A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMECULA SETTING A TIME AND PLACE FOR A
PUBLIC HEARING IN CONNECTION WITH THE SOLID
WASTE AND RECYCLING AND SB1383 COMPLIANCE
FEE ON COMMERCIAL COLLECTION RATES FOR
COMMERCIAL CUSTOMERS FOR FISCAL YEAR 2022-23
THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY RESOLVE AS
FOLLOWS:
Section 1. The City Council of the City of Temecula does hereby find determine and
declare that:
(a) The City of Temecula and CR & R Incorporated entered into an exclusive
solid waste Franchise Agreement on May 28, 1991, as amended on August 27, 1996, June 24,
1997, July 25, 2000, June 13, 2006, October 27, 2015, and November 28, 2017 ("Franchise
Agreement"), for the collection, transportation,recycling, composting and disposal of solid waste
and construction debris, and for providing temporary bin/roll off services in the City.
(b) The Franchise Agreement specifically that the rates for services shall be
adjusted each July ls`, based on certain criteria, and subject to the data from the Bureau of Labor
Statistics designated change in the Consumer Price Index (CPI), from the previous calendar year,
and changes to the Riverside County Department of Waste Resources landfill disposal fees, and
any extraordinary costs which may be as a result of State mandated programs.
(c) According to the Bureau of Labor Statistics for January 2021 through
December 2021,the designated CPI has increased by 5.37%.
(d) The County of Riverside's Waste Management Department will adjust their
landfill disposal rate by 8.6%, from$32.71 per ton to $35.52 per ton.
(e) The Extraordinary Cost increase is to include a rate increase of 3.4% for
commercial customers. Commercial rates vary based on the bin size and frequency of collection.
Section 2. The City Council of the City of Temecula hereby acknowledges and
appoints the 12th day of July 2022,at the hour of 6:00 p.m.,or as soon thereafter as feasible, in the
City Council Changers at City Hall, located at 41000 Main Street, Temecula, CA 92590, as the
time and place for the public hearing on the proposed solid waste and recycling and SB1383
compliance fee on commercial collection rates for commercial customers for fiscal year 2022-23.
At the public hearing, the City Council will hear and consider all objections or protests, if any, to
the proposed rates. The City Council may continue the hearing from time to time.
Section 3. The City Clerk is hereby directed to publish notice of the time and place of
the hearing pursuant to Government Code Section 6066 in the manner required by law.
Section 4. Each affected commercial customer and commercial property owner in the
City of Temecula shall be mailed notice of the proposed rate increase in the manner provided by
law at least forty-five (45)days prior to the public hearing on July 12, 2022.
Section 5. The City Clerk shall certify to the passage and adoption of the resolution.
