CSD 05-10 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE TEMECULA COMMUNITY SERVICES DISTRICT, RECITING THE FACT OF THE SPECIAL TEMECULA COMMUNITY SERVICES DISTRICT MAIL-IN BALLOT ELECTION HELD ON MARCH 14, 2005 DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a Special Mail-in Ballot Election was held and conducted in the City of Temecula, California, on March 14, 2005, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that the special election was for the purpose of obtaining approval by property owners within the Wolf Creek Specific Plan No. 12, for establishment of the annual levy of TCSD Rates and Charges for each affected parcel as follows: Service Level B $25.68 for Residential Street Lighting, Service Level C $129.00 Rates and Charges for Perimeter Landscaping and Slope Maintenance, and Service Level D $179.86 for Refuse and Recycling Collection Services per residential parcel beginning FY 2005-06 was properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California; and WHEREAS, pursuant to Resolution No. CSD 05-04, adopted January 25, 2005, the ballots were returned to the office of the City Clerk/Secretary of the Temecula Community Services District; . the results were received, canvassed in public and are herein set forlh in Section 2. NOW THEREFORE, THE TEMECULA COMMUNITY SERVICES DISTRICT OF THE CITY OF TEMECULA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the whole number of ballots cast in the homeowners election was four (4) and the whole number of provisional ballots cast in the election was none (0). Section 2. That the whole number of ballots cast for establishment of the annual levy for Service Level B rates and charges for Residential Street Lighting per residential parcel beginning FY 2005-06, Service Level C for Perimeter and Slope Landscape Maintenance per residential parcel beginning FY 2005-06, and Service Level D for Refuse/Cycling Collection Services per occupied parcel beginning FY 2005-06 on the ballot were as follows: I:" I ~o I ~ncomPlete Section 3. The Board of Directors of the Temecula Community Services District does declare and determine that as a result of the election, a majority of the voters voting on the measure relating to the establishment of Service Level B, Service Level C, and Service Level D Rates and Charges beginning Fiscal Year 2005-06 pursuant to Article XIIID, Section 6 of the California Constitution, did vote in favor of the measure and that the measure was carried, and shall be deemed adopted and ratified. The City Clerk/Secretary of the Temecula Community Services District (TCSD) shall enter in the minutes of the TCSD Board of Directors, a statement of the result of the election, showing: (1) The whole number of ballots cast in the City; (2) The votes in favor, (3) The votes in opposition and (4) Those received incomplete. Section 5. The City Clerk shall cerlify the adoption of this resolution.
