HomeMy WebLinkAbout97-05 CC OrdinanceORDINANCE NO. 97-0S AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMECULA, AMENDING SECTION 10.25.010(d) OF THE TEMECULA MUNICIPAL CODE REGARDING THE PRIMA FACIE SPEED LIMIT ON (1) YNEZ ROAD BETWEEN RANCHO CALIFORNIA ROAD AND WINCHESTER ROAD (2) DEL REY ROAD AND VIA NORTE (3) MORAGA ROAD BETWEEN RANCHO CALIFORNIA AND MARGARITA ROAD (4) MARGARITA ROAD BETWEEN RANCHO CALIFORNIA ROAD AND STATE ROUTE 79 SOUTH (5) JEFFERSON AVENUE BETWEEN WINCHESTER ROAD AND NORTH CITY LIMITS THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY ORDAIN AS FOLLOWS: WHEREAS, The City of Temecula finds and determines that from time to time it is necessary to add or modify existing prima facie speed limits within the City for certain streets, or parts of streets. WHEREAS, the City conducts engineering and traffic surveys on its roadways in order to determine the appropriate speed limit; WHEREAS, the engineering and traffic surveys on the segments of roadways designated in this Ordinance indicate that the speed limit should remain the same and, therefore, the intent of the Council is to re-affirm the speed limits given the new engineering and traffic study. SECTION 1. Section 10.28.010(d) of the Temecula Municipal Code is hereby amended as follows to modify the declared prima facie speed limits only on the following streets: "Name of Street and Portion Affected Ynez Road between Rancho California Road and Winchester Road Del Rey Road (entire length) Declared Prima Facie Speed l,imit, Miles Per Hour 45 35 Orda\ 97-05 1 Via Norte (entire length) Moraga Road between Rancho California Road and Margarita Road Margarita Road between Rancho California Road and State Route 79 South Jefferson Avenue between Winchester Road and North City Limits 35 40 45 50 Except as specifically set forth in this Section 1, all other provisions of Section 10.28.010(d) shall remain in full force and effect. SECTION 2. Severability. The City Council hereby declares that the provisions of this Ordinance are severable and if for any reason a court of competent jurisdiction shall hold any sentence, paragraph, or section of this Ordinance to be invalid, such decision shall not affect the validity of the remaining parts of this Ordinance. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be posted as required by law. SECTION 4. Effective Date. This Ordinance shall be in full force and effect thirty (30) days after its passage. The City Clerk shall certify to the adoption of this Ordinance and cause copies of this Ordinance to be posted in three designated posting places. SECTION 5. This Ordinance shall be in full force and effect thirty (30) days after its passage; and within fifteen (15) days after its passage, together with the names of the City Councilmembers voting thereon, it shall be published in a newspaper published and circulated in said City.
