AND MAINTAIN STATE ROUTE 79 UNDER THE
CITY'S JURISDICTION
BACKGROUND: Winchester Road (SR 79N) and State Route 79 South (SR 79S) are State
Highways and have been under the jurisdiction of Caltrans for decades. As a result, any
proposed improvements within the State Highway right-of-way must follow Caltrans procedures
and standards that results in lengthy review and approval processes. Such processes have
often delayed the City's efforts to process street widenings; aesthetically enhance the facilities
with landscaping, raised medians, and pedestrian improvements; install, repair and regulate the
timing of traffic signals; and review and approve development projects. It is very apparent that
the residents of Temecula and motorists would be better served if the State Highways that run
through the City limits functioned as local thoroughfares rather than State controlled highways.
In November 2002, the City Council determined that it would be beneficial to the City of
Temecula to control, operate and maintain those portions of SR 79N and SR 79S within the City
limits.
Senator Dennis Hollingsworth was asked to sponsor and carry the necessary state legislation
that allows Caltrans to relinquish these roadways from the State Highway system. The
legislation was approved in September 2003 by both the State Assembly and Senate, but
before SB 87 was introduced to the Governor for signature, Senator Hollingsworth withdrew the
bill due to concerns of property owners along SR 79S at Bedford Court.
The City and Caltrans clarified that the proposed legislation would have no affect regarding the
concerns of the property owners who wanted assurances that the Bedford Court traffic signal
would remain. The intersection of Bedford Court would stay under the jurisdiction of Caltrans,
with or without the legislation and relinquishment, due the intersection's close proximity to the I-
15 northbound freeway ramps.
In November and December 2003, Senator Hollingsworth, the City, Caltrans, and the property
owners met to resolve the matter. It was agreed that the City and Caltrans would review a traffic
study prepared by the property owners to determine whether and for how long it would be
feasible to maintain the signalized intersection at Bedford Court. It was also agreed by Senator
Hollingsworth that he vrould reintroduce SB 87 as an urgency bill. SB 87 should have been
approved by the end of January 2004, but recently the City was informed that Senator
Hollingsworth has submitted amendments to SB 87 including language that would require the
City to abide by a 1995 memorandum of understanding (MOU) that is obsolete and was not
properly studied or perfected with a formal agreement.
By adding Senator Hollingsworth's amendment, the City of Temecula's ability to properly
control, operate, and maintain the relinquished State highway will be severely impacted and it
could expose the City to litigation by third parties whenever there is disagreement with the City's
decisions regarding the highway.
The attached Resolution will formalize the City's position regarding the pending legislation and
our opposition to the amendment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMECULA SUPPORTING SENATE BILL 87

RELINQUISHMENT, AND OPPOSING ANY
AMENDMENTS THAT WILL PLACE LIMITS OR
IMPOSE RESTRICTIONS ON THE CITY OF TEMECULA
TO PROPERLY CONTROL, OPERATE, AND MAINTAIN
STATE ROUTE 79 UNDER THE CITY'S JURISDICTION
THE CITY COUNCIL OF THE CITY OF TEMECULA DOES RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
WHEREAS, Winchester Road (SR79N) and State Route 79 South (SR79S) are
currently under the jurisdiction of the State of California; and
WHEREAS, the City of Temecula is seeking through Senator Hollingsworth to
relinquish portions of Winchester Road (SR79N) and State Route 79 South (SR79S to the City
of Temecula; and
WHEREAS, SE:nate Bill 87 has been introduced to the Senate and Assembly for
approval; and
WHEREAS, Amendments to Senate Bill 87 are being proposed that will adversely
impact the City's ability to properly control, operate and maintain those portions of SR 79N and
SR 79S in the City of Temecula.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Temecula as follows:
Section 1. The City Council of the City of Temecula is in support of the original
legislation as previously approved by both the Senate and Assembly in September 2003.
Section 2. The City Council of the City of Temecula opposes any amendments to the
Bill related to a 1995 Memorandum of Understanding (MOU) between the City of Temecula and
Caltrans that will limit or impose restrictions on the City that would compromise the City's ability
to properly control, operate, and maintain SR 79N and SR 79S.
Section 3. The City Clerk shall forward a certified copy of this Resolution to our State
legislative representative for the purpose of ensuring that the pending Senate Bill 87 is not
amended to include the requirements the 1995 MOU.
PASSED, APPROVED, AND ADOPTED, by the City Council of the City of Temecula at
a regular meeting held on the 28th day of February 2004.
