A RESOLUTION OF THE CITY COUNC]IL OF THE CITY
OF TEMIECULA, CALIFORNIA, ORDERING THE
VACATION OF A PORTION OF SECOND STREET
SOUTHWESTERLY OF FRONT STREET PURSUANT TO
THE AUTHORITY PROVIDED BY CHAPTER 3, PART 3,
DIVISION 9 OF THE STREETS AND HIGHWAYS CODE.
WHEREAS, it appearing to the satisfaction of the City Council of the City of Temecula,
California, that a resolution of intent to vacate the hereafter portion of Second Street was duly
and regularly passed by the City Council of the City of Temecula on the 26th day of October,
1993, and that said resolution was posted in three (3) public places pursuant to Resolution No.
90-60, not more than fifteen (15) days from the date of passage or less than ten (10) days before
the time of the hearing on the said proposed vacation; and that a "Notice of Public Hearing" was
posted along the street to be considered for vacation in accordance with Chapter 3, Part 3,
Division 9 of the Streets and Highways Code and that said hearing on the proposed vacation
having regularly come before the City Council for hearing on the 26th day of October 1993, at
the hour of 7:00 P.M. on said day, the City Council having found from all the evidence
submitted that the hereinafter described portion of Second Street is unnecessary for present or
prospective street purpose.
NOW THEREFORE, it is hereby ordered that the portion of Second Street shown and
described on attachments "A -F" inclusive, is hereby vacated.
BE IT FURTHER RESOLVED that the City of Temecula does herewith reserve over
and upon the proposed vacation an easement to construct, maintain, operate, replace, remove
and renew sanitary sewers and storm drains and appurtenant structures in, upon, over, and
across a street or highway proposed to be vacated and, pursuant to any existing franchise or
renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew, and
enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment,
and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines,
and for the transportation or distribution of electric energy, petroleum and its products,
ammonia, and water, and for incidental purposes, including access to protect these works from
all hazards in, upon, and over the street easement thereof herein vacated.
BE IT FURTHER RESOLVED that the City Clerk shall cause a certified copy of this
resolution of vacation, attested by the City Clerk, to be recorded in the office of the Recorder
of the County of Riverside.

of Riverside, along with that portion of Front Street vacated by
resolution of the Board of Supervisors of Riverside County per
inst. no. 46491, recorded April 23, 1975, also that portion of Lot
12 in Block 30 and that portion of Front Street per Declaration of
Dedication recorded January 24,1980 as inst. no. 15986, as shown by
map on file in Book 15 of Maps, page 726, in the office of the
County Recorder, County of San Diego, State of California described
as follows:
Commencing at the centerline intersection of Second Street and
Front Street as shown on said map; thence South 4403012611 West
along the centerline of Second Street 30 feet to the True Point of
Beginning; thence South 45112913411 East 45 feet; thence South
8903012611 West 21.21 feet to a point on the southeasterly right of
way of Second Street; thence South 4403012611 West along said right
of way 270 feet; thence leaving said right of way North 45102913411
West 30 feet to a point on the centerline of Second Street; thence
North 44113012611 East along said centerline 285 feet to the True
Point of Beginning.

along the centerline of Second Street 115 feet to the True Point of
Beginning; thence continuing South 4403012611 West 200 feet; thence
leaving said centerline North 4502913411 West 30 feet to a point on
the northwesterly right of way of Second Street; thence North
