RECOMMENDATION: That the Traffic Safety Commission receive and file the report.
BACKGROUND: The City's Quality of Life Master Plan (QLMP) 2040 is a visionary and
living document created to express the aspirations, ideals and strategic priorities of the City and
community. In the past ten years, the QLMP has been a very successful tool for City goal setting
and project implementation. The initial version of the plan, referred to as QLMP 2030, reflected a
20-year planning period from 2010-2030. That document included specific goals; key
accomplishments; key findings; metrics of progress; and strategic priorities. Given the substantial
progress made on the QLMP 2030, it was determined an update to the QLMP was needed to set
direction for the City over the next twenty years.
The QLMP 2040 was adopted in November of 2022 and identified seven Core Values including:
1. A Safe and Prepared Community;
2. Transportation Mobility and Connectivity;
3. Healthy and Livable City;
4. Economic Prosperity
5. A Sustainable and Resilient City
6. Accountable and Responsive City Government; and
7. Equity
Each Core Value contributes to our overall quality of life and they guide the measurement of
strength of our goals as we implement the Citizen's 20-year priorities. All City Departments
maintain performance indicators based on the QLMP Core Values and all Capital Improvement
Projects are evaluated in terms of their adherence to the QLMP values. In addition, the Core Values
will serve as the organizing principles and a foundation for a comprehensive update to the City's
General Plan.
Part of the QLMP update process included creating a digital and interactive version of the
document that would be easily accessible for all users. The website includes a dashboard that
displays the indicators used to measure the City's progress in reaching the goals and aspirations
outlined in the document. There is a designated page for each Core Value containing the
community survey results, the accomplishments, objectives, and goals of that specific Core Value
as well as displaying current City data.
In addition, you will find a designated webpage for the Citizen's 20-year Priority Timeline that is
broken up in 5 — 10-year periods. The timeline includes city development, private development
and public -private development or multi -public agency development. This allows the community
to see what we have done, what we are doing, and where we are going.

RECOMMENDATION: That the Traffic Safety Commission:
1. Recommend that the City Council approve the proposed revisions to Chapter 10.24.040
of the Municipal Code to define and clarify bicycle usage on City sidewalks.
2. Recommend that the City Council approve the proposed revisions to Chapter 12.04.050
of the Municipal Code to clarify bicycle usage in City parks.
BACKGROUND: Electric bicycles, more commonly referred to as E-bikes, are increasingly
becoming a more popular mode of transportation as an E-bike boosts a cyclist's ability with the
help of an electric motor. There are many different shapes, sizes and types with speeds ranging
from 20 to 28 miles per hour (MPH).
At the October 26, 2023, Traffic Safety Commission meeting, staff presented on electric bicycles
(E-bikes) safety to garner feedback from the Commission since local jurisdictions will be
responsible for implementing and enforcing policies. The Commission directed staff to research
ideas centered around E-Bike education and enforcement in addition to reviewing and revising
City ordinances to address E-Bikes.
The City of Temecula, along with the Temecula Valley Unified School District and City Sheriff
Department, has already begun to take steps to address the E-bike safety concerns. Below is a list
of education and enforcement measures the City and its' partners have already implemented
regarding E-bikes:
• TVUSD informational letter to parents regarding E-Bike safety and regulations.
• "Caught with your Helmet On" bicycle helmet safety program which provides positive
reinforcement to students wearing helmets.
• School assemblies from Sheriff and Bike Temecula Valley to promote Rules of the Road
bicycle safety strategies.
• Sheriff and TVUSD implementing a plan that requires school students attend free
instructional classes given by the Sheriff's Department. This program educates students
about the rules of the road, E-bike laws, helmet safety, interaction with vehicles and
pedestrians, and more.
• Future social media outreach on City social media platforms educating citizens on E-bikes.
• Examining and recommending ordinance changes to address E-bikes on City sidewalks
and parks.
Staff have also initiated and coordinated meetings with the City of Carlsbad and City of Encinitas
to learn more about their approaches to E-bike safety since they have been at the forefront of
addressing E-bike issues. Staff have learned a great deal on strategies regarding the education,
enforcement, and regulation of E-bikes. Below are some ideas for Temecula to consider as it
navigates its way through the E-bike safety program implementation:
• Provide E-bike informational section on City website.
• Print and provide local signs reminding the public of E-bike safety for installation on
residence front lawns.
• Installation of portable changeable message signs throughout the City at strategic locations
for extended periods of time.
• Provide E-bike safety videos.
• Provide one -page E-bike information overview literature.
As mentioned above, the Commission requested staff to review City ordinances regarding regular
bicycles and electric bicycles on sidewalks and within City parks. Based on this direction, staff
reviewed the subject ordinances, and have provided recommendations for ordinance revisions to
address E-bike concerns.
The current 10.24.040 ordinance reads as follows:
10.24.040. Bicycles on sidewalks- When allowed.
A. Notwithstanding the provisions of Section 10.24.030, bicycles may be ridden on sidewalks
except as follows:
1. No person shall ride a bicycle upon a sidewalk within any business district; upon
the sidewalks of bridges; in pedestrian underpasses; on pedestrian overpasses; or
upon sidewalks adjacent to any school building.
2. No person shall ride a bicycle upon a sidewalk in an area where riding a bicycle
or unicycle is prohibited by ordinance of the city council and appropriate signage
is posted advising of the prohibition.
B. Any person riding a bicycle upon a sidewalk shall ride in the direction of travel in a safe
manner with due care and caution, yield the right-of-way to any pedestrian, and when
overtaking and passing a pedestrian, shall give an audible signal and shall pass to the left
of the pedestrian only under conditions permitting such movement in safety. Any person
riding a bicycle, upon entering a roadway or driveway from a sidewalk, shall yield to all
traffic.
C. As used in this section the following words are defined as follows:
1. Bicycle means a device upon which any person may ride, propelled exclusively by
human power through a belt, chain, or gears, and having one or more wheels,
including, but not limited to, a bicycle, electric bicycle, unicycle, skateboard, roller
skates, or other wheeled toys.
2. "Sidewalk" means that portion of city right-of-way designated or used for
pedestrian travel, including, but not limited to, sidewalks and portions of sidewalks.

The ordinance is proposed to be revised as noted in Exhibit A. Note that this revised ordinance is
a draft that is subject to change at City Attorney's discretion prior to being adopted.
The current 12.04.050 ordinance reads as follows:
12.04.050. Operation of Vehicles
A. Roads for Public Use. The provisions of the California Vehicle Code are applicable in the
city parks upon any way or place of whatever nature which is publicly maintained and
open to the use of the public for purposes of vehicular travel. All violations of the Vehicle
Code shall be enforced and prosecuted in accordance with the provisions thereof.
B. Surfaces Other than Roads for Public Use- Sidewalks. No person shall drive or otherwise
operate a vehicle in a park upon surfaces other than those maintained and open to the
public for purposes of vehicular travel, except upon temporary parking areas as may be
designated from time to time by the commission, and further excepting vehicles in the
service of the city, animal control vehicles, law enforcement vehicles and motorized
wheelchairs. No person shall ride or operate a skateboard in any designated city park
unless that person is wearing a helmet, elbow pads and knee pads. Any person failing to
do so will be subject to citation under this chapter.

A. Notwithstanding the provisions of Section 10.24.030, bicycles, Class 1 E-bikes, and Class

1. No person shall ride a bicycle, Class 1 E-bike, or Class 2 E-bike upon a sidewalk

may be allowed to be ridden within City parks.
F. As used in this section the following words are defined as follows:
1. Bicycle means a device upon which any person may ride, propelled exclusively by
human power through a belt, chain, or gears, and having one or more wheels,
including, but not limited to, a bicycle, electric bicycle, unicycle, skateboard, roller
skates, or other wheeled toys.
2. An electric bicycle (E-bike) is a bicycle equipped with an electric motor of less than
750 watts. There are three classes of E-bikes:
i. Class 1: A bicycle equipped with a motor that provides assistance only when
the rider is pedaling, and that ceases to provide assistance when the bicycle
reaches the speed of 20 miles per hour.
ii. Class 2: A bicycle equipped with a motor that provides assistance via
throttle, and that is not capable of providing assistance when the bicycle
reaches the speed of 20 miles per hour.
iii. Class 3: A bicycle equipped with a motor that provides assistance only when
the rider is pedaling, and that ceases to provide assistance when the bicycle
reaches the speed of 28 miles per hour, and equipped with a speedometer.
Any E-bike with a motor rated higher than 750 watts is considered a motor vehicle
and subject to California Vehicle Code rules and regulations and should only be
ridden where cars and other motor vehicles are permitted.
"Sidewalk" means that portion of city right-of-way designated or used for
pedestrian travel, including, but not limited to, sidewalks and portions of sidewalks.

I am writing to you as the President of the Redhawk Community Association, representing 3256
homes within the City of Temecula. After carefully reviewing the enclosed letter from the Morgan
Hill HOA regarding e-bike and electric scooter safety, our Redhawk Board of Directors has
expressed support for Morgan Hills' requests. We have observed similar issues within our
community and believe that the development of education, legislation, and enforcement procedures
will significantly contribute to enhancing the safety of e-bike and electric scooter riders, and most
importantly pedestrians navigating the sidewalks and streets. There have been several reports of
reckless rider behavior endangering pedestrians.

On behalf of the Board of Directors of the Morgan Hill Homeowners Association, we respectfully request
the City of Temecula, the Temecula Valley Unified School District, the Riverside County Sheriff's Office
and the Beard of Supervisors of the County of Riverside address the Issues of a -bike and electric scooter
safety. We understand that the popularity of these items has far exceeded the ability of our Legislature
and local governmentRaw enforcement to create and pass new laws, defining what is legal. It has
become apparent that an enormous number of young people (students) are the ones who urgently need
instruction. We are suggesting a combined effort including schools, law enforcement, County and
community services require e-bike/electric scooter safety instruction.
The curriculum could/should include rules of the road, a -bike laws, helmet safety, interaction with vehicles
and pedestrians as well as suggestions for parents. Attendees should be accompanied by an adult and,
upon completion of the course, will be Issued a permit which will allow those students to ride/store their e-
blkes or electric scooters on campus during the school day.
We have all seen the safety issues involving these items. Please consider this request as an effort to
prevent future injuries or worse, a tragic loss of life.

RE: City of Temecula to Focus on Safety Measures for E-Bikes and E-Motorcycles
TEMECULA, CA — Temecula Mayor James Stewart announced plans for the City to re-examine local
regulations and create more awareness about a -bike safety throughout 2024 as the popularity of e-bikes
continues to grow.
Mayor Stewart states, "E-bikes are emerging as both an efficient mode of transportation and a fun outdoor
recreational opportunity that the City whole-heartedly supports, but we need to ensure riders are following
the law for their own protection as well as those who travel along the same roads and trails." Of particular
concern are young riders who lack experience navigating through traffic and are more inclined to engage
in reckless biking behaviors such as ignoring stop signs/traffic signals, riding at excessive speeds in
pedestrian areas, crisscrossing roads in front of oncoming traffic and performing stunts in City parks and
streets oblivious to the dangers they are posing to themselves and others.
Mayor Stewart highlighted the importance of examining existing laws and exploring additional regulations
to keep riders safe, "We'll take a comprehensive approach that includes education and enforcement to
ensure the safety of everyone sharing the City's roadways and trail system."
The City's Sheriff's Department and Temecula Valley Unified School District (TVUSD) are partnering to
raise awareness among the youth who are riding a -bikes to and from schools. Temecula Captain Chris
Durham states, "Our goal is to avoid imminent tragedies by engaging with students, and also their parents
who are likely unaware that their adolescent child or teenager is riding with little regard for safety;
oftentimes illegally and without helmets." Anyone under the age of 18 must wear a helmet on any type of
bicycle or e-bike, and Class 3 e-bikes and e-motorcycles require helmets regardless of age. Temecula's
'Caught with your Helmet On' campaign has positively reinforced bike safety wherein deputies, school
resource officers and other first responders provide gift cards to students they 'catch' riding with their
helmet on. Additionally, Bike Temecula Valley, a local nonprofit organization, TVUSD and Sheriff
personnel are promoting bicycle safety strategies and introducing Rules of the Road at school assemblies
citywide.
The City's Sheriff Department and TVUSD are also implementing a plan that requires students attend
mandatory free instructional classes given by the Sheriffs Department to be permitted to ride their a -bike
or motorized scooter to or from school and park on campus beginning with the next school year. This
program will educate students about the rules of the road, a -bike laws, helmet safety, interaction with
vehicles and pedestrians, and more.
All cyclists (e-bike riders included) are subject to the same rules of the road as motorists. Cyclists who do
not follow the laws are subject to ticketing and fines as defined by the California Vehicle Code or local
Municipal Code. "If positive engagement, education, awareness, and warnings aren't adhered to, parents
and their kids can expect that we will cite the rider and impound their e-bike if necessary," adds Captain
Durham who further states, "This is not punitive; it is literally to save their life."
The subject of e-bike safety will be placed on the next Traffic Safety Commission meeting agenda for
general discussion and direction. Members of the public are welcome to share their comments with the
Commission about this important topic. The meeting will be held at City Hall on Thursday, February 22,
2024, at 6pm.

1. Citywide Concrete Repairs FY2023-24
Project: Citywide Concrete Repairs
Status: On November 13, 2023, Loamic Builders Inc. began preparing for concrete repairs
in various locations throughout the city. Construction is continuous. Various
sidewalk, lane, and shoulder closures are expected during the working hours.
(Monday through Friday 7:00 a.m. to 4:30 p.m.). The project is scheduled for 60
working days and is anticipated to be complete in March 2024.
2. Citywide Slurry Seal FY2023-24
Project: Slurry Seal Residential Streets — Citywide Slurry Seal FY 2023-24 Map
Week 10 Schedule
Status: On On October 11, 2023, American Asphalt South began preparing streets for
slurry seal. Construction is continuous. Various lane and road closures are expected
during the working hours (Monday through Friday 7:00 a.m. to 4:30 p.m.). The
affected residential tracts are as follows:
Rancho Vista & Los Ranchitos
Rancho Vista East
Vail Ranch
The project is scheduled for 75 working days. A weekly schedule for street closures
for slurry seal placement will be made available the week prior to work commencing.
Anticipated completion February 2024.
3. 1-15, I-215, Winchester Road, and Murrieta Hot Springs Road
Project: 1-15 / French Valley Parkway Improvements — Phase II
Status: Project construction will run May 2023 through May 2025. Work will involve
northbound portions of 1-15 and 1-215 between Rancho California Road and
Murrieta Hot Springs Road, and the connecting on- and off -ramps. For Traffic

Event: Utility Work
Status: EMWD performing a sewer modifications project resulting in the North Bound #2 lane
closed, along with the Murrieta Creek multipurpose trail closed from January 2024
through July 2024. Anticipated completion end of summer 2024
6. First St. West of Pujol St. and Vincent Moraga Dr. South of Felix Valdez
Project: Utility Work
Status: Murrieta Development will be performing traffic flagging operations for utility pothole
work for future water lines for the Altair Development. Work is scheduled to start on
February 12th, 2024. Work hours are Monday - Friday 7:00 AM - 4:30 PM.
Anticipated completion will be the end of February 2024.
7. Loma Linda / Redwood St.
Project: Utility Work
Status: SCE will begin utility work resulting in intermittent lane closures during work hours.
Working hours are Monday through Friday from 9:00 a.m. to 2:00 p.m. Asphalt
paving restorations are scheduled for 16t" of February and working hours may be
extended during this time. Anticipated completion mid of end of 2024.

10.24.040 Bicycles on Sidewalks and Trails
E. Notwithstanding the provisions of Section 10.24.030 and Section 12.04.050, only bicycles may be allowed to
be ridden within City parks.
My wife and I own a class-1 a-bike that we ride with our son. We would like to be able to safely take our bike
in parks. Enforcing a speed limit on all bikes, including class 1 e-bikes would be preferred over an outright ban
in parks. Banning class 3 bikes seems perfectly reasonable as these are more like motorcycles than bikes and do
have a much greater capacity for damage and injury.
12.04.050 Operation of Vehicles
D. Bicycles. Bicycles are allowed within City parks provided they have no pedal assist or throttle assist
features.
E. Electric Bicycles (E-bikes).No person shall ride or operate an electric bicycle within city parks.
Our family certainly advocates for safety,but we disagree that a-bikes should be banned from parks. Parks are
one of the few destinations for bike commuting in the City of Temecula and we should be instead providing
better bike infrastructure within our parks so that both kids and adults can ride safely and pedestrians don't feel
threatened by cyclists.
We should also take a long-term view of safety and consider how technologies like geo-fencing could be
utilized and implemented to force a-bike speed limits within zoned areas (such as parks and business districts).
It seems unwise to enforce laws that might be harder to overturn once viable technology is able to solve these
issues in a better way.
Overall, it's disappointing to see that there is no mention in this agenda of better bike paths and trails as being a
major component of a-bike and bicycling safety. I agree that safety is important, but banning and restricting
riding will potentially discourage what has the opportunity to be a sustainable form of transportation that helps
the city meet its climate and transportation goals. Based on what I've observed on my own rides through the
city, I believe there are many opportunities to provide safe routes and designated riding areas that will make it
easier to enforce safe riding,while not discouraging and alienating our youth.

e-Bikes are not going away. Let's take a long-term approach to becoming a city that makes them a safe
transportation option.
