MINUTES OF A REGULAR MEETING OF THE
CITY OF TEMECULA COMMUNITY SERVICES COMMISSION
APRIL 12, 2004
CALL TO ORDER
The City of Temecula Community Services Commission convened in a regular meeting at 6:00
p.m., on Monday, April 12, 2004, in the City Council Chambers of Temecula City Hall, 43200
Business Park Drive, Temecula, California.
ALLEGIANCE
Commissioner Edwards led the audience in the Flag salute.

PUBLIC COMMENTS
None.
DIVISION REPORTS
Development Services Administrator presented a brief report, notin9 the following:
. That on March 24, 2004 Pauba Ridge and Serena Hills Park were dedicated; and that
these are park numbers 28 and 29 for the City;
. That the poles for the sports field lighting were installed at Harveston Community Park;
. That the Children's Museum is taking shape; that special events will take place in May;
and that opening to the Children's Museum to the public will be in June.
Recreation Superintendent Pelletier presented a report noting the following:
. That the Annual City Egg Hunt was held at four (4) City Park sites; and that it was well
attended and enjoyed by all;
. That staff is preparing for the Annual 4th of July event; and that the event is scheduled to
be on a Sunday; that the festiyities will begin at 2:00 p.m. with a parade in Old Town
followed by events at the park beginning at 3:00 p.m. and the fireworks show at 9:00
p.m.;

That a new tiny tots sports program will be initiated called Tiny Tots Fundamentals; that
this program is geared for tots ages 4 to 6 and emphasis socialization and basic sports
skill; and that it is a not a competitive program;
That for the convenience and customer service purposes, staff is offering mail-in
registration to Temecula residents for the Summer Day Camp Program; and that this
program will be held at the Community Recreation Center (CRC) beginning mid-June
and will conclude late August;
That the annual Come Fly a Kite Day is scheduled for May 16.
For the Commission, Ms. Pelletier relayed the following:
. That the tiny tot program will be held at the field adjacent to the CRC; and that it will be a
four-week registration program on Tuesdays and Thursdays;
. That the Bunny attended the annual Egg Hunt and that staff is of the opinion that the
event went smoothly; and that there were about 3,000 residents who attended.
COMMISSION BUSINESS
1.
Master Plan - Veteran's War Memorial
RECOMMENDATION:
1.1
That the Community Services Commission approve the Conceptual Master Plan
for the Veteran's Memorial entitled "Letters Home" created by artist Chistopher
Pardell.
Director of Community Services Parker presented a staff report (see staff report), noting the
following:
That the site for the Veterans Memorial will be the North-East side of the Temecula Duck
Pond; that this site was chosen by the selection committee for its high visibility, central
location, and the popularity the park enjoys among the citizens of Temecula;
That the Veterans Memorial Project will be broken down into three phases:
0 Phase I - Finalization of Design;
0 Phase II - Hardscape and Casting Phase;
0 Phase 111- Landscape and Sculptural Installation.
At this time, Christopher Pardell presented a PowerPoint Presentation and answered the
following queries of the Commission.
That the site was chosen for several reasons, its central location, its lovely vistas, its
popularity with the local residents, and its high visibility from Ranch California Road;
That the materials used are designed for durability such as ceramic tiles, granite,
concrete and flagstone;

That there is no requirement for railings, that there will be landings versus a staircase;
and that the walkway will not exceed a 5% grade;
That the statue of the soldier will be a bronze finish;

That the tree being proposed is a deciduous Golden Raintree; that this tree was chosen
because it flowers yellow and its leaves turn yellow in the fall;
That the proposed project is not a war memorial but rather a service memorial;
That staff is in the process of choosing and researching the letters that will be part of the
proposed project;
That there will also be five bronze plaques that will represent the five branches of armed
service; that the plaques will be facing the soldier and that the soldier itself will not be
represent any particular branch of service.
At this time, the Public Hearing was opened.
Mr. Wayn Hall, Temecula resident relayed that the proposed project would be a place where he
would be able to visit and reflect; and that he is in support of this project.
Mr. David Michael, representing Veterans of Foreign War and the American Legion, relayed that
they are in support of the proposed project.
The Commission expressed excitement with the proposed project.
MOTION: Commissioner Edwards moved to approve the Conceptual Master Plan for the
Veteran Memorial. Commissioner Fox seconded the motion and voice vote reflected approval
with the exception of Commissioner Henz who was absent.
2.
Teen Concert Overview
RECOMMENDATION:
2.1
That the Community Services Commission receiye and file this report proYiding
an overview of the teen concert.
Recreation Superintendent Pelletier presented a staff report (as per agenda material), noting the
following:
That in January 2004, Council Member Comerchero and City staff met with
approximately 12 teens and young adults to discuss their desire for a teen concert to be
held in Temecula;
. That the youth expressed concern that there was not anything for them to do locally, and
their recreational opportunities were very limited;

That they would request that City staff host a concert locally and invite several bands to
perform;
. That staff worked with several young people and scheduled a concert to be held on
Friday, April 2, 2004, at the Community Recreation Center;
That five bands were invited to perform;
That the same young people handled the advertising and flyers, ticket sales at the event,
foot concessions, and announcements at the event; and that the cost was $5;
That approximately 230 young people attended the event and without incident;
That staff was present to ensure a safe event; and that in addition, members of the
Temecula Teen Council were present to assist with concessions and monitor the multi-
purpose room;
That the event was considered a success;
That staff is scheduled to meet with the teens for a follow-up evaluation of the event
within the nex1 week;
That a date in May will be considered for another event of this kind;
That the staff is of the opinion that the event was a success because the teens were
instrumental in planning and promoting the event;
That the teens were the promoters of the event;
That the bands are local garage type bands;
That the bands and teens came from various schools;
That bands came in at 30 minute increments.
This item number was received and filed by the Commission.
3.
Temecula Hiah School Gymnasium Join Use AQreement
RECOMMENDATION:
3.1 That the Community Services Commission approve in substantial from the Joint
Use Agreement between the City of Temecula and the Temecula Valley Unified School
District for a Gymnasium at Temecula Valley High School.
Deputy Director Ruse presented a staff report (as per agenda material), noting the following:
That the item is for a joint use agreement between the Temecula Valley School District
and the TCSD;

That the school district has an opportunity to construct a gymnasium at Temecula Valley
High School as part of a campus improvement plan that includes several other
amenities;
That the gym portion of the project qualifies for partial grant funding through the state
allocation board;
. That the gymnasium is proposed to be over 66,000 square feet and will include three full
size basketball courts, boys and girls locker rooms, wrestling room, restrooms, and
storage rooms;
That the estimated cost for the facility will be 9.3 million dollars of which the district is
eligible to obtain up to two-million dollars from the state allocations board;
That the gymnasium project is a portion of an oyerall 28 million dollar improvement
project planned for the Temecula Valley High School;
. That other amenities include lowering the hill on Pauba Road, construction of new
baseball fields in the area, a performing arts facility accommodating approximately 800
seats, a pool complex, and a new two-story permanent classroom building;
That the proposed Joint Use Agreement is for a five (5) year term with automatic five(5)
year renewals thereafter;
That the district will be solely responsible for all design and construction costs of the
facility as well as all operations and maintenance costs;
That the district will have first opportunity for use of the facility to meet student athletic,
recreational, and educational needs;
That once the districts needs have been met, the facility will be available for community
use and as a Joint Use partner, the TCSD will have first priority among community user
groups for use of the new gym;
That the Joint Use Agreement will proYide a mechanism for the district to secure the
funds that are needed for the facility to be able to offer school athletic and educational
programs and will also provide an additional gym for TCSDs own growing recreational
needs.
For Commissioner Edwards, Ms. Ruse relayed that at a future time, if the City were to use the
facilities, there would be a small rental fee required.
MOTION: Commissioner Edwards moved to approve staff's recommendation. Commissioner
Meyer seconded the motion and voice vote reflected approval with the exception of
Commissioner Henz who was absent.

COMMISSIONER'S REPORTS
Commissioner Edward noted that he was very impressed with the Veteran's Memorial and is
very proud to be a resident of the City of Temecula.
Commissioner Meyler and Commissioner Fox echoed Commissioner Edwards' comments.
Chairwoman Hogan relayed that it was a pleasure to be a part of the opening of the two new
parks.
The Commission thanked staff for a wonderful job.
Mr. Parker thanked his staff for all their hard work.

Art In Public Places Ordinance
RECOMMENDATION: That the Community Services Commission receive and file this report with
regards to the establishment of an Art In Public Places Ordinance.
BACKGROUND: In 1998 the City of Temecula developed a Cultural Arts Master Plan. The intent of
developing the Cultural Arts Master Plan was to develop a plan that identified key goals to enhance and
encourage the development of culture and arts in our community. Through a series of workshops,
interviews and focus groups, six (6) goals were identified and established by the community. One of
these goals was to enhance the community through arts in public places. This goal encouraged the
establishment of a public arts ordinance and fee. Over the years, the City has contributed to Art in Public
Places. These investments in Public Art are evidenced by the development of the Veteran's War
Memorial and installation of the sculpture "Singing In The Rain", currently installed at the Temecula Duck
Pond. In addition, three (3) specific plans, Roripaugh, Wolf Creek and Harveston, have all been
conditioned in the Development Agreement to provide a Public Art fee.
The proposed Art in Public Places Ordinance is designed to encourage new development to design,
develop and install artwork in public spaces for the community to enjoy. It requires new development to
install public art, or pay an in-lieu fee for public art if the installation of public art is not feasible. The
artwork or in-lieu fee should have a value equal to 10% of 1 % of the building value in excess of
$100,000. This would apply to residential development, multi-family development and commercial or
non-residential development. If artwork installed has a lesser value than the calculated in-lieu fee, the
remaining value would have to be paid by fees.

The ordinance establishes an Art In Public Places fund, and in-lieu fees would be deposited into this
fund. The funds could be used for the design, acquisition, installation, improvement, maintenance and
insurance of public artwork or displays on City property. It could also be used to offer performing arts
programs on City property for the community. In addition, the funds could be used for art education
programs on City property within the community.

With regards to the process, the developer would forward an application for donation of public artwork to
the City, or installation of artwork on private property, to the Community Services Department. The
application would include preliminary sketches, photographs, models and significant design features to
clarify and indicate the nature of the proposed artwork. Evidence of the value of the artwork must also
be submitted with the application along with a resume from the creator of the proposed artwork. The
application would be reviewed initially by the Community Services Department, which would make a
recommendation thereon. If the application is for donation, then the Community Services Commission
shall review the proposed artwork and act as an advisory body to the City Council who will make the final
decision for donation. If the application is for installation on private property, the Community Services
Commission shall review the application and be the final decision maker on the installation of the
artwork. Public artwork installed on private property shall be maintained by the property owner. The City
would be responsible for the maintenance and upkeep of artwork donated to the City and installed on
City property.
The intent of the public art ordinance and fee is to encourage development to provide public art in public
spaces that our community can enjoy. Through the Cultural Arts Master Plan deveiopment process it
was apparent that the community felt that public art enhances community aesthetics and cultivates a
sense of community pride.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TEMECULA ADDING CHAPTER 5.08 TO THE TEMECULA
MUNICIPAL CODE RELATING TO ART IN PUBLIC PLACES
THE CITY COUNCIL OF THE CITY OF TEMECULA DOES ORDAIN AS
FOLLOWS:
Section 1. Purpose and Findings. The City Council finds, determines
and declares that:
A. Public artwork enhances the quality of life for individuals
living in, working in and visiting Temecula.
B. As deyelopment and re-deyelopment of real property within
Temecula continues, urbanization of the community results and the opportunity
for creation of public artwork is diminished.
C. The California Supreme Court has ruled that municipalities
can require developers either to include public artwork in their development
projects or to pay an in lieu fee. Ehrlich v. City of Culver City, 12 Cal. 854 (1996).
D. Establishment of the Art in Public Places Program set forth
in this Ordinance will promote the general welfare by ensuring that public artwork
is generated in conjunction with private development projects that contribute to
urbanization of the community.
Section 2. Chapter 5.08, Art in Public Places, is hereby added to the
Temecula Municipal Code to read as follows:
"Chapter 5.08
ART IN PUBLIC PLACES
5.08.010
Purpose.
The purpose of this chapter is to enhance the quality of life for city
residents, workers and yisitors by providing for the acquisition and maintenance
of public artwork.
5.08.020
Implementation of chapter.
A. The procedures prescribed by this chapter for review and approyal
of public artwork shall be conducted concurrently with any applicable procedures

prescribed by Title 17 of this code for reyiew and approval of development
permits.
B. The community services department shall establish guidelines that
specify maintenance requirements for public artwork installed on private property
to satisfy the public artwork requirement.
5.08.030
Definitions.
For the purposes of this chapter, the following words and phrases shall
have the following meanings:
"Appropriately maintained" means maintained in conformance with the
city's public artwork guidelines.
"Artwork" means an original creation of physical art including without
limitation a fountain, mobile, mosaic, mural, painting, sculpture and tapestry. An
artwork may be realized through such mediums as bronze, ceramic tile, concrete
stained glass, steel or wood. An artwork may be an integral part of a building or
public space, whether attached to, interior of or ex1ernal to the building.
"Development project" means construction or modification of a building.
"In lieu art fee" means a fee in the amount of one-tenth of one percent of
the project cost in excess of one hundred thousand dollars.
"Project cost" means the total value of a development project, excluding
the land value, as indicated on the building permit issued by the city for the
project.
"Public artwork" means an artwork that is either (i) donated to the city for
installation on city property; or (ii) installed on private property in a publicly
accessible location.
"Public artwork requirement" means the requirement, imposed by this
chapter, of providing a public artwork or paying the in lieu art fee.
"Publicly accessible" means accessible to the public for viewing, in a direct
line of sight, for a minimum period of ten hours per day, seyen days per week.
"Value of a public artwork" means the cost of designing, acquiring,
constructing and installing an artwork, as applicable.
5.08.040
Art in Public Places Fund.

A. There is hereby established in the city a fund known as the "Art in
Public Places Fund," which shall be a depository for fees paid pursuant to this
chapter and for public art-related monetary donations to the city.
B. The Art in Public Places Fund shall be maintained by the finance
director and shall be utilized for the following purposes:
1.
Administration of this chapter.
2. Design, acquisition, installation, improvement, maintenance
and insurance of public artwork displayed on city property.
3.
Offering of performing arts programs on city property for the
community.
4. Art education programs on city property for the community;
provided, however, that not more than fiye percent of the fund's annual budget
shall be used for this purpose.
5.08.050
Applicability of public artwork requirement.
A. Except as provided in paragraph B below, the public artwork
requirement shall apply to the following development projects:
1. Single-family residential unit on a lot within an approved
subdivision and having a project cost in excess of one hundred thousand dollars
($100,000).
2. Multi-family residential units having a project cost in excess
of one hundred thousand dollars ($100,000) per unit.
3. Commercial, industrial, office and other non-residential units
in excess of one hundred thousand dollars ($100,000).
B. The following deyelopment projects shall be exempt from the public
artwork requirement:
1.
Government agency deyelopment projects.
2. Reconstruction of structures that have been damaged by
fire, flood, wind, earthquake or other calamity.
5.08.060
Satisfaction of public artwork requirement.
A. The public art requirement shall be satisfied by completing one of
the following actions in accordance with this chapter:

1.
Donating a public artwork to the city.
2.
Installing a public artwork on private property.
3.
Paying an in lieu art fee.
B. If the value of a public artwork used to satisfy the public artwork
requirement is less than the amount of the in lieu art fee that otherwise would be
applicable to the development project, then the difference shall be paid to the city
and deposited in the Art in Public Places Fund.
5.08.070
Procedure for donation or installation of public artwork.
A. An application for donation of a public artwork to the city, or for
installation of a public artwork on private property, shall be filed with the
community services department prior to the issuance of grading or building
permits for a development project. The application shall include:
1. Preliminary sketches, photographs, models or other
documentation of sufficient descriptiye clarity to indicate the nature of the
proposed artwork.
2.
An appraisal or other evidence of the value of the proposed
artwork.
3.
The resume of the creator of the proposed artwork.
4. If the application is for donation, then the application shall
also include the following:
a. A city attorney-approved written statement executed
by the artwork's creator waiving such person's rights under the Visual Artists
Rights Act of 1990 (17 U.S.C. 101 et seq.), California Ciyil Code Section 1542
and equivalent laws.
5. If the application is for installation, then the application shall
also include the following:
a. Preliminary plans of sufficient descriptiye clarity to
indicate the compatibility of the proposed public artwork with the development
project, adjacent parcels and the surrounding neighborhood.
b. A written statement explaining how the proposed
artwork will be publicly accessible.

6. Any other information requested by the community services
department to enable reasonable eyaluation of the application.
B. Each application shall be reviewed initially by the community
services department, which shall make a recommendation thereon. If the
application is for donation, then the community services commission shall be an
advisory body and the city council shall be the decisionmaker. The city council's
decision on an application for donation shall be final. If the application is for
installation, then the community services commission shall be the decisionmaker
and its decision shall be final unless appealed to the city council in accordance
with Chapter 2.36 of this code.
C. Prior to installing a public artwork on private property to satisfy the
public artwork requirement, the property owner shall execute and record with the
county recorder a city attorney-approved covenant. Such covenant shall require
the property owner and successors thereof to do the following:
1.
Maintain the public artwork in good condition.
2. Allow city representatives to enter upon the property upon
reasonable written notice to perform necessary repairs to the public artwork at
the property owner's expense when it is not maintained in good condition.
3. Indemnify, defend and hold harmless the city, its officers,
employees and agents from any claim, demand, damage, liability, loss, cost or
expense attributable to the public artwork.
5.08.080
Procedure for payment of in lieu art fee.
Payment of the in lieu art fee shall be made prior to the issuance of
grading or building permits unless an alternative deadline is approved by the city
council.
Maintenance of public artwork on private property.
Public artwork installed on private property to satisfy the public artwork
requirement shall be appropriately maintained and insured by the property
owner. The insurance shall be in an amount determined by the city manager and
shall provide coverage in the event of fire damage to or vandalism of the public
work.
5.08.090
5.08.100
Removal or alteration of public artwork on private property.
Artwork installed on private property to satisfy the public artwork
requirement shall not be removed or altered without the prior approval of the city
council. In addition to any other applicable penalty, violation of this section may

render the property owner liable for payment of the in lieu art fee that would haye
been applicable to the development project, and may result in revocation of the
occupancy permit issued for the development project. Prior to any imposition of
in lieu art fee liability or occupancy permit revocation pursuant to this section, the
city shall afford the property owner notice and an opportunity for a hearing."
Section 2. If any sentence, clause or phrase of this Ordinance is for any
reason held to be unconstitutional or otherwise inyalid, such decision shall not
affect the validity of the remaining provisions of this Ordinance. The City Council
hereby declares that it would have passed this Ordinance and each sentence,
clause or phrase thereof irrespectiye of the fact that anyone or more sentences,
clauses or phrases be declared unconstitutional or otherwise invalid.
Section 3. The City Clerk of the City of Temecula shall certify to the
passage and adoption of this Ordinance and shall cause the same or a summary
thereof to be published and posted in the manner required by law.

RECOMMENDATION:
That the Community Services Commission:
Approve the summer 2004 aquatics program offered to the citizen's of Temecula at the
Community Recreation Center Pool, the Chaparral High School Pool and the Temecula
Elementary School Pool.
DISCUSSION: The aquatics program offered by the City of Temecula is currently a
modified year round program designed to meet the recreational needs for those who enjoy
aquatic activities. Staff members within the aquatics section of the Recreation Division are
currently preparing for the summer aquatics program, which is scheduled to officially begin on
Monday, June 21, 2004. This extremely popular program provides a variety of opportunities
for participants of all ages. To date, there are three (3) pools operated by the City. The three
(3) pool locations are Temecula Elementary School Pool, Chaparral High School Pool and the
Community Recreation Center Pool.
The aquatics programs includes, but is not limited to youth and adult swim lessons, public
swim, adult lap swim, family swim nights, water aerobics, private swim lessons, jr. lifeguard
training program, scuba diving classes, lifeguard training courses, as well as scheduling pool
use and lifeguard services to both local non-profit swim teams and the Temecula Unified
School District.
Aquatics Supervisor Gwen Thurston will provide a detailed report regarding the scheduled use
of the pools operated by the City of Temecula throughout the summer months.

RECOMMENDATION: That the Community Services Commission receive and file this report with
regards to the 2004 Summer Sunsets Film and Concert Series.
BACKGROUND: On July 1,2004 the City ofTemecula Community Services Department will kick-off
the Annual Summer Sunsets Film and Concert Series. This year's event encompasses eight (8) weeks
of free concerts held Thursday evenings and movies in the parks held Friday evenings.
All concerts are held at the Thomas H. Langley Amphitheater located at the Community Recreation
Center. The concert line-up includes both past crowd favorites as well as new performers. Free face
painting and balloon art is available to the youth. The Temecula Teen Council will offer refreshments for
sale. New this year, our last concert event will be a "Karaoke Night". Families will be encouraged to
sign-up in advance for an opportunity to show their singing talents and just have a good time. The
concert series has grown in attendance each year and has become a popular family event.
All movies are held on Friday evenings at various park sites throughout the City. Festivities begin at 6:30
pm with S.MAR.T. staff on hand to do arts and crafts with the kids followed by group activities like
scavenger hunts, etc. All movies are rated G. Prior to the start of each movie, we will run Laurel and
Hardy, and The Three Stooges movie shorts. Barbie's Dogs will be on hand with refreshments available
for purchase. Last year was the first year for the Movies in the Park series and the event was well
received by the community averaging 500 in attendance at each movie event. Staff is looking forward to
this year's Summer Sunsets Film and Concert Series being another overwhelming success.

MOONLIGHT MOVIES
IN THE PARK
The City of Temecula Community Services Department presents the "Moonlight Movies
in the Park" Series, Friday evenings during the months of July and August. The movie
series will be featured at various park sites located within the City. Festivities begin at
6:30PM with kids crafts and games. Movies begin at dusk. Bring a blanket, lawn chairs
and a picnic dinner, and come on down to the park for a family movie under the stars.
Refreshments will be available for purchase.
