BACKGROUND SUMMARY
On July 1, 2020, Olivia K. Smith, on behalf of Epic Dog Academy, submitted Planning
Application PA20-0783 to allow for a dog kennel within an existing industrial building.
Staff has worked with the applicant to ensure that all concerns have been addressed, and the
applicant concurs with the recommended Conditions of Approval.
ANALYSIS
Planning Application No. PA20-0783 is a request for a Conditional Use Permit by Olivia Smith to
operate an indoor dog kennel and dog training facility at 42346 Rio Nedo. The indoor facility will
function within 5,887 square foot section of an existing 20,750 square foot multi-tenant industrial
building. Zoning for the existing building is Light Industrial. Temecula Development Code Section
17.08.030 permits kennels in the Light Industrial zone with a Conditional Use Permit.
The proposed Conditional Use Permit application does not propose any site changes nor to add
any additional square footage or make alterations to the exterior of the building.
The proposed Conditional Use Permit would permit the owner to operate seven (7) days a week
between 5:00 a.m. to 8:00 pm. The facility will staff 11 employees to manage the boarding facility
consisting of 28 dog kennel and training services.
The City of Temecula Development Code provides parking requirements in Table 17.24.040. Per
this Table, four (4) parking spaces are required for the office, and five (5) parking spaces are
required for storage and warehousing uses within the tenant space. There are
nine other suites within the building with uses consisting of storage, warehousing, and industrial
uses such as machine shops and upholstery. Including the proposed dog kennel facility with the
other existing uses, a total of 28 parking spaces would be required at the site. The proposed dog
kennel will not negatively impact parking since there are currently forty-five (45) parking spaces
on-site.
LEGAL NOTICING REQUIREMENTS
Notice of the public hearing was published in the SD Union Tribune on November 19, 2020 and
mailed to the property owners within the required 900-foot radius.
ENVIRONMENTAL DETERMINATION
In accordance with the California Environmental Quality Act, the proposed project has been
deemed to be categorically exempt from further environmental review.
The proposed use will be located within an existing industrial building and is permitted upon the
approval of a Conditional Use Permit. The structure can already accommodate the use. No
modifications to the site or structure are needed in order for the use to operate. Conditions of
Approval have been implemented to ensure the project does not cause adverse impacts to the
surrounding area.
FINDINGS
Conditional Use Permits (17.04.010.E)
The proposed conditional use is consistent with the General Plan and the Development Code.
The business will operate as dog kennel facility for dog training and boarding services. This
proposed conditional use is consistent with the City of Temecula General Plan and Development
Code, which label the project site as Industrial Park (IP) and Light Industrial (LI) respectively.
The General Plan and Development Code allow for the dog kennel at the project site upon the
approval of a Conditional Use Permit.
The proposed conditional use is compatible with the nature, condition and development of adjacent
uses, buildings and structures and the proposed conditional use will not adversely affect the
adjacent uses, buildings or structures.
The conditional use will be located within an existing structure within a Light Industrial (LI) zone.
As conditioned, the proposed conditional use is compatible with the nature, condition and
development of adjacent uses, buildings and structures and the proposed conditional use will not
adversely affect the adjacent uses, buildings or structures because the surrounding area includes
similar uses, intensities, and the building may accommodate for the use.
The site for a proposed conditional use is adequate in size and shape to accommodate the yards,
walls, fences, parking and loading facilities, buffer areas, landscaping, and other development
features prescribed in this development code and required by the planning commission or council
in order to integrate the use with other uses in the neighborhood.
The application will allow for dog training and boarding services within an existing industrial
building. No modifications to the structure or site are proposed. Since the site and proposed
conditional use are consistent with the General Plan and Development Code requirements, the
project site is adequate to accommodate the proposed use as required by the Director of
Community Development in order to integrate the use with other uses in the neighborhood.
The nature of the proposed conditional use is not detrimental to the health, safety and general
welfare of the community.
The use as conditioned meets all requirements of the Development, Fire, and Building Codes.
These codes contain provisions designed to ensure for the protection of the health, safety, and
general welfare of the community.
That the decision to approve, conditionally approve, or deny the application for a conditional use
permit be based on substantial evidence in view of the record as a whole before the Planning
Director, Planning Commission, or City Council on appeal.
The decision to conditionally approve the application for a Conditional Use Permit has been based
on substantial evidence in view of the record as a whole before the Director of Community
Development.

DEVELOPMENT OF THE CITY OF TEMECULA
APPROVING PLANNING APPLICATION NO. PA20-0783,
A CONDITIONAL USE PERMIT FOR EPIC DOG
ACADEMY TO PROVIDE DOG BOARDING, TRAINING
AND DAYCARE SERVICES WITHIN THE EXISTING
BUILDING LOCATED AT 42346 RIO NEDO ROAD SUITES
A, B, L, AND MAKING A FINDING OF EXEMPTION
UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT (CEQA) (APN 909-254-009).
Section 1. Procedural Findings. The Director of Community Development of the
City of Temecula does hereby find, determine and declare that:
A. On July 1, 2020, Olivia K. Smith, on behalf of Epic Dog Academy, filed Planning
Application No. PA20-0783, a Conditional Use Permit Application, in a manner in accord with
the City of Temecula General Plan and Development Code.
B. The Application was processed including, but not limited to a public notice, in the
time and manner prescribed by State and local law.
C. The Director of Community Development, at a regular meeting, considered the
Application and environmental review on December 3, 2020, at a duly noticed public hearing as
prescribed by law, at which time the City staff and interested persons had an opportunity to and
did testify either in support or in opposition to this matter.
D. At the conclusion of the earing and after due consideration of the
testimony, the Director of Community Development approved Planning Application No. PA20-
0783 subject to Conditions of Approval, after finding that the project proposed in Planning
Application No. PA20-0783 General Plan and
Development Code.
Section 2. Further Findings. The Director of Community Development, in
approving Planning Application No. PA20-0783, hereby makes the following findings as
required by Development Code Section 17.04.010 (Conditional Use Permits).
A. The proposed use is in conformance with the General Plan and the Development
Code.
The business will operate as dog kennel facility for dog training and boarding services.
This proposed conditional use is consistent with the City of Temecula General Plan and
Development Code, which label the project site as Industrial Park (IP) and Light
