PA04-0508, A MINOR CONDITIONAL USE PERMIT FOR THE SALE OF USED AUTOMOBILES FROM A 1,375 SQUARE FOOT SHOWROOM SITUATED WITHIN AN EXISTING MUL TI- TENANT COMMERCIAL BUILDING, LOCATED AT 28860 OLD TOWN FRONT STREET, SUITE B1, GENERALLY LOCATED ON THE EAST SIDE OF OLD TOWN FRONT STREET, APPROXIMATELY 1,500 FEET SOUTH OF SANTIAGO ROAD, KNOWN AS ASSESSOR PARCEL NO. 922-094-002 WHEREAS, Russell Rumansoff, representing Herron + Rumansoff Architects, Inc., filed Planning Application No. PA04-050B, in a manner in accord with the City of Temecula General Plan and Development Code; WHEREAS, Planning Application No. PA04-050B was processed including, but not limited to a public notice, in the time and manner prescribed by State and local law; WHEREAS, the Planning Director, at a regular meeting, considered Planning Application No. PA04-050B on October 21, 2004, at a duly noticed public hearing as prescribed by law, at which time the City staff and interested persons had an opportunity to and did testify either in support or in opposition to this matter; WHEREAS, at the conclusion of the Planning Director's Hearing and after due consideration of the testimony, the Planning Director approved Planning Application No. PA04- 0508 subject to the conditions of approval after finding that the project proposed in Planning Application No. PA04-050B conformed to the City of Temecula General Plan and Development Code; NOW, THEREFORE, THE DIRECTOR OF PLANNING OF THE CITY OF TEMECULA DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct and are hereby incorporated by reference. Section 2. Findinas. The Planning Director, in approving Planning Application No. PA04-050B (Minor Conditional Use Permit) hereby makes the following findings as required by Section 17.04.010.E of the Temecula Municipal Code: A. The proposed conditional use is consistent with the general plan and the development code. The proposed conditional use is consistent with the General Plan and the Development Code. The project site is zoned Service Commercial and the General Plan designation for the site is Service Commercial, which allows for used automobile dealers with no outdoor display provided a conditional use permit is issued. The number of parking spaces existing on the site meets the parking required for the existing and proposed tenants. The proposed conditional use is compatible with the nature, condition and development of adjacent uses, buildings and structures and the proposed conditional use will not adversely affect the adjacent uses, buildings or structures. The proposed conditional use is compatible with this location because the proposed use is conditionally permitted in the Service Commercial zone and the project site is currently developed with all improvements in place, including parking. Furthermore, vehicular related uses exist in the vicinity of the site, which make the proposed use compatible with and complimentary to several of the existing uses surrounding the site. C. The site for a proposed conditional use is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, buffer areas, landscaping, and other development features prescribed in this development code and required by the Planning Commission or Council in order to integrate the use with other uses in the neighborhood. The site for the proposed conditional use is adequate in size and shape to accommodate this use because the project site is currently developed and the proposed use does not propose any additions or exterior alterations to the existing building or site. The proposed parking demand does not exceed the existing parking spaces. Therefore, the site is adequate for the proposed use. D. The nature of the proposed conditional use is not detrimental to the health, safety, and general welfare of the community. The project site is adequate for the size and scope of the project and the showroom wíll provide additional opportunities and services to the community to purchase used cars within the community. Section 3. Environmental Compliance. The project is categorically exempt from environmental review (Class 1 - Existing Facilities) pursuant to section 15301 of the California Environmental Quality Act. Class 1 applies to minor alteration of existing structures that involve negligible or no expansion of use. Section 4. Conditions. That the City of Temecula Director of Planning hereby conditionally approves Planning Application No. PA04-050B (Minor Conditional Use Permit) for the sale of used automobiles from a 1,375 square foot showroom situated within an existing commercial building, located at 2BB60 Old Town Front Street, Suite B1, known as Assessor Parcel No. 922-094-002, subject to the conditions of approval set forth on Exhibit A, attached hereto, and incorporated herein by this reference.
