A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMECULA APPROVING A LEASE WITH MOBILE
MODULAR MANAGEMENT CORPORATION FOR
MODULAR UNITS TO BE UTILIZED AT THE TEMPORARY
FIRE STATION
THE CITY COUNCIL OF THE CITY OF TEMECULA DOES RESOLVE AS
FOLLOWS:
Section 1. The City Council hereby approves that certain Lease by and between
the City of Temecula and Mobile Modular Management Corporation and authorizes the Mayor
to execute said Lease on behalf of the City, in substantially the form attached hereto as Exhibit
A.
Section 2. The City Clerk shall certify the adoption of this Resolution.
PASSED, APPROVED AND ADOPTED by the City Council of the City of
Temecula on the 14th day of February, 1995.

of occurrenefi that will remJIt in ADDITIONAL CHARGES to fee· already quoted for deliver),, letup, teardown, return and relocabon of
modulers. etc. Additi(x~lly, lieted below is information regarding common practices and procedures that may arise during It~e term
ot your renud.
THE RE-LEVELING OF THE MODULAR due to adverse rot· condiUons (wemese. settfifig, unitable ground. etc.)
2. THE RE-LEVELING OF THE MODULAR if it comes off o! its ,~ck stands due to wind, unlt~ble ground or any other outside force.
3. THE RE-LEVELING OF THE MODULAR if it comes out of &dju~tment due to furniture, files, ate., inNde the modular.
ADDmONAL SET-UP TIME due to unlevei ~ita conditionl, MMMC defines I level lite for D.O.H. modularl as follows: Length - no
greater than a 6' drop in 60', W'm'th - no greater than · 3' drop in 24'. TO HELP AVOID THIS CHARGE, PLEASE MAKE MMMC AWARE OF YOUR

7. MUDDY/INACCESSIBLE SITE. This situa!ion requires 4-whsel drive #rvice to remove or ~pot the modular.
REPAIR CALLS/~AMAGES. MMMC will ~o its utmolt to expedite warranted rel~ir work. However, if the rel~ir is requested and the
cause relates to the use ol equipment beyon~ what ie considered normal wear and tear, abu#, neglect, or the warranty period has
expired, the levee/buyer will be charged lot the sen~ce rail. Common arees of CHARGE BACKS are: Improper or
inadequate electrical hookup, Mrload on receptacles. thppKI or blown circuit breakers, the~mo~at improperly set or let below 70
degrees, aupply air regislats (vents) improperly ~et, dimly HVAC flit·fl, damaged flooring due to · i&ck of chair mats, and
misinlormatJon provided by the lessee/buyer.
MMMC wants to respond as Quickly and efficienUy to your sewice request as podbee. In order to do ~o please provide the following
inlormatton whenever requesting eelice:
1) Company name
2) Contract number
3) Exact location of the modular(s)
4) Com~ct per~o~ who is info,ned o~ both the nature and the Iotalion of the problem and who will be available to meet with our
r, ermciperlon
The lessee/buyer mull contact MMMC and receive its approval prior to performing any warranted rel~ir wo~. In the event that
prior approval is not recei~ed, any re~ulting charges from the Ifisee/buyar to MMMC will not be reimbur~d.
Please be ·ware that we will &ttampt to troubleshoot certain repairs by. phone when you call. For your information 80-90~ of all
repair calls on electzical and/or HVAC problems relate to levee/buyer error in electScat hook-up or operation. Plaice make sure
that you are hookKI up properly to avoid unnece~ary chargel.
HEATING/AIR CONDmONING FILTERS. Please be ewere that it is the le~ee/buyor's rem~oneibUity to chlnge the heating/air
conditioning filter(s) ·very three (3) months or sooner (in duaty areas), to help in~ure ~'rmoth running o! the heating/air unit(I).
If a sendice cell i· mode and the problem tums out to be · dirty filter, the le~/buyer will be charged for the ler~ice earl.
10.
HVAC SERVICE CALLS. Pieale be aware that heabnglair co~dYdoning sendice carls can take up totwo (2) weeks to CMTmCt
depending Ul~m the nature ot the problem. MMMC does not like the delay anymore thaiour cullom·rs do, but, unfortunately, we are
limetad by the mamJlectorar's (heating/mr conditioning) service nero·d(. Whenever po~ible MMMC will do HI ut~olt to exitdate your

REPAIR OF LEAKS. It is not uncommon lot leaks to occur on a modular e~mciaily on a reeendy delivered or relocated one. In
order to seal these leakl properly it requires I dry surface. MMMC will do its utmost to seas any leaks in · timely manner. once the
walther permits.

12. ROOF RUMBLES. There is no warranty or guarantee against roof rumbles.

MODULAR PLACEMENT. It ie the lesseeh)u~r'e responlibility to direct the dmmr on exact planemeN of the modular. We
recommend that the lite be clearly marked to t~,ilitete thai. Be aware that on multi-wide modulefl. the letup crew that follows the
driver does not I~ave the ability to move the modulars more than a law feel Ex~'a charges may re,lit if addibonal movement is
required.
15.
RELOCATING OF EQUIPMENT'. Under no circumstances tall any modular be relo<'4tad from its original point of delivery without
MMMC's consent. Under most circumstances. MMMC will relocate the soduser and charge the lessee/Du~r accordingly. The decision Is
to who and how the modular is to be relocated rests ~oiely with MMMC.
16.
RETURN DELIVERY PROCEDURE'. MMMC requires a minimum of ~0 DAYS NOTICE for return delivery of modulers. Upon n~dyng MMMC
that you wit to schedule re~Jrn delivery pieale provide your =~n~act number. MklklC will do ill utm= to expedite your return
delivery request. The Itsted rental term on )'our rental agreement dOel no( relieve the lessee/twyer of having to give 30 DAYS NOTICF--
Upon scheduling o! the return delivery it il the lessee re~oonsibility to advise MMMC if the wheels. firel, Lxles or towbar have been
removed from the modular. Additionally. it is the eelsee responsibility to advise MMMC if IkJ~ng or' tiedowns are attached to the
modular. it is silo the lessee Pe~=(~heibili[y ~.o inlorm MMMC o~ any adverse site conditions or agoess problems that might exist
prior to return delivery. Finally. the eelsee must have all utilities disconnected from the mociular prior to MMMC arriving It the
site to begin the dismantle.
Please be aware that the lessee ie resportsible for the condition of the modular up until the time that MMMO removes it from your
site. MMMC strongly suggestl that the eelsee have personnel at the site upon pick-up to sign for the modular. Additionally. MMMC il
NOT re~oonsible for any furniture. supplies. phone equipment. or any other Iteml that the lessee hal sealed to remove prior to return
of the modular. Upon tatum of the modular to MMMC'I inventory center an inspecbon of the buildingl will be pertoaf(t; (if requested
in advance. an inspection can be done in t~e field for an &dditional charge). NI damages or other needed wmlc to return the modular
to its original condition will be billed for upon complMion of Ihil inspection report.
17. SKIRTING REMOVAL'. Unless otherwise noted on the con~ract agreement. skirting removal is the responsibility of the lessee. At
the leesee's request MMMO will perform thil work at an additional co~t. Our charges will include Ikirt removal. towbar inl~Jllation.
and stacking the skirting neatly at your lite. The lessee may remove the Ikirbng and install the towbari to avoid this charge.
18. DELIVERY, RELOCATION. OR RETURN DELIVERY TIMES. Due to untoresssn dalay~ related to weather. traffic or a prior haul, MMMC
cannot guarsntee specific time,1 on deliv&ric,~. r=[urn de:iveries, or relocates.
19.
CLEANING DEPOSIT'. MMMC charges a S75.00 cleaning/key depoMt. (Der module, on all contracal. This deposit il refondable only
it the modular is returned in a cleanliness condition equal to or better than when it wal originally Ihipped. Charges for ~amlges to
the modular will be billed for separately as outlined it)Dye.
20.
PRORATION OF RENT'. MMMC prorates rent in one-half (1/2) month increments only. Any modular on rent beyond Ihe 14th day of I
billing cycle will be responsible for the lull months rental payment. Under no circum~ncel will any rental be for less than two
(2) months.
21.
DEPARTMENT OF HOUSING & COMMUNITY DEVELOPMENT {DOll) ANNUAL REGISTRATION FEES'. NI pricing to DOH annual registration
lee exempt organizabonl.as~Jmes that lessee/buyer.will complete all required forms, el I1Jpplied by MMMC. in order to effect In exempt
statul for the building(I) during the rental term. pri~'~to delivery of the building(s). MMMC~ will lubmit ~uch completed k)rml to the
State.
22. RAMPS & SEISMIC SUPPORT SYSTEMS. These iteml are not provided by MMMC unless specittceily noted on the cone'lot.
23. KEYS' If ke~ are not returned with the building. the levee will be amazed I re-E'e~ing charge. If fockNta are altered and no(
returned to their original condiUon. charges may be assessed.
