HomeMy WebLinkAbout121406 DH Minutes MINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA DIRECTOR'S HEARING DECEMBER 14, 2006 A regular meeting of the City of Temecula Director's Hearing was called to order on Thursday, December 14, 2006 at 1 :40 p.m. in the Main Conference Room, located at 43200 Business Park Drive Temecula, California. Senior Planner Emery Papp presiding. Also present were Associate Planner Christine Damko, Projects Engineer Annie Bostre-Le, Assistant Planner Katie Le Comte and Minute Clerk Cynthia Lariccia. Senior Planner Papp convened the meeting at 1 :40 p.m. and asked if anyone present would like to speak on items not on the agenda. Hearing no one, the first item was introduced. Item No.1: Planninq Apolication PA06-0275. a Tentave Parcel Map to combine six lots totalinq 0.48 acres into a sin~le lot for the develooment of the Dalton /I Buildina, located on the north side of 51h Street west of Mercedes Street. Associate Planner Damko presented an overview of the project and staff recommendations. The Subdivision Ordinance states that a parcel map can be completed with a maximum of four parcels. This project proposes to merge six lots, which requires a Tentative Parcel Map. The map is consistent with the Conditions of Approval for the Dalton /I Building, which is currently under construction that required the merger of the six lots. The proposed project is categorically exempt from further environmental review per CEQA Section 15315, Class 15, Minor Land Divisions. Senior Planner Papp opened the Public Hearing at 1 :42 p.m. Applicant Hector Correa, 28465 Old Town Front Street, Temecula, thanked the Planner and concurred with the Conditions of Approval. Senior Planner Papp closed the Public Hearing on this item and approved Planning Application No. PA06-0275 subject to the Conditions of Approval. Item No.2: Plannina Apolication PA06-0222. a Tentave Parcel Mao to subdivide aODroximatelv 4.2 acres into three lots with a minimum lot size of 1.0 net acre. located on the north side of Santiaao Road at John Wamer Road. Assistant Planner Le Comte presented an overview of the project and staff recommendations. Proposed Tentative Parcel Map would subdivide 4.2 acres into three lots with a minimum lot size of 1.0 net acre. The proposed project meets the standard found within the Subdivision Ordinance and the Development Code. The project is zoned Low Density Residential which requires all lots within this zoning designation have a minimum lot size of 1.0 net acre. The subject parcel also falls within the Chaparral Area which requires lots adjacent to Santiago Road shall have a minimum lot size of 1.75 acre. Parcel Three meets this requirement. The project proposes a 24-foot wide point of access easement from Santiago Road. Parcels One and Two will be granted access to this Reciprocal Access Agreement for ingress and egress for their property. The Fire Prevention Bureau has indicated that the access is acceptable and meets all applicable standards. The proposed project is categorically exempt from further environmental review per CEQA Section 15315, Class 15, Minor Land Divisions. Senior Planner Papp asked if the applicant is proposing to do any grading at the site. Assistant Planner Le Comte stated that a Grading Plan is currently under review by Public Works. R:\DIRHEARIMINUTES\2006\ 12-14-06.doc Senior Planner Papp asked Engineer Bostre-Le if any slopes have been created in excess of ten feet in height. Engineer stated that there is a Condition included in the Conditions of Approval to fix those slopes that are greater than 2:1. Senior Planner Papp opened the Public Hearing Applicant Yvette Anthony, 43135 Avenida De San pasqual, Temecula, thanked the Planner for her assistance. She stated that she has graded the rear portion of the property, intends to grade the front portion, and do street improvements from Ormsby thru the frontage of her property. Steve Lis, 30000 Santiago Road, Temecula, stated his concern with the land subdivided into smaller parcels at the expense of the other neighbors. He felt the area was designed to keep it wide and open and not for more homes and a higher volume of traffic. Gary Weidman, 30680 Santiago Road, Temecula, stated he wants to see the project complete but his concern was with the grading that needs to be fixed. He also asked about the bond requirement for the improvements. Engineer Bostre-Le stated that the map will not move forward unless the bond is in place. Mr. Weidman suggested that an additional condition be added to the bond to protect his interests. His concern was if the hill comes down he could lose % an acre of his property. He also stated that he was at the hearing for the Delgado property split and that there is large hole in Santiago Road that accumulated from his property runoff. Ms. Anthony stated that the area has been zoned for one-acre minimum parcel for longer than Mr. Lis lived in the area. She also stated that Santiago Road would continue to be rural. She also stated that her street improvements would enhance the area. She discussed the back slopes. She stated that her slopes have been certified by a Soils Engineer to be stable. She made reference to Condition 61 regarding the grading. Engineer Bostre-Le stated that the Condition is consistent with the City's Grading Standards and that the slopes in question are not in conformance. Senior Planner Papp recommended that Condition 61a be moved from "Prior to Issuance of Building Permits" to the section under "General Requirements." He stated that in the City's General Plan there is a Community Design Element Policy that states created slopes in the Chaparral area shall not exceed 2:1 and without resolving the issue, he cannot approve the project. Mr. Weidman restated his concern that his property be protected by any future building on this site. Senior Planner Papp slated that any subsequent owners who build on this site will have to abide by all the Conditions of Approval in the underlying map. Ms. Anthony questioned Condition #59 regarding Parcel Map approval and recordation with reference to building her house on Parcel 2 before the summer. Engineer Bostre-Le stated that she could break ground as there is one legal lot. Ms. Anthony questioned Condition 23(b) regarding design of street improvements. Engineer Bostre-Le stated that when her street improvement plans are submitted, the Traffic Department will advise her on how far out to the east they would like her to do her design. Senior Planner Papp proceeded to address the issues brought up by the public. The zoning allows for one-acre parcels. In 2005, the City of Temecula adopted a Comprehensive Update to the General Plan which included a new EIR that evaluated all the traffic impacts in the City. These impacts were analyzed based on the zoning of the properties not the actual use of the land. Santiago Road was changed to a rural standard with the knowledge that those parcels could be subdivided. Public Hearings were held on these matters and residents were given the opportunity to express their views. Owners of parcels can subdivide in this area. Senior Planner Papp addressed the grading. The applicant expressed every intent to correct the problem and was advised that the map will not be recorded until the grading is in compliance with the General Plan. The applicant has also agreed to move Condition #61 (a) to the General Requirement section of the Conditions of Approval. This will assure the work will be done prior to any issuance of building permits. Senior Planner Papp closed the Public Hearing and approved Planning Application PA06-0222.
