HomeMy WebLinkAbout100605 DH Minutes MINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA DIRECTOR'S HEARING OCTOBER 6, 2005 A regular meeting of the City of Temecula Director's Hearing was called to order on Thursday, October 6, 2005 at 1 :30 PM in the Community Development Conference Room, located at 43200 Business Park Drive Temecula, California. Principal Planner Don Hazen presiding. Also present were, Assistant Planner Harmony Bales, and Minute Clerk Cynthia Lariccia. Item No.1: Plannina ADDlication PA05-0242 a Minor Conditional Use Permit to establish a 13.978 sauare foot indoor children's Darty facility within an existina buildina. located on the northeast corner of Business Park Drive. Principal Planner Hazen convened the meeting at 1 :30 PM. Assistant Planner Bales gave an overview of the project, including hours of operation and parking. Project has been deemed CECA exempt. Principal Planner opened the Public Hearing at 1 :37 PM. Applicants Myra and Tony Thornton, 32889 Canyon Crest Drive, Wildomar have reviewed and agreed to the conditions of approval. Joseph Tortomasi, 1766 Rabbit Hill, Fallbrook, owner of the building, commented on the parking use and recommended approval of the project. Principal Planner Hazen requested clarification of parking on the site map. Myra Thornton stated the map for parking came directly from the CC&R's that spell out which building is allotted which parking spaces and designates the remaining spaces as common for use by all the business park facilities. Principal Planner Hazen asked if a representative of the business park association offered City staff written consent that demonstrates to the City the allowable use of these common spaces. Assistant Planner Bales stated that no correspondence has been received from the association. Principal Planner Hazen stated that staff needs to look at a copy of the CC'R's and/or a statement from an authorized representative that acknowledge that these undesignated spaces are available on a first-come, first-serve basis. Mr. Thornton also clarified the use of the building as a private party facility and their will be no loitering in the area. Principal Planner Hazen closed the Public Hearing at 1 :48 PM Principal Planner Hazen clarified permitted use and conditional use of the facilities in the business park. The City can regulate conditional use permits. He stated he had concern with parking and needs verification from the business association that these parking spaces are not restricted. Secondly, he wanted staff to go through mailing labels to see if notifications were accurate and that the association was included. Based on the flawed notice and outstanding question on the allocation of parking and getting proper consent, Pincip;al Planner Hazen continued the application to the October 13, 2005 Director's Hearing. Applicant consented to the continuance. Item No.2: Plannina ADDliCRtion PA05-0212 a Minor Conditional Use Permit to uDarade an existina Tvoe 41 (on sale beer and wine-eatina Dlace) license to a TVDe 47 (on sale aeneral-eatina Dlace) license. located on the northeast corner of Ynez Road and Solana Wav. Assistant Planner Bales gave an overview of the project, including hours of operation and impact on surrounding uses and traffic. Project has been deemed CECA exempt. Principal Planner opened the Public Hearing at 1 :55 PM. Dick Evitt, 5905 Winncliff Drive, Riverside, agent, working on behalf of the applicant, and requested modification on Item #11 of Conditions and Approval regarding hours of operation. He stated that the restaurant would remain open entire day and not close between serving times. He also is awaiting clarification from the Health Department regarding a hood in the kitchen. Principal Planner Hazen asked if there was a separate bar or lounge area. Applicant stated only tables and outside eating area. . Assistant Planner Bales responded to the question on the hood. The site plans supplied to the County was from previous tenant improvements and suggested applicant contact the County. Principal Planner closed the Pllblic Hearing at 2:00 PM Principal Planner Hazen approved PA05-0212 and modified Condtiion#11 deleting reference to specific hours of mealtimes. He also clarified for the record that the Health Department letter will only be referenced in the event it becomes applicable.
