CALL TO ORDER
The City of Temecula Community Services Commission convened in a regular meeting at 6:00
p.m., on Monday, February 13, 2006, in the City Council Chambers of Temecula City Hall,
43200 Business Park Drive, Temecula, California.

Honoring Ms. Janet Kitchel for her outstanding efforts with regard to Development Services,
Chairman Edwards presented Ms. Kitchel with a plaque of recognition.
Thanking Chairman Edwards and staff, Ms. Kitchel noted that it has been a pleasure for her to
work in the Community Services Department.

DIVISION REPORTS
Maintenance Superintendent Harrington provided a brief overview of items that were addressed
by the Maintenance Division since the last Community Services Commission meeting, noting
the following:
. That the Maintenance Division has completed the installation of the handrails and
upgraded the stairway step lighting at the Temecula Community Theater auditorium
. That light was installed at the Mary Phillips Senior Center and the Temecula Community
Center flagpoles
. That a security light was upgraded at the back of the Temecula Community Center
. That plant materials were installed throughout many roadway median islands in the
Redhawk and Vail Ranch Developments

. That a failing wrought-iron fence adjacent to the flood control channel was replaced at
the Vail Ranch Development
. That the walk-way lights were repaired at Vail Ranch Park and Redhawk Park site E and

Recreation Superintendent Pelletier provided the Community Services Commission with a brief
staff report, noting the following:
. That morning lap swim was extended to 5:30 a.m. rather than 6:00 a.m. and has been
well received by the public
. That on Friday, February 10, 2006, a Family Astronomy Night was held, and was a well
received
. That the FIT program will begin on March 13, 2006, and will be held at the Ronald
Reagan Sports Park as well as Harveston Community Park from 6:00 p.m. to 8:00 p.m.,
Monday through Friday
. That more information regarding the annual volunteer recognition event will be provided
at the March 13, 2006, Community Services meeting.
Cultural Arts Administrator Betz provided a brief summary of activities in the Cultural Arts
Division, noting the following:
. That auditions for the Frog Prince will be held on Monday, February 13, 2006, and will
be produced by Missoula Children's Theatre
. That Mr. Bill Strong was hired as the new Technical Coordinator for the Old Town
Temecula Community Theater
. That the Antique Radio - The Roger Sannipoli Collection at the History Museum
received positive feedback from visitors
. That Leverne Parker - History Regional Paintings, will be held at the History Museum
opening March 11 through April 30, 2006
. That the Children's Museum has been running at full capacity.
In response to Commissioner Meyler's question, Mr. Betz noted that the Missoula Children's
Theatre travels throughout the United States to provide special programs with kids from local
communities. .
Development Services Administrator McCarthy provided the following report:
. That the YMCA has submitted its development plans to the City for review process,
advising that its new facility will be located in Margarita Park

. That construction will begin on the six-acre neighborhood park.
CONSENT CALENDAR

1.1 That the Community Services Commission approve the minutes of the January 9,
2006 meeting.
MOTION: Commissioner Henz moved to approve the Consent Calendar. Commissioner
Meyler seconded the motion and voice vote reflected unanimous aDDroval.
COMMISSION BUSINESS
2. Librarv UDdate
2.1 That the Community Services Commission receive and file a report on the
progress on the Temecula Public Library Project.
Deputy Director Ruse provided the Commission with a brief update of the Temecula Library
Project, noting the following:
. That construction is progressing well and on schedule
. That the foundationlslab and the structural steel have been erected beyond the center
point of the building
. That the remaining foundation and steel will be poured in the near future
. That the curb and plantings have been installed in the parking lot, advising that it would
be anticipated to pour the asphalt within the next couple of weeks
. That the bids for the Pauba Road improvements (separate project) were opened on
January 9, 2006, and that a contract has been awarded and construction would be
anticipated to begin within the next 30 to 45 days
. That LLSI has begun the purchasing and processing of the opening day collections, and
selecting collections will be moved from the existing branch to supplement the new
opening day collection: and that RFID tags for radio frequency identification will be
included in the process
. That the Information Systems Department continues to work on all other technology that
will go into the library
. That staff has been working with the County, LLSI and architects LPA, to begin the final
selection of furnishings for the library
. That it would be anticipated to have the construction in the early fall of 2006 with an
opening shortly thereafter.

For Commissioner Hogan, Ms. Ruse noted that those wishing to donate to the library would
need to go through the Friends of the Library.
Commissioner Henz gave kudos to Deputy Director of Community Services Ruse and staff for
their efforts with regard to the new library.
It was the consensus of the Community Services Commission to receive and file this report.
3. Patricia H. Birdsall SDOrts Park UDdate
3.1 That the Community Services Commission receive and file an update on Patricia
H. Birdsall Sports Park.
Via overheads, Development Services Administrator Mc Carthy provided a brief up date on the
Patricia H. Birdsall Sport Park.
For Commissioner Henz, Development Services Administrator Mc Carthy relayed that 450
parking spaces will be provided for the Sports Park.
It was the consensus of the Community Services Commission to receive and file this report.
4. Doa Park Proiect UDdate .
4.1 That the Community Services Commission receive and file a report on the sub-
committee's findings on the Dog Park Project.
Via overhead, Director of Community Services Parker provided a brief update on the sub-
committee's findings on the Dog Park Project.
At this time, the public hearing was opened.
Mr. Nick Shistople, Temecula, relayed his support for the proposed project, but expressed his
desire for a larger dog park.
At this time, the publiC hearing was opened.
For the Commission, Director of Community Services Parker noted that staff could explore the
possibility of expanding the proposed dog park.
Chairman Edwards noted that Long Canyon Creek Park would have a long and linear space
and would make a good candidate for a dog park.
MOTION: Commissioner Hogan moved to approve the proposed dog park as presented.
Commissioner Henz seconded the motion and voice vote reflected unanimous aDDroval.

No reports at this time. Mr. Parker distributed a departmental report to the Commission.

For Commissioner Fox, Mr. Parker noted that the Roripaugh and Johnson Ranch Open Space
Agreement would be a working document at this time, but that at the completion, a copy will be
forwarded to her.
In response to Commissioner Hogan's query regarding Murrieta Creek, Director of Community
Services Parker stated that the the Public Works Department has taken the lead on the creek
project, but would be of the opinion that the project will be underway some time in the near
future.
COMMISSIONERS' REPORTS
For Commissioner Henz, Ms. Carthy noted that the contract for the Redhawk Park upgrades
would be nearing completion and will be moving forward.
Commissioner Henz expressed concern with CC&R's new guidelines with regard to Household
Hazardous Wastes, and requested that the issue of Household Hazardous Wastes be
agendized for discussion.
Understanding Commissioner Henz's concem, Director of Community Services Parker stated
that he will agendize the issue for discussion.
ADJOURNMENT
At 7:00 p.m., Chairman Edwards adjourned this meeting to the next regular scheduled meeting
on Monday, March 13, 2006, at 6:00 p.m., in the City Council Chambers, 43200 Business Park

SUBJECT: Amendment to the Old Town Specific Plan (PA04-0596)
BACKGROUND
The City Council originally approved the Old Town Specific Plan (OTSP) on February 8 1994.
Periodically since that time, the Specific Plan has been modified to respond to the ever changing
situation in Old Town.
ANALYSIS
The proposed amendment originates from a number of issues that have come up since the Specific
Plan was updated earlier this year. By addressing these issues staff believes that that the OTSP will
enable a more appropriate style of development and that the revitalization of Old Town will be
improved. The proposed changes are as follows:
. Allow '10r profit" museums within the High Density Residential Planning Area
. Delete the Conditional Use Permit requirement for mixed use projects, and allow the
determination for individual uses within a mixed use project to be based on the use matrix
. Require residential uses within mixed use projects to provide on-site parking for each
residential unit, or accept an in-lie4 parking fee
. Provide flexibility in how private open space is provide for mixed use projects
. Expand the historic preservation requirements of the Old Town Specific Plan to four
designated historic sites outside of Old Town T emecula and to clarify the requirements for
making determinations of historic appropriateness
. Incorporate design standards for the remaining alleys in Old Town
. Make a number of minor clarifications to the sign provisions, design guidelines and the
permitted use matrix

Staff proposed to amend the regulations for the High Density Residential Planning Area to allow '10r
profit" museums within this district of the Old Town Specific Plan.

Mixed Use Proiect Recuirements
At this time the first new mixed use buildings are being proposed within Old Town. As staff has
reviewed the applications for conformity with the Specific Plan, staff has identified potential
unanticipated consequences. As a result, staff is recommending that the conditional use permit
requirement for mixed use projects be removed from the Specific Plan. In doing this, residential
uses within a mixed use project will be permitted by right, whereas the determination for non-
residential uses will be made based on the Land Use Matrix (Table 111-1), which identifies specific
uses as either permitted, conditionally permitted or prohibited in its corresponding columns for
Tourist Serving Residential and Tourist Retail Core.
The policy that eliminated off-street parking within Old Town in order to stimulate economic
development within Old Town has worked as anticipated; however, in the interest of sustaining
economic development and vitality of mixed use projects, staff is concerned that this policy could
negatively affect the residential component of mixed use development within Old Town. Therefore,
staff is proposing that mixed use projects require one on-site parking space for each proposed
residential unit. Staff is also proposing as part of this provision that if the parking requirement
cannot be met, then the applicant may petition the Director of Planning to pay an "in-lieu" parking
fee. This on-site parking requirement for residential uses in mixed use development will eliminate
the need for residents to compete for parking on the street or in public parking lots and help ensure
the viability of residential mixed-use development.
The requirement that each unit be provided with its own private open space area can make it harder
to provide the trad.itional downtown streetscape. To allow more flexibility, staff is recommending that
private open space requirement for mixed use projects in the Old Town area be reduced from 150
square feet to 75 square feet per unit, and to allow the private open space requirement to be met.
individually per unit, communally for the entire project, or in a combination of both approaches.
Staff feels that this. additional flexibility for mixed use projects in the Tourist Retail Core Planning
Area will better achieve the vision for the core of Old Town Temecula.
Exoansion of the Historic Preservation Provisions
In recent months, there has been a growing concern that the historic structures outside of Old Town
Temecula do not have the same protections as the historic structures within Old Town. As a result
staff has identified a mechanism to extend these protection provisions without creating a new Board
or Commission. The proposal would modify the historic preservation provisions in Chapter V of the
Old Town Specific Plan to apply to all designated historic structures within the City. According to the
proposed amendment, the Old Town Local Review Board will have the opportunity to review any
proposed changes to the exterior of the building before the Director of Planning or the Planning
Commission considers the proposed changes.
The other changes to the historic preservation requirements consist of a minor change to how a
determination of historic appropriateness is made. The change focuses on the determination action
rather than on the issuance of a certificate. The change does not effect how the Old Town Local
Review Board currently operates.

Staff has sent a letter to the owners of the four historic sites outside of Old Town to make them
aware of the City's plans. A copy of the letter is included in Attachment 2.
Alleys
Another area of concern is the need to protect the remaining alleys within Old Town Temecula.
Over the years, many of the alleys within Old Town have been vacated. At this point in time only
about half of them remain. Staff is recommending that the remaining alleys be maintained. To
accomplish this, the proposed amendment would require the protection of the remaining alleys and
would establish design and improvement criteria within the OTSP. Most of the remaining alleys
would retain a primarily vehicular function. The exception is the small alley between Fourth and Fifth
Streets that runs between Old Town Front Street and Murrieta Creek. Portions of this alley have
been designated primarily for pedestrian use.
Other Clarifications/Chances
The remaining changes represent minor adjustments and clarifications including: the updating of the
correct title for the color palette, adding Day Spas as permitted uses in the Tourist Retain Core and
Community Commercial Planning Areas, and clarifying that plywood in an unacceptable exterior
material. Most of the remaining changes involve the restoration of several sign standards that had
been approved during an earlier amendment and had been accidentally left out of an earlier
amendment to the Old Town Specific Plan.
RECOMMENDATION
Staff is recommending that the Old Town Local Review Board make a recommendation that the
Planning Commission review the proposed changes to the Old Town Specific Plan and forward a
recommendation to the City Council.

Designated alleys within Old Town shall be maintained and protected for future
public use. The design and components within each alley shall be consistent with
the purpose identified within this Specific Plan. Development projects adjacent to
the designated aUeys will be required to construct improvements in and adjacent
to the alley. These improvements shall include paving, lighting, or other
necessary components to ensure the functionality and safety of the designated
aUeys. Umited landscaping should be provided when feasible, provided that the
functionality of the alley is not affected. When resident or business parking is
established in the rear yard areas adjacent to the alleys, access to these parking
spaces may be provided directly to the alleys."

''7. Loading Facilities
Loading and unloading facilities shall be visually screened from access streets and

loading and unloading facilities is physically not possible, the facilities shall be
architecturally integrated into the overall design of the building. Loading and
unloading areas in or adjacent to the alleys do not require additional visual
screening. "
3. Amend Section IV by adding a new Subsection L to read as follows:
"L. ALLEY GUIDEliNES
The aUeys in Old Town Temecula were originaUy created with the original plat and
subdivision in the 1880's. Since that time, many of the alleys have been eliminated.
As part of the revitaliZlltion efforts in Old Town, it has been detennined that the
remaining aUeys need to be preserved and integrated into the Specific Plan. The
purpose of this Section is to provide guidance on the use of alleys within the Old
Town Temecula.
The primary purposes of the remaining alleys are either for vehicular access or
pedestrian .access. The primary goal of the vehicular access alleys is to provide
service and rear area parking access to adjacent properties. The majority of these
alleys are located between Old Town Front Street and Mercedes Street. The primary
purposes of the pedestrian access alleys are to enhance the pedestrian connections
between Old Town Front Street and Murrieta Creek.
The foUowing alleys between Old Town Front and Mercedes Streets will retain a
primarily vehicular function: .

Guideline I - Functional Desil!n for Vehicular Access AUevs
The alleys designated for primary vehicular access should comply with the
foUowing criteria:
. The minimum width of the aUey travelway shaU be at least a twenty
(20)feet.
. Parking spaces may back into the aUeys provided that at least 12 feet is
provided between the centerline of the alley and the back of the
parking space.
. Pedestrian amenities may be provided along the vehicular access alleys
provided that the use of the alley for vehicular access is not impaired
or restricted.
. Additional landscaping may be provided but is not required to be
provided along the aUeys unless adjacent to pedestrian or resident
seating areas and when additional screening is required.
. Businesses may establish patron entrances from vehicular access
alleys provided that additional space is provided to that an area at least
six feet in width is provided to accommodate door swing and safe
pedestrian movement into and out of the business.
Guideline 2 - Functional Desil!n for Pedestrian Access AUevs
The alleys designated for primary pedestrian access should comply with the
foUowing criteria:
. Pedestrian amenities such as fountains, landscaping and seating areas
should be provided when limited vehicle use is not anticipated.
. Businesses may take access from pedestrian access alleys.
. Portions of pedestrian access alleys used for limited vehicular access
should confonn to the requirements for vehicular access aUeys.

A. PURPOSE
Protecting the cultural heritage and historical architectural resources found in Old Town
and elsewhere in Temecula is part of the overall goal for the revitalization of Old
Town and the protection of the community's heritage. The Old Town Specific Plan
also gives owners of eligible historic properties relief from the contemporary municipal
codes, ordinances, taxes, and laws levied on newer contemporary structures. Historic
structures on the Temecula Local Historic Register that are located outside of Old
Town Temecula are also eligible to receive relief from contemporary municipal
codes, ordinances, taxes, and laws levied on newer contemporary structures.
B. ESTABLISHMENT OF THE DISTRICT
The boundary of the Old TewR Temecula Local Historic Preservation District shall be
coterminous with the boundary of the Old Town Specific Plan. In addition, the
Temecula Local Historic Preservation District also includes the following historic
structures outside of Old Town Specific Plan:
1. Vail Ranch Headquarters complex located at 32095 Highway 79 South
2. Vail Ranch House located at 31658 Via San Carlos

6.5. Nothing in this section shall be construed so as to exempt any person from
complying with any other provision of law.
D. OLD TOWN LOCAL REVIEW BOARD (OTLRB)
I. The Old TaWIl Temecula Local Historic Preservation District shall have an
advisory review board known as the Old Town Local Review Board to provide
input into all major projects within the Old Town Specific Plan and to review any
proposed modifications to any historic structure. The Director of Planning may
also provide the Old Town Local Review Board with information on major
projects that are either: adjacent to Old Town that may have the potential to
affect the Old Town area or that are adjacent to or have the potential to affect
any historic structure or site. '
2. The Old Town Local Review Board shall be composed of five members and one
alternate (who shall serve in the absence of any member). Board members shall
be appointed by the City Council for terms of 3 years. The member terms shall be
staggered so that all the members of the Old Town Local Review Board are not
appointed at the same time. All members shall exhibit an interest in and

knowledge of the history and architecture of the Old Town Temecula Local
Historic Preservation District. At least one member shall be knowledgeable in
architectural and construction techniques. Members shall serve without pay.
3. The Old Town Local Review Board shall hold regular public meetings and
establish such rules as may be aI'I'LVI',;ate or necessary for the orderly conduct of
its business. Three members shall constitute a quorum. At its first meeting of the
year, the Board members shall elect a Chairman and Vice Chairman (who will
officiate the meetings when the Chairman is absent), who shall serve for terms of
one year.
4. The Old Town Local Review Board shall have the following powers and duties in
addition to those otherwise provided in this ordinance:
a. Provide for pre-application conferences with individuals interested in
constructing or altering p,~,..",,;y within the Old Town Temecula
Local Historic Preservation District. The purpose of these conferences
shall be to familiarize the applicant with the historic significance and
related architectural themes of the district.
b. For historic' structures within Old Town Temecula, utilize the
adopted Old Town Specific Plan Design Guidelines in the review of
applications as part of process to make findings of consistency and
al'l"VI',;ateness with the Specific Plan. Use the Design Guidelines as
a basis for approving or denying applications for a Finding
Cerlifieale of Historic Appropriateness.
For historic structures outside of Old Town Temecula, utilize the
best available information for the architectural style of the historic
structure to maintain the integrity of existing historic architecture as
well as preserve its local historic context.
c. Explore means for the protection, retention, and use of any significant
structures, natural features, sites, and areas in the district including but
not limited to a,..,..,~,..,;ate legislation and financing by independent
funding organizations, or other private, local, state, or federal
assistance.
d. Serve as an advisory resource to all agencies of the City in matters
pertaining to the Temecula Local Historic District, and to encourage
efforts by, and cooperation with individuals, private organizations, and
other governmental agencies concerned with preservation of the
district's architectural, environmental, and cultural heritage.
e. Render advice and guidance, upon request of the property owner or
occupant regarding construction, restoration, alteration, decoration,
landscaping, or maintenance of any structure, natural feature, site or
area within the district.

f. Encourage public understanding and appreciatIOn of the unique
architectural, environmental, and cultural heritage of the district
through educational and in;"'I",,,iative programs.

1. The City Council has identified the following historic buildings and structures in

designated on the Local Historic Register for the City of Temecula. All buildings
on this list are eligible to receive any and all benefits authorized by the State of
California for designated historic structures. The use of the Historic Building

F. CERTIFIC,....TE FINDING OF mSTORIC APPROPRIATENESS
1. No existing designated historic building or .structure may be altered or
demolished, and no new building or structure constructed without a the pFieP
9JlPFO'Vftl of Finding a Certifieate of Historic Appropriateness pursuant to the
provisions of this Section prior to the alteration or demolition. The Finding
shall be incorporated into the review and approval process for the requested
change.
2. Certifieates A Finding of Historic Appropriateness within Old Town Temecula
may be issued either by the Director of Planning or the Planning Commission or'
City Council as part of the approval process for any development within the Old
Town Specific Plan. The approval authority for a determinatioR of who
9Jlproves the Certifieates Finding of Historical Appwp>;ateness shall be based
upon the approval authority established by the Development Code for the
accompanying application. No development application for Level Two projects
in Old Town, as described below, may be approved without a recommendation
from the Old Town Local Review Board.
3. Certifieates A Finding of Historic Appropriateness for structures located
outside of the Old Town Specific Plan may be approved by the Director of
Planning for Level One projects and by the Planning Commission for Level
Two projects. The Old Town Local Review Board shall review and provide
comments on all requests to alter any historic structure.
4. For the purposes of implementing the provisions of the Old Town Specific Plan
and the requirements of the Temecula Local Historic Preservation District,
there are two levels of Old Town development projects. The first category is the
ministerial or minor projects, referred to as Level One projects. The second
category is for non-ministerial and major projects, also called Level Two projects.
a. Level One Proiects do not require the review and recommendation of
the Old Town Local Review Board. Level One projects may be
approved by administrative (staff only) review following the Director
of Planning's determination to grant a Finding Certificate of
Historical Appropriateness. Typical examples include the following:
.
Interior ehaRges or alterations to historic structures;
Re-Iandscaping around existing structure;
Re-roofing of an existing building;
Additions and remodels to non-historic single family residences;
Exterior architectural modifications to an existing commercial,
office, or residential building effecting less than 25% of the froilt
or street side exterior facade;
The demolition to non-historic buildings and structures;
New individual signs up to 12 square feet in size; and
Changes in the copy of previously "pp>u led signs.

The Director of Planning, at hislher tlteiF-sole discretion, may forward
Level One projects to the Old Town Local Review Board when unique
circumstances, or the sensitivity of adjacent historic structures or land
uses indicate the potential for an adverse aesthetic impact.
b. Level Two Projects have the potential for significant aesthetic impacts.
Level Two Projects shall always require review by the Old Town
Local Review Board prior to action by the approving authority.
Typical examples of Level Two projects include, but are not limited
to, the following:
. Multi-family residential projects;
. New commercial and office projects;
. Exterior architectural modifications to an existing commercial,
office, or residential building when 25% or more of the front or
street side exterior facade is affected;
. The alteration to a designated historic structure;
. The demolition of, or substantial alteration to, a designated
historic structure (requires Planning Commission approval);
. New individual signs over 12 square feet;
. Mini-monument signs located on architectural features that
exceed the standard height requirement of four feet; and,
. The removal of a specimen oak tree with a 10 inches or greater
trunk diameter.
5. All applications shall be filed 9R tile f9FRlS ftRd in a manner determined by the
Director of Planning.. Requests for a Finding of Historic Appropriateness
:'..jlplieati9BS shall not be accepted unless they. are accompanied by the
ayy.vy.:ate filing fee and such information and drawings as may be required by
the Director of Planning. All applications for Certifieates a Finding of Historic
Appropriateness shall be signed by either the owner of the property or a person
authorized by the owner.
All drawings shall be signed by the architect responsible for the design and must
be in sufficient detail to show the proposed design for the site. This includes the
architectural design and elevations (including signs), proposed materials, textures
and colors (including material samples), and the site layout (including all
improvements affecting appearances, such as walls, walks, terraces, plantings,
accessory buildings, signs, lights, and other similar elements).
6. Following the receipt of a complete application, the Director of Planning shall
schedule a meeting of the Old Town Local Review Board within 60 days and
provide the Board with a staff report, including a copy of the site plan and
. elevations. The Board shall review the application material and make a
recommendation to approve or deny, with or without conditions, any requests for
a Certifieates Finding of Historic Appropriateness to the approval authority
designated by the Development Code.

7. In considering requests applieatioBs for Certifieates a Finding of Historic
Al'l'wl',;ateness, the Old Town Local Review Board shall make the following
findings:
a. That the proposed structure is in conformance with the General Plan
for Temecula and with all applicable requirements of slate law and
other ordinances of the city and is designed for the protection of the
public health, safety, and general welfare.
b. That the proposed structure is in conformance with the requirements of
the Old Town Specific Plan, including the goals, objectives and
policies, and architectural guidelines and standards.
c. In the event of the proposed demolition of a designated historic
building or structure, the Board shall also be required to find that
applicant has submitted substantial evidence that the structure is
imminently dangerous or unsafe and that the structure can not be
effectively repaired or retrofitted.
8. The expiration date for a Certifieates Finding of Historic AI'I',vl',;ateness shall
be the same as expiration date for the accompanying planning application, as may
be extended pursuant to the provisions of the Development Code. If the
Development Code does not specify an expiration date, the project for which the
Certifieates Finding of Historic Appropriateness was approved shall commence
construction within three years of the date of approval or the Certifieates Finding
of Historic Appropriateness shall become null and void. No extensions of time
will be allowed for these projects.
G. MAINTENANCE AND CARE
1. The owner, occupant, or other person in actual charge of an building or structure
on Temecula Local Historic Register shall keep in good repair all of the exterior
portions of such improvement, building, or structure, all of the interior portions
thereof when subject to control as specified in the designation statement, and all
interior portions thereof whose maintenance is necessary to prevent deterioration
and decay of any exterior architectural feature.
2. Nothing in the requirements of section shall be construed to prevent the ordinary
maintenance or repair of any exterior architectural feature in or on any designated
Temecula Local Historic Register building of structure that does not involve a
change in design, material, or external appearance thereof.

H. ADDITIONAL VIOLATION PROVISIONS FOR HISTORIC STRUCTURES
1. In addition to the general violation provisions in Section III.H.7 of the Specific
Plan, any person who demolishes, alters or removes a building or structure on the
Temecula Local Historic Register, that person and the owner shall be required to
restore the building, site, or structure to its original condition and selling prior to
the violation within ninety days. Any action to enforce this provision may be
brought by the city or any other interested party. This civil remedy shall be in
addition to, any criminal prosecution and penalty and any other remedy provided
bylaw
2. If any person demolishes or removes aD building or structure on the Temecula
Local Historic Register in violation of this section, no building or construction
related (including grading) permits or permits to use the PLVp.:..ty as a parking
area or other commercial venture shall be issued for a period of up to seven years,
at the City Council's discretion, based on the significance of the resource from.the .
date of demolition, except to replicate the lost resource. The failure to adequately
maintain a designated historic building or structure can also be considered to
constitute the unauthorized demolition of a building or structure on the Temecula
Local Historic Register.
For the purpose of this section, the demolition shall be presumed to have occurred
on the date the city has actual knowledge of the demolition. The owner shall have
the burden of providing an earlier date, if entitlement to an earlier date is claimed.
The owner shall have the affirmative obligations to plant and maintain turf grass,
to provide a temporary irrigation system to maintain such landscaping, and te
prevent the accumulation of debris and waste on the property during the interim
period."

1. Make the following changes to the Sign Standards in Section III.
"G. SIGN REGULATIONS
The intent of these regulations is to establish specific standards for all exterior signage
that will ensure continuity, consistency, and hannony with the architectural quality of
the Old Town environment as it may have appeared in the early 1900's.
1. Applicability
These regulations shall apply to all signage within the Tourist Retail Core and
Tourist Serving Residential areas of the Specific Plan. Signage within the
Highway Tourist Commercial District, Community Commercial, Medium Density
Residential District, and High Density Residential Land Use Districts shall
comply with the sign requirements contained in the Development Code and the
Signage Design Guidelines contained in Section IV.J of the Specific Plan.
2. Permit Required
Unless specifically stated in these regulations, a sign permit is required prior to
placing, erecting, moving, reconstructing, altering, or displaying any sign within
the Specific Plan.
3. Prohibitions
No person shall erect, re-erect, construct, enlarge, alter, move, improve, remove,
convert, or equip any sign or sign structure or cause or permit the same to be done
contrary to, or in violation of, the provisions of these sign regulations. All signs
not expressly permitted by this Section are prohibited. No application for sign
permit or other application for a prohibited sign shall be accepted, acted upon, or
approved.
4. Prohibited Signs in Old Town
o Freestanding signs on lots with less than 150' of road frontage (except/or
mini monument signs)
o Roof mounted signs
o Animated signs, including time and temperature displays
o Rotating, moving, emitting, or flashing signs
o Balloon signs

6. Sign Standards
a. Allowable Sign Area. Unless specifically exempted for this
requirement, the total amount of signage for each business shall be
limited to the following.
i. For business establishments having q. single frontage onto a
public street, or buildings with one building entrance, are
permitted a maximum total square footage equal to 1.5 square
feet of sign per linear frontage foot of business establishment.
Each business may use any combination of the following signs
to arrive at the total allowable square footage. However, each
sign shall not exceed the maximum square footage described in
this Section,
ii. For business establishments having frontage onto two public
street are permitted a maximum total square footage equal to
1.5 square feet of sign per linear frontage foot of business
establishment along the primary street and 0.5 square feet of
sign area per linear frontage foot of business establishment
along the secondary street.. Each business may use any
combination of the following signs to arrive at the total
allowable square footage. However, each sign shall not exceed
the maximum square footage described in this Section.

b. Buildilll! Surface Silffis. Except as specified below, all building
surface signage shall be counted toward the maximum allowable
sign area.
i. Wall Mounted Silffis. Maximum of one square foot per linear
frontage foot of business establishment. To be located no higher
than the lowest of the following points:
. 25 feet above grade;
. Bottom of the sill line of the second floor windows; or
. . Cornice line of the building.
ii. Hamnnf! Sims,. As an alternative to the standard wall sign, an
under canopy hanging sign may be used. Hanging signs must
be parallel to the street and, in addition hanging signs may not
exceed 75% of the width of the business frontage or be more
than 12 inches in height. If located over a walkway, the
vertical clearance between the bottom of the sign and walking
grade shall be a minimum of 7 feet.
iii. Rear Fadml Sillns. If a building has parking or pedestrian
access at the rear, each business is permitted a maximum of
one sign, not to exceed 3 square feet. The rear facing sign can
either be located adjacent to the entry point, or on the exterior
rear facing wall of the business.
iv. Interior Facim! Sil'ns. Where a building has a courtyard or
interior plaza that can not' be viewed from the public right of
way, each business shall be permitted a maximum of one sign,
not to exceed 5 percent of the total interior courtyard wall area
of the business. Interior facing signage shall not be counted
toward the overall total sign area permitted for the business or
building.
v. Sunefl!raohics. The purpose of allowing wall supergraphics is to
allow the advertising or depiction of products that may have been
available in an 1890's marketplace. A supergraphic is a mosaic,
mural, painting, graphic art, or combination thereof which is
professionally applied to a building that does not contain any
brand name, product name, letters of the alphabet spelling or
abbreviating the name of any product, company, profession, or
business, or any logo, trademark, trade name, or other
commercial message. Maximum size shall not exceed 60 percent
of wall surface. Supergraphics shall not be counted toward the
overall total sign area permitted for the business or building.

c. Other Buildinl! Silms. All window, awning and projecting signs shall
be counted toward the maximum allowable sign area.
i. Permanent Window Sil!ns. On ground level: coverage shall not
exceed 20 percent of the total window and door area visible
from the exterior of the building; on second leve: coverage
shall not exceed 30 percent per window. (No window signs are
permitted above secondfloor).

ii. Mini-Monument Sillns. A maximum of one double face mini-
monument sign is permitted if the street frontage is less than
150 feet, if th"e building existed prior to 1994, and if the
building is set back more that ten feet from the street. The
maximum sign area shall not exceed 6 square feet. Sign may
only be indirectly illuminated, internal illumination is
prohibited. The height of the sign shall not exceed 4 feet. If a
sign is placed on a creative, time appropriate architectural
element such as a covered wagon, wagon wheel, railroad cart,
etc, the height may be increased consistent with period element
at the sole discretion of the Director of Planning. If a building
has more than one tenant or building per lot, there shall still
only be one mini-monument sign allowed.
e. Temoorarv Siens. Temporary signs shall not be counted toward the
overall total sign area pennitted for the business or building. The
types of temporary signs are as follows.
i. Jemoorarv Banners. Temporary grand opening and special
event signs are allowed for each business establishment on the
exterior wall. Signs shall not be attached to any other
freestanding element (porch balustrade, garden wall, tree,
monument sign, vehicle, etc.). Signs shall be constructed of
cloth, canvas, or other durable material. Plastic or vinyl banner
signs are not pennitted. The use of neon colored/day glow
banner signs is are also prohibited. All temporary signs, except
for A-Frame/Sandwich Boards, shall abide by the provisions of
the Ordinance Regulating Temporary Signs, as amended.
ii. A-Frame/Sandwich Board Silrn. One A-frame or sandwich
board sign allowed per properly on Friday, Saturday, Sunday,
and designated Monday holidays. The size shall not exceed 3.5
feet high and 2 feet wide. A-frame signs shall not block the
sidewalk: and shall not be illuminated. No permit is required for
A-frame and sandwich board signs which comply with . these
provisions.
f. Accessorv Siens. Accessory signs shall not be counted toward the
overall total sign area pennitted for the business or building. The
types of accessory signs are as follows.
i. Buildinll Name Silln. The purpose of allowing building name
signs is to allow for the identification of buildings. The
maximum size shall not exceed 10 percent of the wall surface.
In the event that the building name advertises one or more

Dear Property Owner:
The City of Temecula will be considering a proposal to expand the protection for certain historic
structures outside of the Old Town area in the next few months. At present, only designated
historic structures within the Old Town Temecula area receive specific protections. The
proposal would require that any changes to a designated historic structure be reviewed by the
Old Town Local Review Board and approved by the City of Temecula prior to any changes
being made. The proposal would also make the property owner responsible for maintaining the
historic structure to prevent any further deterioration. The proposal would expand these

Temecula sites are:
. Vail Ranch Headquarters complex located at 32095 Highway 79 South;

. Gonzalez Adobe located at 27645 Jefferson Avenue.
The purpose of this letter is to notify you that we anticipate that the Old Town Local Review
Board will discuss this matter on Tuesday, March 13, 2006 at 9:00 a.m. in the Main Conference
Room located at 43200 Business Park Drive in Temecula. Following the Old Town Local
Review Board's review, we also anticipate this proposal will be presented to the PI<lnning
Commission and then the City Council for consideration.
We have enclosed a copy of the proposed changes to the current historic preservation
provisions located in Chapter V of the Old Town Specific Plan. This material shows the existing

A. PURPOSE
Protecting the cultural heritage and historical architectural resources found in Old Town
and elsewhere in Temecula is part of the overall goal for the revitalization of Old.
Town and the protection of the community's heritage. The Old Town Specific Plan
also gives owners of eligible N510ric properties relief from the contemporary municipal
codes, ordinances, taxes, and laws levied on newer contemporary structures. Historic
structures on the Temeculll Local Historic Register that are located outside of Old
Town Temecula are also eligible to receive relief from contemporary municipal
codes, ordinances, taxes, and laws levied on newer contemporary structures.
B. ESTABLISHMENT OF THE DISTRICT
The boundary of the Old Town Temecula Local Historic Preservation District shall be
coterminous with the boundary of the Old Town Specific Plan. In addition, the
Temecula Local Historic Preservation District also includes ihe following historic
structures outside of Old Town SpecifIC Plan:
1. Vail Ranch Headquarters complex located at 32095 Highway 79 South
2. Vail Ranch House located at 31658 Via San Carlos
3. Wolf Tomb located at 45334 Maguey Court

1. Within the boundaries of the Old TDWB Temecula Local Historic Preservation
District no person shall demolish, remove, relocate, or cause to be relocated,
alter, or cause to be altered, construct, or cause to be constructed or modify any

the buildings exterior are not required to obtain a Finding CeFtifieate of Historic
Appropriateness.
~5. Nothing in this section shall be construed so as to exempt any person from
complying with any other provision oflaw.
D. OLD TOWN LOCAL REVIEW BOARD (OTLRB)
1. The Old TDWB Temecula Local Historic Preservation District shall have an
advisory review board known as the Old Town Local Review Board to provide
input into all major projects within the Old Town Specific Plan and to review any
proposed modifICations to any historic structure.' The Director of Planning may
also provide the Old Town "Local Review Board with information on major
projects that are either: adjacent to Old Town that may have the potential to
affect the Old Town area or that are adjacent to or have the potential to affect
any historic structure or site. .
2. The Old Town Local Review Board shall be composed of five members and one
alternate (who shall serve in the absence of any member). Board members shall
be. appointed by the City Council for terms of 3 years. The member terms shall be
staggered so that all the members of the Old Town Local Review Board are not
appointed at the same' time. All members shall exhibit an interest in and

knowledge of the history and architecture of the Old TewB Temecula Local
Historic Preservation District. At least one member shall be knowledgeable in
architectural and construction techniques. Members shall serve without pay.
3. The Old Town Local Review Board shall hold regular public meetings and
establish such rules as may be al'l"Vl'.:ate or necessary for the orderly conduct of
its business. Three members shall constitute a quorum. At its first meeting of the
year, the Board members shall elect a Chairman and Vice Chairman (who will
officiate the meetings when the Chairman is absent), who shall serve for terms of
one year.
4. The Old Town Local Review Board shall have the following powers and duties in
addition to those otherwise provided in this ordinance:
a. Provide for pre-application conferences with individuals interested in
constructing or altering property within the Old T9WB Temecula
Local Historic Preservation District. The purpose of these conferences
shall be to familiarize the applicant with the historic significance and
related architectural themes of the district.
b. For historic structures within Old Town Temecula, utilize the
adopted Old Town Specific Plan Design Guidelines in the review of
applications as part of process to make! findings of consistency and
"J-'P'\'l'.;ateness with the Specific Plan. Use the Design Guidelines as
a basis for approving or denying applications for a Finding
Certifiellte of Historic Appropriateness.
For historic structures outside of Old Town Temecula, utilize the
best available information for the architectural style of the historic
structure to maintain the integrity of existing historic architecture as
well as preserve its local historic context.
c. Explore means for the protection, retention, and use of any significant
structures, natural features, sites, and areas in the district including but
not limited to "l'l"Vl'.;ate legislation and fmancing by independent
funding organizations, or other private, local, state, or federal
assistance.
d. Serve as an advisory resource to all agencies of the City in matters
pertaining to the Temecula Local Historic District, and to encourage
efforts by, and cooperation with individuals, private organizations, and
other governmental agencies concerned with preservation of the
district's architectural, environmental, and cultural heritage.
e. Render advice and guidance, upon request of the property owner or
occupant regarding construction, restoration, alteration, decoration,
landscaping, or maintenance of any structure, natural feature, site. or
area within the district.

f. Encourage public understanding and appreciation of the unique
architectural, environmental, and cultural heritage of the district

3. The following historic structures in Old Town Temecula have been moved from
their original locations. Saint Catherine's Church building (Historic Building
"A") was relocated to Sam Hicks Monument Park in 1992. The Bill Freideman
House (Historic Building "0") was relocated on the same site in 2003 as part of
housing project sponsored by the City Redevelopment Agency.

F. CERTlFIC..\TE FINDING OF HISTORIC APPROPRIATENESS
1. No existing designated historic building or structure may be altered or
demolished, and no new building or structure constructed without a the pPieF
appFBVaI Bf Finding a CeJ'tifieate of Historic Appropriateness pursuant to the
provisions of this Section prior to the alteration or demolition. The Finding
shall be incorporated into the review and approval process for the requested
change.
2. Certifieates A Finding of Historic A......<v...<:ateness within Old Town Temecula
may be issued either by the Director of Planning or the Planning Commission or
City Council as part of the approval process for any development within the Old
Town Specific Plan. The approval authority for a deteP ":.,.,,,iBB Bf whB
appl'6\'8s tile Ceriifieates Finding of Historical A......<v...,:ateness shall be based
upon the ,"......<v/al authority established by the Development Code for the
accompanying application. No development application for Level Two projects
in Old Town, as described below, may be approved without a recommendation
from the Old Town Local Review Board.
3. Certifieates A Finding of Historic Appropriateness for structures located
outside of the Old Town SpecifIC Plan may be approved by the Director of
Planning for Level One projects and by the Planning Commission for Level
Two projects. The Old Town Local Review Board shall review and provide
comments on all requests to alter any historic structure.
4. For the purposes of implementing the provisions of the Old Town Specific Plan
and the requirements of the Temecula Local Historic Preservation District,
there are two levels of Old Town development projects. The first category is the
ministerial or minor projects, referred to as Level One projects. The second
category is for non-ministerial and major projects, also called Level Two projects.
a. Level One Proiects do not require the review and recommendation of
the Old Town Local Review Board. Level One projects may be
approved by administrative (staff only) review following the Director
of Planning's determination to grant a Finding Certifieate of
Historical App,vp,;ateness. Typical examples include the following:
. Interior ehaBges BF alterations to historic structures;
. Re-landscaping around existing structure';
. Re-roofing of an existing building;
. Additions and remodels to non-historic single family residences;
. Exterior architectural modifications to' an existing commercial,
office, or residential building effecting less than 25% of the front
or street side exterior facade;
. The demolition to non-historic buildings and structures;
. New individual signs up to 12 square feet in size; and
. Changes in the copy of previously approved signs.
The Director of Planning, at his/her tlteiP-sole discretion, may forward
Level One projects to the Old Town Local Review Board when unique

circumstances, or the sensitivity of adjacent historic structures or land'
uses indicate the potential for an adverse aesthetic impact.
b. Level Two Proiects have the potential for significant aesthetic impacts.
Level Two Projects shall always require review by the Old Town
Local Review Board prior to action by the approviBg authority.
Typical examples of Level Two projects include, but are not limited
to, the following: '
. Multi-family residential projects;
. New commercial and office projects;
. Exterior architectural modifications to an existing commercial,
office, or residential building when 25% or more of the front or
street side exterior facade is affected;
. The alteration to a designated historic structure;
. The demolition of, or substantial alteration to, a designated
historic structure (requires Planning Commission approval);
. New individual signs over 12 square feet;
. Mini-monument signs located on architectural features that
exceed the standard height requirement of four feet; and,
. The removal of a specimen oak tree with a 10 inches or greater
trunk diameter.
5. All applications shall be filed 8B the f8FIBS BBd in a manner determined by the
Director of Planning. Requests for a Finding of Historic Appropriateness
AppIi,,/;.::o,t shall not be accepted unless they are accompanied by the
aPl"vp,;ate filing fee and such information and drawings as may be required by
the Director of Planning. All applications for Certificates a Finding of Historic
Al'p,vp,;ateness shall be signed by either the owner of the property or a person
authorized by the owner.
All drawings shall be signed by the architect responsible for the design and must
be in sufficient detail to show the proposed design for the site. This includes the
architectural design and elevations (including signs), proposed materials, textures
and colors (including material samples), and the site layout (including all
improvements affecting appearances, such as walls, walks, terraces, plantings,
accessory buildings, signs, lights, and other similar elements).
6. Following the receipt of a complete application, the Director of Planning shall
schedule a meeting of the Old Town Local Review Board within 60 days and
provide the Board with a staff report, including a copy of the site plan and
elevations. The Board shall review the application material and make a
recommendation to approve or deny, with or without conditions, any requests for
a Certifieates Finding of Historic Al'l',vl'.:ateness to the approval authority
designated by the Development Code.
7. In considering requests ':':.'"..; lB5-for Certifieates a Finding of Historic
Apl'.vp.:ateness, the Old Town Local Review Board shall make the following
findings:

a. That the proposed structure is in conformance with the General Plan
for Temecula and with all .applicable requirements of state law and
other ordinances of the city and is designed for the protection of the
public health, safety, and general welfare.
b. That the proposed structure is in confoimance with the requirements of
the Old Town Sp~cific Plan, including the goals, objectives and
policies, and architectural guidelines and standards.
c. In the event of the proposed demolition of a designated historic
building or structure, the Board shall also be required to fmd that
applicant has submitted substantial evidence that the structure is
imminently dangerous or unsafe and that the structure can not be
effectively repaired or retrofitted.
8. The expiration date for a CeFtifieatea Finding of Historic App.vp.;ateness shall
be the same as expiration date for the accompanying planning application, as may
be extended pursuant to the provisions of the Development Code. If the
Development Code does not specify an expiration date, the project for which the
CeFtifieatea Finding of Historic Appropriateness was approved shall commence
construction within three years of the date of approval or the CeFtifieateS Finding
of Historic App.vp.;ateness shall become null and void. No extensions of time
will be allowed for these projects.
G. MAINTENANCE AND CARE
1. The owner, occupant, or other person in actual charge of an building or structure
on Temecula Local Historic Register shall keep in good repair all of the exterior
portions of such improvement, building, or structure, all of the interior portions
thereof when subject to control as specified in the designation statement, and all
interior portions thereof whose maintenance is necessary to prevent deterioration
and decay of any exterior architectural feature.
2. Nothing in the requirements of section shall be construed to prevent the ordinary
maintenance or repair of any exterior architectural feature in or on any designated
Temecula Local Historic Register building of structure that does not involve a
change in design, material, or external appearance thereof.

H. ADDITIONAL VIOLATION PROVISIONS FOR HISTORIC STRUCTURES
1. In addition to the general violation provisions in Section III.H.7 of ,the Specific
Plan, any person who demolishes, alters or removes a building or structure on the
Temecula Local Historic Register, that person and the owner shall be required to
restore the building, site, or structure to its original condition and setting prior to
the violation within ninety days. Any a<;tion to enforce this provision may be
brought by the city or any other interested party. This civil remedy shall be in
addition to, any criminal prosecution and penalty and any other remedy provided
bylaw
2. If any person demolishes or removes lIB building or structure on the Temecula
Local Historic Register in violation of this section, no building or construction
related (including grading) pennits or pennits to use the !-'.v!-'....;j as a parking
area or other commercial venture shall be issued for a period of up to seven years,
at the City Council's discretion, based on the significance of the resource from the
date of demolition, except to replicate the lost resource. The failure to adequately
maintain a designated historic building or structure can also be considered to
constitute the unauthorized demolition of a building or structure on the Temecula
Local Historic Register.
For the purpose ()fthis section, the demolition shall be presumed to have occurred
on the date the city has actual knowledge of the demolition. The owner shall have
the burden of providing an earlier date, if entitlement to an earlier date is claimed.
The owner shall have the affinnative obligations to plant and maintain turf grass,
to provide a temporary irrigation system to maintain such landscaping, and te
prevent the accumulation of debris and waste on the property during the interim
period. "

Universal Waste Regulations

RECOMMENDATION: That the Community Services Commission receive and file this report
regarding the Universal Waste.
BACKGROUND: In 2001, the Department of Toxic Substances Control adopted emergency
regulations that banned Universal Waste from landfills within the State of California. While this ban
took effect immediately for commercial waste the regulations allowed an exemption for household
waste until February 8, 2006.
Examples of Universal Waste are:
. Common household batteries
. Fluorescent tubes and bulbs
. Electronic devices such as televisions, monitors, radios, microwaves
. Mercury gauges, thermometers and novelties
. Non-empty aerosol cans.
Through the Riverside County Household Hazardous Waste Collection Program, residents can
dispose of most of their Universal Waste during these events. In response to these new regulations
Temecula Community Services District, has begun a household battery collection program.
Collection boxes have been placed at City Hall, Mary Phillips Senior Center, Temecula Community
Center (TCC), the Community Recreation Center (CRC) and the County Library.

Construction of the Patricia H. Birdsall Sports Park (Wolf Creek Sports Complex) continues. Installation
of the field lighting, installation of artificial turf fields and parking lot are complete. Construction of the
buildings and irrigation systems continue.
Construction of the Temecula Public Library project is currently underway. Construction of the retainer
walls is complete and the structural steel is nearing completion. Staff continues to meet regularly to
discuss furniture selections, information systems needs, etc.
Construction ofthe Boys and Girls Club project at Kent Hintergardt Park is currently underway. Standard
Pacific has started construction of the parking lot improvements.
The Community Services Department released an-RFQ to landscape architect firms for Redhawk Park
Improvements for the four Redhawk park sites acquired on June 30,2005 with the annexation of Redhawk
into the City of T emecula. The City Council approved a contract with RJM Design to being designing the
improvements to the park sites. These improvements include picnic tables, picnic shelters, park benches,
sidewalks, tot lots, etc.
The Cultural Arts Division is busy preparing for the winter-spring sessions of classes and activities as
outlined in the Guide to Leisure Activities. In addition, the Cultural Arts Division is responsible for the day-
to-day operations at the Old Town Temecula Community Theater, the History Museum and the
Imagination Workshop, Temecula Children's Museum.
The Development Services Division continues to participate in the development review for projects within
the City including Wolf Creek, Roripaugh and Harveston, as well as overseeing the development of parks
and recreation facilities, and the contract for refuse and recycling, cable television services and
assessment administration.
The TCSD Maintenance Division continues to oversee the maintenance of all City parks and facilities, and
assist in all aspects of Citywide special events,

The Recreation Division staff is currently programming for the winterlspring classes and activities and
special events including the annual Volunteer Recognition event, the Spring Egg Hunt, the Summer Film
and Concert series, the 4th of July parade and fireworks extravaganza and many other special events.
