HomeMy WebLinkAbout080504 DH Minutes MINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA DIRECTOR OF PLANNING AUGUST 5, 2004 A regular meeting of the City of Temecula Director's Hearing was called to order on Thursday, July 29, 2004, at 1 :30 PM, in the Community Development Conference Room, located at 43200 Business Park Drive, Temecula, California. Principal Planner, Donald Hazen, presiding. Also present were Associate Planner Stuart Fisk and Minute Clerk Adria McClanahan. Item No.1: Planninq Application No. PA03-0639 A Minor Conditional Use Permit to establish a vehicle impound facilitv for UP to 42 vehicles at anv one time at an existinq buildinq located at 27495 Diaz Road. Principal Planner Don Hazen called the meeting to order at 1 :34 PM. Associate Planner Stuart Fisk presented an overview and staff recommendations of this project. Highlighting the proposed facility is currently operating under a Temporary Use Permit. The vehicle impound area is located within a fenced industrial yard that provides for adequate screening of the impound area from public view. Pursuant to Section 17.08 of the Development Code a Conditional Use Permit must be obtained for impound yards located within the Light Industrial zone. Proposed project is consistent with the Development Code in that the vehicle impound area is confined to the rear of the principal structure within the rear two-thirds of the lot. The vehicle impound area is located on appropriate paving and is screened from public view and from adjoining properties by appropriately designed walls and fencing. Staff supports findings for a Minor Conditional Use Permit can be made. In accordance with CEQA the proposed project has been deemed categorically exempt from further review. This exemption is Class 1 for existing facilities with negligible expansion of use. Staff recommends the Planning Director make the findings for a Minor Conditional Use Permit. Staff also recommends the Planning Director determine the project is exempt from CEQA guidelines, pursuant to Section 15301, Existing Facilities. Principal Planner requests clarification of the parking structure layout verifying the vehicles would have adequate access into the impound yard. Principal Planner also questioned Condition # 10 which states "to further screen the impound yard slats to match the south facing fence shall be added to the chain link fence that separates the industrial yard from the manufacturing yard". Principal Planner verified the benefit of the extra slatting in terms of public visibility from Sarah Way. Associate Planner stated when the gate is opened to the industrial area there is adequate visibility. Principal Planner opened Public Hearing at 1 :41 PM. Frank Bulleit, 2095 Calle Diablo, Hemet California, 92545, Manager of Gosch Towing & Recovery. Gosch Towing obtained a lease with Liberty Towing on Jefferson Avenue in Temecula. The owner of Liberty Towing sold the business and ended their lease thereby making it necessary to apply for the Minor Conditional Use Permit. The owner of the current facility, Randy Fitzpatrick, is subleasing the warehouse facility. Only 30 vehicles will be stored at any given time. Currently there are 19 vehicles. Per Applicant, members of the Public come to the office and are only allowed to enter the impound yard accompanied by a Gosch Towing employee to obtain property from the vehicle. Principal Planner requested a description of the fenced in yard; specifically the barbed wire fencing. Mr. Bulleit stated a portion of the barbed wire fencing was pre-existing. Principal Planner questioned whether or not the Development Code allowed barbed wire fencing. Associate Planner stated the barbed wire was previously conditioned therefore additional approval for the fencing was not necessary. Viola Henzelmann, 42568 Jalene Court, Temecula, Ca 92595. Her parents, Mr. & Mrs Alfred Hanzelamnn are the property owners for 43020, 43064, 43114, 43162, 43095 and 43135 Blackdeer Loop. These are the buildings located behind the proposed impound yard facility. Ms. Henzelmann primary concern and objection to the proposed facility was the propensity for vandalism. The applicant assured Ms. Henzelmann all necessary precautions will be taken to prevent vandalism. Principal Planner stated the Police Depart is requesting that lighting be strategically placed throughout the parking lot so as to proved adequate lighting. Per Applicant flood lights are currently installed. Per Principal Planner adequate lighting must be installed throughout the facility. No further requests to speak were presented. Principal Planner closed the Public Hearing portion on this item. Principal Planner Donald Hazen responded to the vandalism issue. The Police Department has reviewed the proposed project. The City of Temecula Police Department has the responsibility to patrol and protect the community. The Condition will be added for applicant to show slatting on the north facing, in response to the adjacent property owner's request. If the barbed wire is allowed per the Development Code the condition will be added, stating, "barbed wire will be added to all sides of the fence."
