Since the Center for Disease Control and Prevention first confirmed the existence and potential spread of COVID-19, there has been significant escalation. On March 4, 2020, the Governor of the State of California proclaimed a state of emergency due to the spread of COVID- 19. On March 11, 2020 the World Health Organization declared the COVID-19 outbreak to be a pandemic. On March 13, 2020, the President of the United States made an emergency determination under the Robert T. Stafford Disaster Relief and Emergency Assistance Act in response to COVID-19. On March 16, 2020, the Riverside County Public Health Officer issued an order cancelling and prohibiting all gatherings in which ten or more people are expected to be present, subject to certain limited exceptions. On March 17, 2020, the City Manager of the City of Temecula issued a Declaration of Local Emergency related to the COVID-19 pandemic pursuant to Temecula Municipal Code Section 2.56.050. On March 24, 2020, April 28, 2020, and June 9, 2020 the City Council proclaimed the existence of a local emergency due to the COVID-19 pandemic. Government Code § 8630 and Temecula Municipal Code Chapter 2.56 provide that the City Council of the City of Temecula may proclaim the existence of a local emergency as defined by Government Code § 8558, subdivision (c). COVID-19 has created conditions that are or likely to be beyond the control of local resources and require the combined forces of other political subdivisions to combat. The mobilization of local resources, ability to coordinate interagency response, accelerate procurement of vital supplies, use mutual aid, and allow for future reimbursement by the state and federal governments will be critical to successfully responding to COVID-19. The conditions under which the City Council declared its March 24, 2020, April 28, 2020 and June 9, 2020 local emergency continue to exist. It is therefore recommended that the City Council adopt the attached resolution reaffirming and proclaiming the existence of a local emergency due to the COVID-19 pandemic. The City Council will continue to review this local emergency proclamation every sixty (60) days pursuant to Government Code Section 8630(c), and/or sooner as the Council determines (i.e., 30 days, etc.), and will terminate the emergency proclamation when the conditions warrant. Recitals. The City Council finds, determines and declares that: (a) Government Code § 8630 and Temecula Municipal Code Chapter 2.56 provide that the City Council of the City of Temecula may proclaim the existence of a local emergency as defined by Government Code § 8558, subdivision (c). (d) On March 4, 2020, Gavin Newsom, Governor of the State of California, proclaimed a state of emergency to exist in California due to the spread of COVID-19. (e) On March 11, 2020 the World Health Organization declared the COVID- 19 outbreak to be a pandemic. (f) On March 13, 2020, President Trump determined that the ongoing Coronavirus Disease 2019 (COVID-19) pandemic is of sufficient severity and magnitude to warrant an emergency determination under section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. 5121-5207. (g) Governor Newsom has issued several Executive Orders making certain findings and issuing emergency orders to deal with COVID-19 pandemic. These Executive Orders are listed and updated continuously at https://www. og v.ca.gov/category/executive-orders/. More Executive Orders are expected. (h) The California Department of Public Health reports a significant number of COVID-19 cases and deaths in the state. The number of cases and deaths are reported and updated at hgps://www.cdph.ca.gov/programs/cid/dcdc/pages/immunization/ncov20l9.aspx. (i) The Riverside County Public Health Officer has issued numerous Health Orders making certain findings and issuing emergency orders to deal with COVID-19 pandemic, including cancelling and prohibiting all gatherings and requiring all person to wear mask when outside of their homes. The Riverside County Health Officer's Orders are listed and updated continuously at https://www.riveoph.org/coronavirus. More Health Orders are expected. 0) The Governor's Executive Orders and Riverside County Health Officer's Health Orders to close non -essential businesses and prohibit gatherings has created economic hardship and dislocation for persons and businesses and will reduce tax revenues to the City necessary for providing essential City services. (k) On March 17, 2020, the City Manager of the City of Temecula issued a Declaration of Local Emergency related to the COVID-19 pandemic pursuant to Temecula Municipal Code Section 2.56.050. (1) On March 24, 2020, the City Council adopted Resolution No. 2020-17 entitled "A Resolution of the City Council of the City of Temecula Proclaiming the Existence of a Local Emergency Relating to the Covid-19 Virus Pandemic and Confirming the City Manager's Declaration of Local Emergency on March 17, 2020." On April 28, 2020, the City Council adopted Resolution No. 2020-20 entitled, "A Resolution of the City Council of the City of Temecula Reaffirming and Proclaiming the Existence of a Local Emergency Relating to the Covid-19 Virus Pandemic and Issuing Certain Orders for the Conduct of City Affairs During the Local Emergency." On June 9, 2020, the City Council adopted Resolution No. 2020-35 entitled, "A Resolution of the City Council of the City of Temecula Reaffirming and Proclaiming the Existence of a Local Emergency Relating to the Covid-19 Virus Pandemic and Issuing Certain Orders for the Conduct of City Affairs During the Local Emergency." (m) Due to the expanding list of countries with widespread transmission of COVID-19, increasing travel alerts and warnings for countries experiencing sustained or uncontrolled community transmission issued by the CDC, the escalation of United States domestic cases of and deaths from COVID-19, the identification of COVID-19 cases in California and Riverside County, COVID-19, and the severity and magnitude of the COVID-19 pandemic, has created conditions that are or likely to be beyond the control of local resources and require the combined forces of other political subdivisions to combat. (n) The mobilization of local resources, ability to coordinate interagency response, accelerate procurement of vital supplies, use mutual aid, and allow for future reimbursement by the state and federal governments will be critical to successfully responding to COVID-19. (o) The City Council finds that these conditions warrant and necessitate that the City reaffirm and proclaim the existence of a local emergency. Section 2. Proclamation of Local Emergency Based on the findings set forth above, the City Council of the City of Temecula hereby reaffirms the findings set forth in Resolution Nos. 2020-17, 2020-20, and 2020-35 and further proclaims that a local emergency now exists 2 throughout the City of Temecula. During the existence of said local emergency the following shall be in effect: (a) The local emergency powers, functions, and duties of the City Manager and the emergency organization of this City shall be those prescribed by state law, by ordinances, and resolutions of this City, and by the approved emergency plans of the City of Temecula. (b) The local emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council of the City of Temecula, State of California. (c) The City Council shall review this local emergency proclamation at least every sixty (60) days pursuant to Government Code Section 8630(c) and shall terminate the emergency proclamation at the earliest possible date the conditions warrant. (d) The City Manager is authorize to transfer funds from the Unreserved Fund Balance and transfers between departmental budget accounts when necessary under this declaration of an emergency. (e) Pursuant to the provisions of Temecula Municipal Code Section 2.56.050 the City Manager is authorized to enter into agreements on behalf of the City necessary under this declaration of an emergency. (f) The City Council determines that for the reasons described in this Resolution, compliance with the bidding requirements of Chapters 3.28 and 3.30 of Temecula Municipal Code is not in the best interest of the City and all such bidding requirements are hereby waived. (g) The City Manager may authorize expenditures of funds without regard to the amounts thereof, so long as there exists an unencumbered appropriation in the fund account against which the cost of the agreement is to be charged. (h) The City Manager is hereby authorized to enter into all agreements on behalf of the City, Temecula Community Services District, and the Successor Agency to the Temecula Redevelopment Agency without regard to the amounts thereof, so long as there exists an unencumbered appropriation in the fund account against which the cost of the agreement is to be charged, including without limitation, consultant agreements, agreements for the purchase of goods and services, real property leases and license agreements, public works construction and maintenance agreements, grant agreements, and amendments to real property purchase agreements and exclusive negotiating agreements. (i) The City Manager is hereby authorized to approve documents implementing the provisions of the California Environmental Quality Act (CEQA) other than Environmental Impact Reports. 0) The City Manager is hereby authorized to approve notices of completion, accept surety bonds, and release surety bonds, in connection with public works projects. 3 (k) The City Manager, in consultation with the City Attorney, is hereby authorized to settle personal injury and property damage lawsuits and enter into settlement agreements on behalf of the City, Temecula Community Services District, and the Successor Agency to the Temecula Redevelopment Agency without regard to the amounts thereof, so long as there exists an unencumbered appropriation in the fund account against which the cost of the agreement is to be charged. (1) The City Manager is authorized to negotiate and implement labor related policies and staffing changes deemed necessary in order to respond to the Local Emergency. (m) The City Manager is authorized to sign checks on behalf of the City, including without limitation, payroll hand checks, and may delegate this authority to the Director of Finance. (n) City Manager is authorized to modify on -street and off-street parking requirements for businesses, including without limitation modifications for food service or other businesses to accommodate pick-up or delivery services. Section 3. Ratification of City Manager's Actions. The City Council hereby ratifies the actions of the City Manager taken pursuant to Resolution Nos. 2020-17, 2020-20 and 2020-35. Section 4. Further Actions. The City Manager shall: (a) Forward a copy of this Resolution to the Director of California Governor's Office of Emergency Services; (b) Reaffirm the City's request the Governor of California, pursuant to the Emergency Services Act issue a proclamation declaring an emergency in Riverside County and waive regulations that may hinder response and recovery efforts; (c) Reaffirm the City's request that recovery assistance be made available under the California Disaster Assistance Act; and (d) Reaffirm the City's request that the State expedite access to State and Federal resources and any other appropriate federal disaster relief programs. The initiative is based broadly on the Race, Equity and Leadership (REAL) program offered through the National League of Cities. As a part of the workplan, the City Council conceptually approved items in three phases, related to ongoing education, communication, policy review, resolution adoption and the creation of a commission. The conceptual approval ensured that the important conversations and hard work around race, equity, diversity, and inclusion will continue well into the future in a sustainable and meaningful manner. This item is on the agenda tonight so that staff can provide the City Council and community with a status update on the workplan, have the City Council consider the adoption of a resolution, and receive general direction from the City Council on related matters. Sincerely, 2 Rick Reiss Paseo Del Sol Temecula, CA 92592 Dear Temecula City Council; I am requesting that the city’s forthcoming resolution as so described in Item #7 be re-considered for modification. The resolute statements themselves are quite laudable, but as is so frequently the case, the devil is in the details. I seriously question some of choices the city has chosen to highlight as justifications for this resolution. While the deaths of all the named individuals have a real sense of tragedy to them, a few of these cases were in fact attributable to the deceased young men’s own criminal actions. For example the Ferguson Police Officer who shot and killed Michael Brown was cleared by both the local authorities and by the Obama era US Department of Justice as a self-defense action taken by the officer. Brown brazenly attacked the officer attempting to take away his service firearm therefore refuting the political claim that the criminal attacker (Brown) was merely following the dubious “hands up, don’t shoot” narrative. The tragic death of Trayvon Martin in Florida did not even involve city authorities or law enforcement officers whatsoever as the young man lost his life in a violent struggle with a Hispanic man who was acting as part of a neighborhood watch program. The neighborhood watch man killed Martin after receiving a severe beating by his attacker in which he was fearful for his life. Subsequent investigations and trials ruled that the shooting death of Martin was justifiable self-defense. I will add that the named deaths in the Item #7 resolution are apparently all black men. But if this resolution were to truly represent diversity then shouldn’t other people with different backgrounds and races who also met with untimely deaths at the hands of police be mentioned too? One prime example is the murder of Justine Damond, an Australian woman with dual American citizenship, who was shot and killed by a Minneapolis Police Officer in 2017. She was not a criminal in any sense. She called 911 in an effort to report a possible crime in progress and she suffered grievously for it. The convicted former officer, himself a black Somali immigrant, is now serving a state prison term. Yet there is nobody protesting, rioting or looting under the banner of Australian Lives Matter, nor should there be ... any rioting or looting. There are of course many other cases like Justine Damond’s that I could easily cite for you and which do not meet the narrative of the highly publicized agit-prop pressure groups receiving all of the attention right now. This clearly illustrates the lack of diversity within the context of your proposed city resolution. I believe that your resolution wording should be expanded to include the concept of creed as well. For many millennia, people have been persecuted and discriminated against because of their religious beliefs. Yet there is nothing that really suggests an inclusiveness of religion in the proposed resolution unless perhaps the rather watered down term “cultural background” is supposed serve as lackadaisical catch all wording. I think the word religion should be added to Item #7 just as the word is also used in our 1st Amendment to the US Constitution. The other issue I would like to bring to your attention is the overall tone of the supporting points that are cited to justify the city’s resolution. This tone comes off as both defensive and appeasing as if the City of Temecula has something to be ashamed of. Yet Temecula was founded in 1989, some 25 years after the end of the Jim Crow Era that was practiced in the American South. Temecula has nothing to be shameful about. We are a vibrant, diverse, healthy and inclusive community and these supporting rationalizations 3 suggest that Temecula residents have something to be ashamed of. Nothing could be further from the truth. This does not mean that we are free of problems. Of course we too have our share; we all live in an imperfect world. Rude drivers, homelessness, petty crime, neighbors with barking dogs, pushy shoppers and other people acting like jerks is part of the normal daily routines in life on this world. Yet you would be hard pressed to find the source of such antagonisms here in Temecula to be rooted in hatred and bigotry. The iconic symbol of American justice is the blindfolded Lady Justice wielding a sword while holding balancing scales. This is the conceptual source of our equality and fairness. As human beings we are all to be treated equally and with fairness and impartiality before the bar of American justice, and so too in our interactions with civil and government institutions. The blindfolded Lady Justice does not mete out punishment, justice, services, contracts or other public order based on race, religion, ethnicity, sex, economic status, disability or any other benign human traits. She is immune to these immaterial mortal characteristics when objective truth is to be determined. Lastly, I add an honorable mention to the stellar law enforcement service that acts to protect and serve Temecula, i.e., the Riverside County Sheriff’s Office. We are also blessed to have the US Border Patrol actively engaged in our community acting as a "bonus" police agency that we all benefit from. Our highly professional local sheriff’s deputies and law enforcement are a reflection of our high caliber community as so many of these first responders choose to make Temecula their homes too. It should be of no surprise to anyone that the dysfunctions we currently see as Americans in law enforcement all seem to occur in those cities and areas that have been poorly governed by Democrat party machines for decade after decade after decade. Fortunately Temecula has no such endemic and highly politicized pathologies like these other troubled US cities. Yet we all must remain vigilant and I hope and pray that we can keep it this way. Please consider amending and changing the proposed resolution as I had mentioned before. Thank you for your time and consideration. I urge City Council members to act upon this resolution by implementing a robust plan for addressing systemic racism in our city. I look forward to hearing staff's update on the race and equity initiative, but based on the report considered at the July 14 City Council meeting, I worry that it will focus narrowly on individual-level solutions that are incapable of solving systemic problems. The proposed plan, which emphasizes educating city staff and organizing conversations with community members, does nothing to improve the health and safety of Black, Brown, and poor Temecula residents. The resolution City Council members will consider this evening also reflects ignorance of the difference between individual- level racism and systemic racism. While the resolution "denounces racism in all its forms, systemic or otherwise," it elaborates only on the negative impacts of "inherent biases and prejudice," meaning racism built into individual people's beliefs and actions. While interpersonal racism is indeed a serious problem, systemic racism is the reason why Black Americans are 2.7 times more likely to get Covid than white Americans and 3.57 times more likely to die from Covid than white Americans. Systemic racism, not individual-level racism, is the reason why white families have ten times as much wealth as Black families in the US. Systemic racism is the reason why Black men are 3.5 times more likely than whites to be killed by police. The most impactful system-wide change City Council members can take is to reduce Temecula's police budget. Temecula spent $38.5 million dollars contracting with the Riverside County Sheriff's Department this fiscal year. Research consistently shows that Black people are subject to over-policing, police harassment, and police violence. When 2 Temecula spends 44% of our budget on police, City Council members send a clear signal to Black Temecula residents that their health and safety is not a priority. The city of Temecula must reduce its policing budget and reallocate funds to services that would benefit Black Temecula residents, including mental health services, housing, and education. This moment calls for a radical rethinking of systems that disproportionately hurt Black people; as written, the proposed plan subverts this, and continues to prioritize white and business interests over the well-being of residents of color. As the very first action to be taken by the Council since its July 14 approval of a race and equity initiative, any implementing resolution which is adopted will necessarily be seen as a foundational resolution - and interpreted as such. With that in mind, it appears that the proposed resolution’s reference to (quote) “ the Temecula community, communities of color and those negatively impacted physically, emotionally, mentally, and/or economically by racism resulting from inherent biases and prejudice” (unquote) fails to make clear reference to other impacts 2 including, but not limited to, educational, medical and housing impacts. In the absence of such language, it is possible – even likely - that we will end up debating whether the terms “physically “ and “economically” include those kinds of things. Hopefully, that conflict can be avoided. It is respectfully requested that the Council modify the proposed resolution to specifically address these concerns. In connection with the suggested inclusion of a reference to educational impacts, it is recognized that the primary actor in the education arena is the TVUSD school board. And not all of the police conduct was wrongful. 2 Those two paragraphs appear to be pandering to the agenda of Black Lives Matter. I object – ALL LIVES MATTER including the unborn. There is no focus on the lives of any other races other than black. The third ‘Whereas’ paragraph seems to set forth that the rioting and burn of other cities is “. . . protest and related community dialogues . . .”. THAT IS NOT ACCURATE ! I fully support our First Amendment right to PEACEFULLY protest, but that is NOT what has been happening and I do NOT think that this Council should make a statement is not accurate. The fifth ‘Whereas’ paragraph implies that Temecula has had discriminatory practices that have been the cause of racism. While none of us is in anyway perfect and we should all try to improve our conduct, this does not accurately set forth the facts at issue. The Resolution seems designed to set the stage for a call to DEFUND the police. I am totally and completely opposed thereto. My name is Katherine Villagran, and I have been a resident of Temecula since 2003. I am submitting this comment regarding the City Council’s consideration of a resolution denouncing racism. I strongly support this declaration. More than this, I hope it is reflective of a deep commitment to reckon honestly with the many ways that racial discrimination is built into and upheld by our laws and our society at large, not solely in the minds and actions of any particular individual. We live in a country where the net worth of the average white family is almost 10 times greater than an average black family, where black men are handed down significantly longer sentences than white men when convicted of similar offences, where black mothers are 243% more likely to die from pregnancy- or childbirth-related causes than white mothers, and where black men are more likely to die at the hands of police than white men. These disparities cannot be accounted for by personal racial bias; they are the result of systemic racism. It is the responsibility of every individual and every community to name these inequalities as the intolerable evils that they are, and to take whatever steps are in their power toward the creation of a fairer and more just society. It is my sincere hope that the Temecula City Council will approve the formal denunciation of the evils of racism as a first small, but necessary step toward the fulfilment of this responsibility. Once 2 this declaration has been made, I look forward to learning more of how the members of the council plan to work toward redressing the harm that systemic racism continues to cause. Thank you. K.
