A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMECULA ACCEPTING THE RIGHT OF ENTRY AND
TEMPORARY CONSTRUCTION EASEMENTS AND
ORDERING THE RECORDATION OF THE SOUND WALL
COVENANTS IN CONNECTION WITH THE
CONSTRUCTION OF THE PALA ROAD SOUND WALL
THE CITY COUNCIL OF THE CITY OF TEMECULA DOES RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
WHEREAS, The FHWA Community Noise Impact Assessment (revision 2) prepared
by the Riverside County Environmental Health Department dated October 31, 1995, which was
approved by Caltrans on November 22, 1995, called for the construction of a sound wall along
Pala Road fronting certain properties affected by the realignment of Pala Road; and,
WHEREAS, The property owners described in said assessment were given due
notice regarding the proposed construction of the sound wall and thereafter agreed to the
construction of said sound wall: and,
WHEREAS, The property owners as listed in Exhibit "A" have individually granted a
right of entry and temporary construction easement to the City of Temecula for the purpose of
constructing a sound wall along Pala Road: and,
WHEREAS, The property owners have individually agreed to covenant themselves
as to maintaining the sound wall into perpetuity; and,
WHEREAS, the City desires to accept the right of entry and temporary construction
easements in order to construct the sound wall; and, order the recordation of the sound wall
covenants to ensure that the sound wall is maintained into perpetuity;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Temecula
hereby accepts the Right of Entry and Temporary Construction Easements as offered by
individual property owners listed in Exhibit "A", in substantially the form attached hereto for the
purposes stated therein; and, that the City Clerk is directed to record the Sound Wall Covenants
as attached hereto. The City Engineer is hereby authorized to make minor modifications to the
legal descriptions on said documents.
PASSED, APPROVED, AND ADOPTED, by the City Council of the City of Temecula at
a regular meeting held on the 19~ day of December 2000.
