A RESOLUTION OF THE CITY COUNC]IL OF THE CITY OF
'i MECULA APPROVING AND AUTHORIZING AND DIRECTING
THE EXECUTION AND DELIVERY OF AN AMIEND@T NO. I
TO JOINT COMMUNITY FACI]LITIES AGREEMENT
WHEREAS, on April 23, 1996, the City of Temecula (the "City") and the Old
Town/Westside Community Facilities District Financing Authority (the "Authority") entered into
a Joint Community Facilities Agreement (the "Agreement') with respect to certain public
improvements in the Old Town area of the City and the Western Bypass, some of which public
improvements will be owned and/or operated, when completed, by the City (the "Public
Improvements"); and
WHEREAS, in order to assure that the Public Improvements will be completed as
expected, the City desires to enter into an amendment no. 1 to the Agreement (the "Amendment")
to provide for a guarantee of completion with respect to the Public Improvements and certain other
matters; and
WHEREAS, a form of the Amendment has been filed with the City Clerk and the City
Council, with the assistance of City staff, has reviewed the Amendment and the City Council now
desires to approve the Amendment and direct its execution and delivery.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Temecula
as follows:
1. Approval of Amendment. The City Council hereby approves the Amendment, in the
form on file with the City Clerk, and hereby authorizes and directs the City Manager to execute
and deliver the Amendment in such form together with any changes therein deemed admissible
by the City Manager upon consultation with the City Attorney and the City Director of Public
Works, the approval of such changes to be conclusively evidenced by the execution and delivery
by the City of the Amendment.
2. Official Actions. The City Manager, Finance Director, Director of Public Works, City
Clerk and all other officers of the City are hereby authorized and directed to take all actions and
do all things necessary or desirable hereunder the respect to the Amendment, including but not
limited to the execution and delivery of any and all certificates, documents and other instruments
which they, or any of them, deem necessary or desirable and not inconsistent with the purposes
of this Resolution.

at a regular meeting held on the 1 lth day of June, 1996.
