HomeMy WebLinkAbout00-085 CC ResolutionRESOLUTION NO. 2000-85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA AUTHORIZING THE CITY MANAGER TO EXECUTE THE ADMINISTERING AGENCY-STATE AGREEMENT NO. 08-0457, DATED NOVEMBER 10, 1999, AND ALL PERTINENT PROGRAM SUPPLEMENT AGREEMENTS FOR STATE FUNDED PROJECTS. THE CITY COUNCIL OF THE CITY OF TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: WHEREAS, the Legislature of the State of Califomia has enacted legislation by which certain State funds are made available for use on local transportation facility projects; and, WHEREAS, the City of Temecula has applied to the California Transportation Commission for State funding from the State Transportation Improvement Program for the local administration of certain transportation facility projects; and, WHEREAS, as provided by State policy, said local transportation facility projects will not receive any federal funds; and WHEREAS, before State funding will be made available for specific local transportation facility projects, Merced County and the State of California are required to enter into an agreement relative to prosecution of specific project and maintenance of the completed facility; and WHEREAS, Caltrans has prepared a Mater Agreement entitled, "Administering Agency - State Agreement for State Funded Projects" for execution by Caltrans and the City of Temecula pursuant to State requirements; and, WHEREAS, a Program Supplement to the Master Agreement is required to be approved for every specific project that is to receive State funds; and, WHEREAS, Paragraph 4 of Article I, "Project Administration," of the Master Agreement allows a local agency governing body to delegate the authority to manage the Program Supplements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Temecula as follows: Section 1. That the City Manager is authorized to execute the Administering Agency- State Agreement No. 08-0457, dated November 10, 1999, for State Funded Projects. Section 2. That the City Manager is authorized to execute the individual Program Supplements to the "Administering Agency - State Agreement for State Funded projects. Section 3. This Resolution shall take effect immediately upon its adoption.
