HomeMy WebLinkAbout2023-88 CC Resolution RESOLUTION NO. 2023-88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA TO APPROVE THE GRANT AGREEMENT WITH THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) FOR COMMUNITY PROJECT FUNDING (CPF) AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE GRANT AGREEMENT AND ALL PERTINENT SUPPLEMENTAL DOCUMENTS THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Consolidated Appropriations Act, 2023 (the FY 2023 Act), (Public Law 117-328), Congress made funding available of $2,982,285,641 for grants for the Economic Development Initiative (EDI) for the purposes, and in amounts, specified for Community Project Funding/Congressionally Directed Spending,and these Community Project Funding(CPF)awards are administered by the Department of Housing and Urban Development(HUD); and WHEREAS, this grant agreement between the Department of Housing and Urban Development(HUD) and City of Temecula(the Grantee) is made pursuant to the authority of the Consolidated Appropriations Act 2032 (Public Law 117-328) and the Explanatory Statement for Division L of that Act, which was printed in the Senate section of the Congressional Record on December 20, 2022 (Explanatory Statement); and WHEREAS,that the definitions at 2 CFR 200.1 apply to this Grant Agreement,the Budget Period, and Period of Performance, and begins and ends on the dates specified, except where this Grant Agreement specifically states otherwise; and WHEREAS, the Grantee must use the Grant Funds as provided by the Approved Budget, and the Grantee is the Responsibility Entity and agrees to assume all the responsibilities and is subject to all applicable Code of Federal Regulations (CFR's) and requirements, including Uniform Administrative Requirements, Cost Principles, and Audit Requirements, the Period of Performance, and Environmental Review as it pertains to the National Environmental Policy Act (NEPA) compliance. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Temecula approve the Grant Agreement between the Department of Housing and Urban Development (HUD) and City of Temecula(the Grantee),in the amount of$800,000 for the DePortola Road/Jedediah Smith Road Roundabout Project; and BE IT FURTHER RESOLVED that the City Manager, is hereby authorized and empowered to execute in the name of the City of Temecula the Grant Agreement,including but not limited to,all supplemental documents such as applications,agreements,amendments,and requests for payment, necessary to secure grant funds and implement the approved grant program or project; and BE IT FURTHER RESOLVED that these authorizations are in effect from the Date of Grant Obligation of December 20, 2022, and by the adoption of this resolution, up to and including the Period of Performance/Budget Period End Date of August 31, 2031, as necessary for the completion of the aforementioned project.
