A. Government Code Section 36516 provides that council members in a city with a population of 50,000 to 75,000 persons are authorized to receive a salary of $500.00 per month. The population of a city for the purposes of establishing council member salaries may be based upon either a federal census or an estimate of population validated by the California Depadment of Finance. B. The population of the City of Temecula is 53,791 persons as validated by the California Department of Finance. Section 2. Section 2.04.050 of the Temecula Municipal Code is hereby amended to read as follows: "2.04.050 Compensation "A. In accordance with Government Code Section 36516, each council member shall be entitled to a salary of in the amount of five hundred dollars ($500.00) per month. "B. Upon the submission of an itemized account, any council member may be reimbursed for the actual and necessary expenses incurred in the performance of official duty. The Council may, by resolution, establish a schedule of actual and necessary expenses incurred in the performance of official duty for which council members may be reimbursed." Section 3. As required by Government Code Section 36516.5, council members shall not be eligible for the $500.00 salary described in Section I of this Ordinance until the term of office begins for council members elected at the November 2001 General Municipal Election. Until such time, council members shall continue to receive $300.00 per month in salary. Ords/2000-07 I Section 4. If any sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or otherwise invalid, such decision shall not affect the validity of the remaining provisions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each sentence, clause or phrase thereof irrespective of the fact that any one or more sentences, clauses or phrases be declared unconstitutional or otherwise invalid. Section 5. The City Clerk of the City of Temecula shall certify to the passage and adoption of this Ordinance and shall cause the same or a summary thereof to be published and posted in the manner required by law.
