HomeMy WebLinkAbout95-013 CC ResolutionRESOLUTION NO. 95-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA APPROVING A LEASE WITH MOBILE MODULAR MANAGEMENT CORPORATION FOR MODULAR UNITS TO BE UTILIZED AT THE TEMPORARY FIRE STATION THE CITY COUNCIL OF THE CITY OF TEMECULA DOES RESOLVE AS FOLLOWS: Section 1. The City Council hereby approves that certain Lease by and between the City of Temecula and Mobile Modular Management Corporation and authorizes the Mayor to execute said Lease on behalf of the City, in substantially the form attached hereto as Exhibit A. However, if the rel~ir is requested and the cause relates to the use ol equipment beyon~ what ie considered normal wear and tear, abu#, neglect, or the warranty period has expired, the levee/buyer will be charged lot the sen~ce rail. Common arees of CHARGE BACKS are: Improper or inadequate electrical hookup, Mrload on receptacles. thppKI or blown circuit breakers, the~mo~at improperly set or let below 70 degrees, aupply air regislats (vents) improperly ~et, dimly HVAC flit·fl, damaged flooring due to · i&ck of chair mats, and misinlormatJon provided by the lessee/buyer. In the event that prior approval is not recei~ed, any re~ulting charges from the Ifisee/buyar to MMMC will not be reimbur~d. For your information 80-90~ of all repair calls on electzical and/or HVAC problems relate to levee/buyer error in electScat hook-up or operation. Plaice make sure that you are hookKI up properly to avoid unnece~ary chargel. HEATING/AIR CONDmONING FILTERS. Whenever po~ible MMMC will do HI ut~olt to exitdate your 11. REPAIR OF LEAKS. It is not uncommon lot leaks to occur on a modular e~mciaily on a reeendy delivered or relocated one. In order to seal these leakl properly it requires I dry surface. MMMC will do its utmost to seas any leaks in · timely manner. once the walther permits. Be aware that on multi-wide modulefl. the letup crew that follows the driver does not I~ave the ability to move the modulars more than a law feel Ex~'a charges may re,lit if addibonal movement is required. 15. RELOCATING OF EQUIPMENT'. Under no circumstances tall any modular be relo<'4tad from its original point of delivery without MMMC's consent. Under most circumstances. MMMC will relocate the soduser and charge the lessee/Du~r accordingly. The decision Is to who and how the modular is to be relocated rests ~oiely with MMMC. 16. RETURN DELIVERY PROCEDURE'. MMMC requires a minimum of ~0 DAYS NOTICE for return delivery of modulers. Upon n~dyng MMMC that you wit to schedule re~Jrn delivery pieale provide your =~n~act number. Finally. the eelsee must have all utilities disconnected from the mociular prior to MMMC arriving It the site to begin the dismantle. Please be aware that the lessee ie resportsible for the condition of the modular up until the time that MMMO removes it from your site. MMMC strongly suggestl that the eelsee have personnel at the site upon pick-up to sign for the modular. Additionally. MMMC il NOT re~oonsible for any furniture. supplies. phone equipment. or any other Iteml that the lessee hal sealed to remove prior to return of the modular. Upon tatum of the modular to MMMC'I inventory center an inspecbon of the buildingl will be pertoaf(t; (if requested in advance. an inspection can be done in t~e field for an &dditional charge). NI damages or other needed wmlc to return the modular to its original condition will be billed for upon complMion of Ihil inspection report. 17. SKIRTING REMOVAL'. Unless otherwise noted on the con~ract agreement. skirting removal is the responsibility of the lessee. At the leesee's request MMMO will perform thil work at an additional co~t. Our charges will include Ikirt removal. towbar inl~Jllation. and stacking the skirting neatly at your lite. The lessee may remove the Ikirbng and install the towbari to avoid this charge. 18. DELIVERY, RELOCATION. OR RETURN DELIVERY TIMES. Due to untoresssn dalay~ related to weather. traffic or a prior haul, MMMC cannot guarsntee specific time,1 on deliv&ric,~. r=[urn de:iveries, or relocates. 19. CLEANING DEPOSIT'. MMMC charges a S75.00 cleaning/key depoMt. (Der module, on all contracal. Charges for ~amlges to the modular will be billed for separately as outlined it)Dye. 20. PRORATION OF RENT'. MMMC prorates rent in one-half (1/2) month increments only. Any modular on rent beyond Ihe 14th day of I billing cycle will be responsible for the lull months rental payment. Under no circum~ncel will any rental be for less than two (2) months. 21. DEPARTMENT OF HOUSING & COMMUNITY DEVELOPMENT {DOll) ANNUAL REGISTRATION FEES'.
