A Development Review Committee meeting was held on April 24, 2003. As a result of the Development Review Committee meeting the applicant made revisions and submitted them for staff's review on June 17, 2003. Staff received final exhibits on July 30, 2003, and the project was placed on the September 17, 2003 Planning Commission Agenda. PROJECT DESCRIPTION The applicant is requesting a conditional use permit to expand the existing school site by seven classrooms. Currently, there are seven classrooms within the existing classroom building. According to the Letter of Justification (see attached) submitted by the applicant, the requested expansion will meet the needs for the parish for their office employees and Catechism classes. The current office portion does not adequately provide enough space for their current staff. The proposed Development Plan is for the construction of a 10,902 square foot classroom building, a 2,301 square foot office addition and the remodel of an existing classroom building. The proposed 10,902 square foot classroom building is located on an existing pad, which is visible from Santiago Road and "C" Street. The existing pad area is a landscaped area that will need to be eliminated to make room for the expansion. The proposed remodel is for the existing classroom building. The applicant is proposing to paint the existing classroom building to match the proposed buildings and the other existing buildings on site. The site currently consists of a 16,310 square foot sanctuary building, an 11,401 square foot social hall building, and a 4,009 square foot classroom building. The site is accessed from two driveways off of "C" Street. The proposed 2,301 square foot office addition building will be located directly adjacent to the existing social hall. No parking spaces will be eliminated, as a part of the expansion.. The site currently has 391 parking spaces with the majodty of the parking located directly adjacent to the main sanctuary. The applicant is proposing to construct the expansion utilizing the same colors and materials as the colors and materials on the existing buildings. The present use is compatible with the surrounding uses and there have been no complaints filed with the City about the uses currently taking place at Saint Catherine's. The intent of the proposed expansion will permit Saint Catherine's to adequately serve their existing membem and employees. Staff has determined that the expansion will not increase the current traffic trips generated to and from the site. The proposed project is located in Planning Area 18 of the Rancho Highlands Specific Plan. Because the Rancho Highlands Specific Plan is silent on landscape requirements and building design, staff utilized the standards specified in the Development Code (Section 17.06.050 N) and the City Wide Design Guidelines. The proposed site planning and circulation is consistent with the commercial development performance standards in the Development Code. The proposed site plan has eliminated any conflicts between pedestrian and vehicular traffic by locating the pedestrian access parallel with the vehicular access. The loading and unloading areas have been located at the west side of the proposed classroom building and will not be visible from the public right of way. The proposed building design is consistent with the architectural design of the Development Code, the architectural elements in the City-Wide Design Guidelines and the existing architecture for the site. Providing the three foot recessed windows along the front elevation has broken up the mass and bulk of the proposed building and is consistent with the existing windows on the sanctuary building. The terraced slope located along the front elevation of the proposed classroom building serves to break up the height of the building visible from the public right of way. The colors and materials serve to complement the design theme for the existing buildings on the site. The proposed roofing materials and roof pitches are similar to the existing buildings and serve to break up the massing of the buildings from the existing single-family residences. The proposed landscaping exceeds the minimum requirements of the Development Code and complements the architectural design theme. Staff has determined that the deletion of the landscaping area where the proposed classroom building is to be located does not detract from the overall quality of the site. The applicant is proposing to add landscaping on all four sides of the office addition excluding the walkways, along the front slope area of the proposed classroom building, and on both sides of the existing classroom building adjacent to the parking lot. The additional landscaping will compliment an existing site that is well landscaped and maintained. ENVIRONMENTAL DETERMINATION The project is exempt from environmental review based on Section 15314 (Minor Additions to Schools) of the California Environmental Quality Act and there are no potentially significant environmental constraints on the site. The entire site has been previously graded and developed. The project qualifies for a Class 14 exemption because the proposed expansion will not increase the current student capacity by 25% and will not be adding more than 10 new classrooms. CONCLUSION/RECOMMENDATION Staff has determined that the proposed project is consistent with the City's Design Guidelines and conforms to all of the applicable development regulations contained within the Rancho Highlands Specific Plan. Staff recommends approval of the Conditional Use Permit and Development Plan with the attached findings and conditions of approval. The proposed expansion to the existing Saint Catherine of Alexandria Sanctuary is consistent with the Land Use Element of the general plan. The proposed educational and meeting room and expansion of the school site meets the purpose and intent of a conditional use permit as defined in Section 17.04.010A of the development code. The church and school use is the identified use for the site within the Rancho Highlands Specific Plan. The proposed conditional use is compatible with the nature, condition and development of adjacent uses, buildings and structures and the proposed conditional use will not advemely affect the adjacent uses, buildings or structures. The proposed conditional use is compatible with adjacent land uses as defined in the general plan. Staff has reviewed the proposed expansion against the adjacent land uses and has determined that the proposed uses will be a complimentary addition to the area. The church has been operational for over ten years with no adverse affects on the adjacent properties. The site for a proposed conditional use is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, buffer areas, landscaping, and other development features prescribed in the development code and required by the planning commission or council in order to integrate the use with other uses in the neighborhood. Staff has reviewed the proposed project against the Rancho Highlands Specific Plan requirements for a Chumh/School facility and has found that the project meets or exceeds all of the requirements. The nature of the proposed conditional use is not detrimental to the health, safety and general welfare of the community. Staff has reviewed the proposed expansion to the Church/School facility and found that it in no way will be detrimental to the health, safety, or general welfare of the community. Ingress and egress to the site has not been relocated from its original location off of "C" Street. Fire Prevention has reviewed circulation and drive aisle widths and has determined that the site will able to be adequately sen/ed by the Fire Department in an emergency situation. That the decision to approve, conditionally approve, or deny the application for a conditional use permit be based on substantial evidence in view of the record as a whole before the Planning Commission or City Council. This application has been brought before the Planning Commission at a Public Hearing where members of the public have had an opportunity to be heard on this matter before the Planning Commission renders their decision. R:\C U P',2003\03-0167 St. Catherine of AlcxandfiaXStaff Report.doc 4 Development Plan (Section 17.05.01 OF) The proposed use is in conformance with the General Plan for Temecula and with all applicable requirements of state law and other ordinances of the city. The proposal is consistent with the land use designation and policies reflected for Low Medium Density Residential (LM) development in the City of Temecula General Plan, as well as the development standards for Planning Area 19 located in the Rancho Highlands Specific Plan. The site is therefore properly planned and zoned and found to be physically suitable for the type and density of the proposed Expansion to the existing Saint Catherine of Alexandria Sanctuary. The overall development of the land is designed for the protection of the public health, safety, and general welfare. The architecture proposed for the building is consistent with the Architectural requirements as stated in the Design Guidelines and the Commercial Performance Standards of the Development Code. The project has been reviewed for, and as conditioned, has been found to be consistent with, all applicable policies, guidelines, standards and regulations intended to ensure that the development will be constructed and function in ~ manner consistent with the public health, safety and welfare. WHEREAS, Bennett Lord, filed Planning Application No. PA03-0167 (Conditional Use Permit and Development Plan), in a manner in accord with the City of Temecula General Plan and Development Code; WHEREAS, the Application was processed including, but not limited to a public notice, in the time and manner prescribed by State and local law; WHEREAS, the Planning Commission, at a regular meeting, considered the Application on September 17, 2003, at a duly noticed public hearing as prescribed by law, at which time the City staff and interested persons had an opportunity to and did testify either in support or in opposition to this matter; WHEREAS, at the conclusion of the Commission hearing and after due consideration of the testimony, the Commission recommended approval of the Application subject to and based upon the findings set forth hereunder; WHEREAS, all legal preconditions to the adoption of this Resolution have occurred. A Consistency Check fee shall be paid per the City of Temecula Fee Schedule. 19. An appropriate method for screening the gas meters and other externally mounted utility equipment shall be reviewed and approved by the Planning Department. 20. A separate building permit shall be required for all signage. 21. The construction plans shall indicate the application of painted rooftop addressing plotted on a 9-inch grid pattern with 45-inch tall numerals spaced 9-inch apart. The numerals shall be painted with a standard 9-inch paint roller using fluorescent yellow paint applied over a contrasting background. The property owner shall fully install all required landscaping and irrigation, and submit a landscape maintenance bond in a form and amount approved by the Planning Department for a period of one-year from the date of the first occupancy permit. 25. All of the foregoing conditions shall be complied with prior to occupancy or any use allowed by this permit. DEPARTMENT OF PUBLIC WORKS 26, Unless otherwise noted, all conditions shall be completed by the Developer at no cost to any Government Agency. It is understood that the Developer correctly shows on the site plan all existing and proposed property lines, easements, traveled ways, improvement constraints and drainage courses, and their omission may require the project to be resubmitted for further review and revision. General Requirements 27, A Grading Permit for precise grading, including all on-site flat work and improvements, shall be obtained from the Department of Public Works prior to commencement of any construction outside of the City-maintained street right-of-way. 28. All grading plans shall be coordinated for consistency with adjacent projects and existing improvements contiguous, to the site and shall be submitted on standard 24" x 36" City of Temecula mylars, Prior to Issuance of a Grading Permit 29. A Grading Plan shall be prepared by a registered Civil Engineer and shall be reviewed and approved by the Department of Public Works. The grading plan shall include all necessary erosion control measures needed to adequately protect adjacent public and private property. 30. The Developer shall post secudty and enter into an agreement guaranteeing the grading and erosion control improvements in conformance with applicable City Standards and subject to approval by the Department of Public Works. 31. A Soil Report shall be prepared by a registered Soil or Civil Engineer and submitted to the Director of the Department of Public Works with the initial grading plan check. The report shall address all soils conditions of the site, and provide recommendations for the construction of engineered structures and pavement sections. 32. The Developer must comply with the requirements of the National Pollutant Discharge Elimination System (NPDES) permit from the State Water Resources Control Board. No grading shall be permitted until an NPDES Notice of Intent (NOI) has been filed or the project is shown to be exempt. 33. The following design criteria shall be observed: a. Flowline grades shall be 0,5% minimum over P.C.C. and 1.00% minimum over A.C. paving. b. The Developer shall pay to the City the Western RiverSide County Transportation Uniform Mitigation Fee (TUMF) Program as required by, and in accordance with, Chapter 15.08 of the Temecula Municipal Code and all Resolutions implementing Chapter 15.08. 39. Prior to Issuance of a Certificate of Occupancy 40, As deemed necessary by the Department of Public Works, the Developer shall receive written clearance from the following agencies: a. Any appurtenance damaged or broken shall be repaired or removed and replaced to the satisfaction of the Director of the Department of Public Works. FIRE DEPARTMENT 42. The following are the Fire Department Conditions of Approval for this project. All questions regarding the meaning of these conditions shall be referred to the Fire Prevention Bureau. 43. Final fire and life safety conditions will be addressed when building plans are reviewed by the Fire Prevention Bureau. California Building Code (CBC), California Fire Code (CFC), and related codes, which are in foroe at the time of building, plan submittal. The Fire Prevention Bureau is required to set a minimum fire flow for the remodel or construction of all commeroial buildings per CFC Appendix III.A, Table A-III-A-1. The developer shall provide for this project, a water system capable of delivering 1500 GPM at 20 PSI residual operating pressure, plus an assumed sprinkler demand of 400 GPM for a total fire flow of 1900 GPM with a 2 hour duration. The required fire flow may be adjusted during the approval process to reflect changes in design, construction type, or automatic tire protection measures as approved by the Fire Prevention Bureau. The Fire Flow as given above has taken into account all information as provided. (CFC 903.2, Appendix Ill-A) The Fire Prevention Bureau is required to set minimum fire hydrant distances per CFC Appendix Ill-B, Table A-III-B-1. A minimum of 2 hydrants, in a combination of on-site and off- site (6" x 4" x 2-2 1/2" outlets) shall be located on Fire Department access roads and adjacent public streets. Hydrants shall be spaced at 450 feet apart, at each intersection and shall be located no more than 225 feet from any point on the street or Fire Department access road(s) frontage to a hydrant. The required fire flow shall be available from any adjacent hydrant(s) in the system. The upgrade of existing fire hydrants WILL be required. An additional hydrant is required to the rear of the classroom building. (CFC 903.2, 903.4.2, and Appendix Ill-B) As required by the California Fire Code, when any portion of the facility is in excess of 150 feet from a water supply on a public street, as measured by an approved route around the exterior of the facility, on-site fire hydrants and mains capable of supplying the required fire flow shall be provided. For this project on site fire hydrants are required. (CFC 903.2) If construction is phased, each phase shall provide approved access and fire protection pdor to any building construction. (CFC 8704.2 and 902.2.2) Prior to building construction, all locations where structures are to be built shall have approved temporary Fire Department vehicle access roads for use until permanent roads are installed. Temporary Fire Department access roads shall be an all weather sur[ace for 80,000 lbs. GVVV. (CFC 8704.2 and 902.2.2.2) Prior to building final, all locations where structures are to be built shall have approved Fire Department vehicle access roads to within 150 feet to any portion of the facility or any portion of an exterior wall of the building(s). Fire Department access roads shall be an all weather sudace designed for 80,000 lbs. GVVV with a minimum AC thickness of .25 feet. (CFC sec 902) Fire Department vehicle access roads shall have an unobstructed width of not less than twenty-four (24) feet and an unobstructed vertical clearance of not less than thirteen (13) feet six (6) inches. (CFC 902.2.2.1) Prior to issuance of building permits, the developer shall furnish one copy of the water system plans to the Fire Prevention Bureau for approval prior to installation. Plans shall be signed by a registered civil engineer; contain a Fire Prevention Bureau approval signature block; and conform to hydrant type, location, and spacing and minimum fire flow standards. After the plans are signed by the local water company, the originals shall be presented to the Fire Prevention Bureau for signatures. (CFC 8704.3, 901.2.2.2 and National Fire Protection Association 24 1-4.1) 52. Prior to issuance of a Certificate of Occupancy or building final, "Blue Reflective Markers" shall be installed to identify fire hydrant locations. (CFC 901.4.3) 53. Prior to issuance of a Certificate of Occupancy or building final, approved numbers or addresses shall be provided on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Numbers shall be of a contrasting color to their background. Commercial, multi-family residential and industrial buildings shall have a minimum twelve (12) inches numbers with suite numbers a minimum of six (6) inches in size. All suites shall have a minimum of six (6) inch high lettem and/or numbers on both the front and rear doors. Single family residences and multi-family residential units shall have four (4) inch letters and/or numbers, as approved by the Fire Prevention Bureau. (CFC 901.4.4) 54. Prior to issuance of Certificate of Occupancy or building final, based on square footage and type of construction, occupancy or use, the developer shall install a fire sprinkler system. Fire sprinkler plans shall be submitted to the Fire Prevention Bureau for approval prior to installation. (CFC Article 10, CBC Chapter 9) 55. Prior to issuance of Certificate of Occupancy or building final, based on a requirement for monitoring the sprinkler system, occupancy or use, the developer shall install an fire alarm system monitored by an approved Underwritem Laboratory listed central station. Plans shall be submitted to the Fire Prevention Bureau for approval prior to installation. (CFC Article 10) 56. Prior to the issuance of a Certificate of Occupancy or building final, a "Knox-Box" shall be provided. The Knox-Box shall be installed a minimum of six (8) feet in height and be located to the right side of the main entrance door. (CFC 902.4) 57. All manual and electronic gates on required Fire Department access roads or gates obstructing Fire Department building access shall be provided with the Knox Rapid entry system for emergency access by fire fighting personnel. (CFC Appendix II-E) 62. During additional construction all ACCESS and FIRE SAFETY SYSTEMS will be maintained in proper working condition acceptable to the Chief. BUILDING AND SAFETY 63. All design components shall comply with applicable provisions of the 2001 edition of the California Building, Plumbing and Mechanical Codes; 2001 California Electrical Code; California Administrative Code, Title 24 Energy Code, California Title 24 Disabled Access Regulations, and the Temecula Municipal Code. 64. The City of Temecula has adopted an ordinance to collect fees for a Riverside County area wide Transportation Uniform Mitigation Fee (TUMF). Upon the adoption of this ordinance on Mamh 31,2003, this project will be subject to payment of these fees at the time of building permit issuance. The fees shall be subject to the previsions of Ordinance 03-01 and the fee schedule in effect at the time of building permit issuance. 65. Submit at time of plan review, a complete exterior site lighting plans showing compliance with Ordinance No. 655 for the regulation of light pollution. All street lights and other outdoor lighting shall be shown on electrical plans submitted to the Department of Building and Safety. Any outside lighting shall be hooded and directed so as not to shine directly upon adjoining property or public rights-of-way. 66. The trash enclosures shall be large enough to accommodate a recycling bin, as well as, regular solid waste containers. 79. The City of Temecula's Multi-Use Trail and Bikeways Master Plan has identified a Class I six (6) foot wide multi-use trail along Santiago Road from C Street to the Santiago Road Bridge. The M-1 trail design shall include a DG surface with a two rail split rail fence separating the trail from the three (3) foot wide planter area and sidewalk. 80. All parkways and trails including areas within the right of way, landscaping, fencing and on- site lighting shall be maintained by the property owner or maintenance association. 81. However, the parish has been ~valuating its present circumstances and program challenges and the parish has determined that they have inadequate facilities for their needs. The application includes a proposal that breaks down into three parts. The first part is a one-story expansion of the existing parish offices to allow the parish staff to operate in less crowded facilities and handle the expanded ministries. The second portion of the proposal is to perform a minor remodel to the oldest and smallest building on the campus and upgrade its exterior to match with the other buildings. The third and largest portion of our proposal is the construction of a new two-story classroom structure. The added classrooms are 'intended to fulfill a need for a consolidated facility for religious education. Presently, the parish conducts its religious education classes in whatever spaces are available, in a chaotic and inefficient manner. It is important to note the following about the attached proposal. In large part, the goal of this project is to handle an existing classroom and staffing need ra~ther than respond to a growing parish population. It is also significant, that the parking needs for the parish will not change. The church remains the biggest assembly space on the campus and generates all of the parking needs. The other assembly facilities on campus are not used simultaneously with services in the church. On Sundays, the classrooms will be used for religious education but the students are all below driving age and attend classes while their parents are in the church. ,Thus there is no increase in the need for parking spaces. In summary, the proposed project is entirely compatible with the existing uses on the campus and will have a negligible affect upon the existing traffic or developments in the area. The parish will, in the long run be more appropriately organized and efficient than it is at the present. Section 17.10 of the Development Code allows amades subject to Planning Commission approval of a Minor Conditional Use Permit The proposed computer network and gaming facility is currently operating. Code Enforcement Division has cited the facility for operating without a Minor Conditional Use Permit. An application for a Minor Conditional Use Permit was submitted to the Planning Department on Mamh 20, 2003. Staff requested additional information on Apdl 3, 2003. The applicant submitted the requested information on May 2, 2003. Staff has since conducted reseamh on the commemial center to determine the extent of potential nuisances within the shopping center. PROJECT DESCRIPTION The applicant is requesting a Minor Conditional Use Permit to operate a computer network and Intemet gaming facility. The facility is proposed on the west side of Jefferson Avenue, approximately 260 feet south of Via Montezuma. The proposed computer network and Internet gaming facility includes approximately 50 computer stations for internet and personal use, custom computer building and repair, web page design and graphic design. In addition, the project facility will provide periodic computer training classes on and off-site. The applicant has proposed the hours of operation to be Monday through Friday 2:00 P.M. to midnight and Saturday and Sunda~, 10:00 A.M. to midnight. The applicant has requested the flexibility for extended summer and holiday hours, however no exact times have been proposed. If the applicant requests extended hours of operation for summer and/or holidays, a Temporary Use Permit will be required. The internal facility will be continuously recorded via camera surveillance and an on-site security guard will be provided. ANALYSIS Use The Planning Commission has the discretion to apply operational conditions deemed necessary to make the findings of approval, including, but not limited to the following: Need for adult supervision, · Hours of operation, · Inside and outside security measures, · Noise attenuation, · Bicycle facilities, and · Interior waiting area. The primary concerns of staff include the potential violations of curfew for minors, viewing of adult material, hours of operation, access to and from the building, and loitering. Staff has discussed the City curlew Ordinance with the Police Department and the Police Department has indicated that this facility will be patrolled similar to night clubs and barn. The Police Department will perform periodic field investigations to determine if there ara any problems, or in this case, if minors are in violation of the City curfew Ordinance. This is a standard operation procedure performed by the Police Department, which ensures compliance with the City curfew Ordinance. Staff has also been in discussion with the applicant concerning adult oriented material. As a condition of approval the viewing of adult material is not permitted within the facility. The applicant has assured staff that all computers within the facility maintain a filter system and any attempt by customers to view such material will automatically alert the stora personnel. City of Temecula Police Department has reviewed the proposed project and concurs with the requested hours of operation. They ara as follows: Monday- Friday: 2:00 P.M. - 12:00 A.M. Saturday and Sunday: 10:00 A.M. - 12:00 A.M. The applicant has indicated in the statement of operations, that a security guard will be provided in addition to. recorded camera surveillance. At a minimum, the Conditions of Approval require an adult, no less than 21 years of age to be prasent during hours of operation from Sunday through Thursday and two adult supervisors on Friday and Saturday. Staff has included a condition of approval that the rear door is to be used for emergency purposes only and shall not be used for daily customer use. The applicant is raquired to post "No Loitering" signs throughout the shopping center. ENVIRONMENTAL DETERMINATION Staff has reviewed the project for compliance with the California Environmental Quality Act. Based on staff's review, the proposed project is eligible for a CEQA exemption (Class 1- Existing Facilities) pursuant to Section 15301 of the CEQA Guidelines. SUMMARY/CONCLUSIONS Staff believes the raquired findings necessary to approve a computer network and Internet gaming facility in the Community Commercial zoning district can be made. The project, as proposed and as conditioned, complies with all applicable development standards of the Community Commercial zoning district. Staff believes the proposed computer network and Internet gaming facility is compatible with the surrounding environment. The City ordinance pertaining to curfew for minors will be in effect, raasonable hours of operation have been applied, no loitering on-site will be permitted, viewing of adult material is prohibited, on-site security will be provided and access to and from the rear of the building will be limited during normal business hours. FINDINGS Conditional Use Permit (17.04.010E) The proposed conditional use is consistent with the General Plan and the development code. General Requirements The applicant and owner of the real property subject to this condition shall hereby agree to indemnify, protect, hold harmless, and defend the City with Legal Counsel of the Ci~s own selection from any and all claims, actions, awards, judgments, or proceedings against the City to attack, set aside, annul, or seek monetary damages resulting, directly or indirectly, from any action in furtherance of and the approval of the City, or any agency or instrumentality thereof, advisory agency, appeal board or legislative body including actions approved by the voters of the City, concerning the Planning Application. The City shall be deemed for purposes of this condition, to include any agency or instrumentality thereof, or any of its elected or appointed officials, officers, employees, consultants, contractors, legal counsel, and agents. City shall promptly notify both the applicant and landowner of any claim, action, or proceeding to which this condition is applicable and shall further cooperate fully in the defense of the action. The City reserves the right to take any and all action the City deems to be in the best interest of the City and its citizens in regards to such defense. This approval shall be used within two (2) years of the approval date; otherwise, it shall become null and void. By use is meant the beginning of substantial construction contemplated by this approval within the two (2) year period, which is thereafter diligently pursued to completion, or the beginning of substantial utilization contemplated by this approval. This Conditional Use Permit may be revoked pursuant to Section 17.03.080 of the Cites Development Code. The permittee shall obtain City approval for any modifications or revisions to the approval of this Conditional Use Permit. The development of the premises shall substantially conform to the approved Exhibits D (Floor Plan), contained on file with the Community Development Department - Planning Division. The applicant shall comply with their Statement of Operations dated 3/30/03, on file with the Community Development Department - Planning Division, unless superceded by these conditions of approval. The regular hours of operation shall be as follows: Monday- Friday ~ 2:00 pm - 12:00 am Saturday - Sunday 10:00 am - 12:00 am 10. The applicant shall post at least three (3) "No Loitering" signs throughout the project site subject to approval by the Planning Director (Business and Profession Code 26501). 11. At least one adult providing on-site supervision and security shall be provided on the premises during all hours of operation. 12. The applicant shall maintain an interior waiting area for no less than five (5) customers. 13. The rear door shall be used for emergency purposes only and shall not be used for customers as exit/entrance privileges. 14. The applicant shall fumish one (1) bicycle rack (4 total spaces) on the project si.t~e, subject to approval by the Planning Director. POLICE DEPARTMENT 15. Currently, the Temecula Police Department concurs with the requested hours of operation, as indicated in the statement of operations. However, if any recurring problems should occur where the need for police response is needed due to the late hours of operations or for any other reasons, the Temecula Police Department, at it's discretion, reserves the right to approach the City's Planning Commission and request the hours of operation be amended. 16. 17. The sales and/or use of any alcoholic beverages on premises and surrounding area of responsibility is prohibited in accordance with City Ordinance 97-07, (9.14.010 TMC series) Applicant will ensure no loitering, disorderly house (Business and Profession Code 26501 ) occurs on or adjacent to its premises during hours of operation. Applicant will ensure juveniles are not exposed to any display of adult materials and ensure this type of adult entertainment is not present on site per City Municipal Code 9.04.020 TMC. 19. Applicant will familiarize employees with City Municipal Code 9.12.010 TMC, curfew for minors. 20. Applicant will ensure that at least one adult supervision (age twenty-one years or older) be on the premises at all times during hours of operation from Sunday through Thursday and two adult supervision on Friday and Saturday. The Temecula Police Department concurs with applicants' Letter of Justification in providing a security guard on premises dudng hours of operation. If Secudty officer(s) are provided, they must be identified in uniform. Secudty officer will not be armed with any type of firearms (weapon). This does not include mace or pepper spray. 21. Applicant will be responsible for any cost incurred by the Police Department if additional officers are required because of traffic problems/congestions, public disturbance or where the need for police presence is required. BUILDING AND SAFETY DEPARTMENT 22. All design components shall comply with applicable provisions of the 2001 edition of the California Building, Plumbing and Mechanical Codes; 1998 National Electrical Code; California Administrative Code, Title 24 Energy and Disabled Access Regulations and the Temecula Municipal Code. 23. Obtain all building plans and permit approvals prior to commencement of any construction work. 24. All building and facilities must comply with applicable disabled access regulations. Code Enforcement in cooperation with the Planning Department has permitted this business to operate pending the outcome of this application. The application was deemed incomplete and the requested material was not provided until March 3, 2003. A study of the property was conducted by the Police Department in March to assess the clientele attending the facility. Staff has since conducted research on similar businesses to determine the extent of potential nuisances that may accompany this use within the commercial center. PROJECT DESCRIPTION The applicant is requesting a Minor Conditional Use Permit to operate an Internet arcade/caf~ in a commercial center that provides entertainment for customers primarily between 15-25 years of age. This facility will offer the customers a supervised place to browse the Internet and to play in multiplayer games against each other. The proposed facility will have approximately 70 computer stations. The facility is proposed on the west side of Jefferson Avenue, approximately 600 feet north of Winchester Road. The applicant has proposed the hours of operation of Sunday through Thursday 10:00 A.M. to 2:00 A,M. and Friday and Saturday 10:00 A.M. to 4 A.M, The expected peak hours of operation are between 6:30 P.M. and 2:00 A.M. when most other business in this small center are either closed or near closing for the evening. An adult supervisor will be in attendance at all times and the facility will operate surveillance cameras for security purposes. ANALYSIS Use The City Attorney has determined that the proposed use is similar to an arcade use and shall be subject to any/all requirements for arcades. Section 17.10 of the Development Code allows arcades subject to the approval of a Conditional Use Permit by the Planning Commission. The Planning Commission has the discretion to apply any condition deemed necessary including the following: · Need for adult supervision · Hours of operation · Inside and outside security measures · Noise attenuation · Bicycle facilities · Interior waiting area R:',M C U F~2.002~02-0701 Lanwerx Arcade\Staff Report.doc 2 The primary concerns of staff include the potential violations of curfew for minors, viewing of adult material, hours of operation, access to and from the building and loitering. The project is required to implement the City Ordinance curfew for minors, which prohibits the "presence of minors (any person under the age of 18 years old) in or upon public or private streets, road, drive, alley or trail; any public or community park or recreation area; any public ground, place or building; or any vacant lot or abandoned or vacant building between the hours of 10:00 P.M. and the time of sunrise of the following day." The City Ordinance sets forth exceptions and permits a minor's presence '~vhen engaged in or going directly to or returning directly form any lawful activity with written permission from a custodial person over the age of eighteen years of age." Staff has been in discussion with the applicant concerning adult oriented material. As a condition of approval, the viewing of adult material is not permitted within the facility. The applicant has assured staff that all computers within the facility maintain a filter system and any attempt by customers to view such material will automatically alert the store personnel. City of Temecula Police Department surveyed this facility in March of this year. They assessed the number of individuals utilizing the facility at various late night hours. They found that all late night patrons (those after 11:20 p.m.) were adults with the exception the time period that coincided with the school district's spring break (See Attachment 3). The Police Department is willing to accept the applicant's requested hours of operation based on their knowledge the of late night activity and the fact that the police have not been summoned to this facility since it opened. However, the Police Department has included a condition they may request the Planning Commission amend the hours of operation should the department be involved with recurring problems at this facility. ENVIRONMENTAL DETERMINATION Staff has reviewed the project for compliance with the California Environmental Quality Act. Based on staff's review, the proposed project is eligible for a CEQA exemption (Class 1- Existing Facilities) pursuant to Section 15301 of the CEQA Guidelines. SUMMARY/CONCLUSIONS Staff believes the required findings necessary to approve an Internet/arcade caf~ in the Community Commercial zoning district can be made. The project, as proposed and as conditioned, complies with all applicable development standards of the Community Commercial zoning district. Staff believes the proposed InternetJarcade caf6 is compatible with the surrounding business. The City ordinance pertaining to curfew for minors will be in effect, reasonable hours of operation have been applied, no loitering on-site will be permitted, viewing of adult material is prohibited, and on-site supervision and security will be provided. FINDINGS Conditional Use Permit (17.04.010E) The proposed conditional use is consistent with the General Plan and the development code. General Requirements The applicant and owner of the real property subject to this condition shall hereby agree to indemnify, protect, hold harmless, and defend the City with Legal Counsel of the City's own selection from any and all claims, actions, awards, judgments, or proceedings against the City to attack, set aside, annul, or seek monetary damages resulting, directly or indirectly, from any action in furtherance of and the approval of the City, or any agency or instrumentality thereof, advisory agency, appeal board or legislative body including actions approved by the voters of the City, concerning the Planning Application. The City shall be deemed for purposes of this condition, to include any agency or instrumentality thereof, or any of its elected or appointed officials, officers, employees, consultants, contractors, legal counsel, and agents. City shall promptly notify both the applicant and landowner of any claim, action, or proceeding to which this condition is applicable and shall further cooperate fully in the defense of the action. The City reserves the right to take any and all action the City deems to be in the best interest of the City and its citizens in regards to such defense. By use is meant the beginning of substantial construction contemplated by this approval within the two (2) year period, which is thereafter diligently pursued to completion, or the beginning of substantial utilization contemplated by this approval. All conditions shall be complied with prior to any occupancy or use allowed by this conditional use permit. This Conditional Use Permit may be revoked pursuant to Section 17.03.080 of the City's Development Code. ° The permittee shall obtain City approval for any modifications or revisions to the approval of this Conditional Use Permit. The development of the premises shall substantially conform to the approved Exhibits D (Floor Plan), contained on file with the Planning Department. The applicant shall comply with their Statement of Operations, on file with the Planning Department, unless superceded by these conditions of approval. Regular hours of operations Shall be as follows; Sunday through Thursday: 10:00 a.m.- 2:00 a.m. Friday and Saturday:, 10:00 a.m. - 4:00 a.m. 10. The applicant shall post at least three (3) "No Loitering" signs throughout the project site subject to approval by the Planning Director (Business and Profession Code 26501). 11. At least one adult providing on-site supervision and security shall be provided on the premises during all hours of operation. 12. The applicant shall maintain an interior waiting area for no less than five (5) customers. 13. The rear door shall be used for emergency purposes only and shall not be used for customers as exit/entrance privileges. 14. The applicant shall furnish one (1) bicycle rack (4 total spaces) on the project site, subject to approval by the Planning Director. POLICE DEPARTMENT 15. Currently, the Temecula Police Department concurs with the hours of operations as indicated bythe applicant. However, if any recurring problems should occur where the need for police response is needed due to the late hours of operations or for any other reasons, the Temecula Police Department, at it's discretion, reserve the right to approach the City's Planning Commission and request the hours of operation be amended. 16. The sales and/or use of any alcoholic beverages on premises and surrounding area of responsibility is prohibited in accordance with City Ordinance 97-07, (9.14.010 TMC series) R:Wl C U P~002~02-0701 Lanwerx Arcade\Staff Repoll.doc 12 17. Applicant will ensure no loitering, disorderly house (Business and Profession Code 26501 ) occurs on or adjacent to its premises during hours of operation. 18. Applicant will ensure juveniles are not exposed to any display of adult materials and ensure this type of adult entertainment is not present on site per City Municipal Code 9.04.020 TMC. 19. Applicant will familiarize employees with City Municipal Code 9.12.010 TMC, curfew for minors. 20. Applicant will ensure that at least one adult supervision (age twenty-one years or older) be on the premises at all times during hours of operation from Sunday through Thursday and two adult supervision on Friday and Saturday. 21. Applicant will be responsible for any cost incurred by the Police Department if additional officers are required because of traffic problems/congestions, public disturbance or where th.~e need for police presence is required. BUILDING AND SAFETY DEPARTMENT 22. All design components shall comply with applicable provisions of the 2001 edition of the California Building, Plumbing and Mechanical Codes; 2001 California Electrical Code; California Administrative Code, Title 24 Energy Code, California Title 24 Disabled Access Regulations, and the Temecula Municipal Code. 23. Obtain all building plans and permit approvals prior tO commencement of any construction work. 24. All building and facilities must comply with applicable disabled access regulations. Provide all details on plans. (California Disabled Access Regulations effective April 1, 1998) 25. Restroom fixtures, number and type, to be in accordance with the provisions of the 2001 edition of the California Building Code Appendix 29. 26. Provide appropriate stamp of a registered professional with original signature on plans prior to permit issuance. 27. Provide electrical plan including load calculations and panel schedule, plumbing schematic and mechanical plan for plan review for any improvements proposed. FIRE DEPARTMENT 28. Final fire and life safety conditions will be addressed when building plans for any alteration are reviewed by the Fire Prevention Bureau, or a field inspection is performed. These conditions will be based on occupancy; use, the California Building Code (CBC), California Fire Code (CFC), and related codes, which are in force at the time of building, plan submittal. 29. Prior to the issuance of a Certificate of Occupancy or building final, a "Knox-Box" shall be provided, or a key provided for the common Knox Box. The Knox-Box shall be installed a minimum of six (8) feet in height and be located to the right side of the main entrance door. It is however the responsibility of the owner/operators of this establishment to keep the fire lanes open and passable at all times. 31. The applicant shall comply with the requirements of the Fire Code permit process and update any changes in the items and quantities approved as part of their Fire Code permit, or any change of use for this business. These changes shall be submitted to the Fire Prevention Bureau for review and approval per the Fire Code and is subject to inspection.
