HomeMy WebLinkAbout05_050 PC Resolution PC RESOLUTION NO. 2005-50 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMECULA RECOMMENDING THAT THE CITY COUNCIL APPROVE AN ORDINANCE ENTITLED "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMECULA AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF TEMECULA AND AMENDING PORTIONS OF TITLE 17 OF THE TEMECULA MUNICIPAL CODE TO ACHIEVE CONSISTENCY WITH THE PROVISIONS AND REQUIREMENTS OF THE UPDATED CITY GENERAL PLAN (PA05-0085)" WHEREAS, Section 65800 of the Government Code provides for the adoption and administration of zoning laws, ordinances, rules and regulations by cities to implement such general plans as may be in effect in any such City; WHEREAS, the City of Temecula has undergone an extensive process of comprehensively updating the City General Plan; WHEREAS, the City Council forthe City ofTemecula approved a comprehensive update to the City General Plan and Certified the Final Environmental Impact Report on April 12, 2005; WHEREAS, the City of T emecula desires to ensure that the City Zoning Map and Municipal Code are consistent with the updated General Plan; WHEREAS, the Planning Commission considered the proposed amendment on July 6, 2005, at a duly noticed public hearing as prescribed by law, at which time the City staff and interested persons had an opportunity to, an did testify either in support or opposition to this matter; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OFTEMECULA DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. Recommendation of Approval. The Planning Commission for the City of Temecula hereby recommends that the City Council adopt an ordinance making the Development Code consistent with the recently updated General Plan substantially in the form attached to this resolution as Exhibit A. Section 2. Meadowview Zoninq. Included in the recommendation is that the Official Zoning Map show the residential parcels for the Meadowview tract with a Low Density Residential (L) designation. Planning Commission Chairman Mathewson did not participate in the discussions, considerations or vote concerning zoning designations for Meadowview as he owns a home in the Meadowview tract. Section 3. Environmental Compliance. The Final Environmental Impact Report for the Update of the General Plan and related amendments to the Development Code was certified on April 12, 2005. This Ordinance is part of the consistency re-zoning process that was included in the project assessed by the environmental impact report for the General Plan Update. Since the Certification of the FEIR, there have been no changes in circumstances or setting that would require the preparation of an addendum, subsequent or supplement to an EIR. As a result, the Planning Commission recommends that the City Council make a finding that this Ordinance is exempt from further environmental review because it is included as part of a project for which an environmental impact report was prepared.
