HomeMy WebLinkAbout083007 DH Minutes MINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA DIRECTOR'S HEARING AUGUST 30, 2007 A regular meeting of the City of Temecula Director's Hearing was called to order on Thursday, August 9, 2007 at 1 :30 p.m. in the Main Conference Room, located at 43200 Business Park Drive Temecula, California. Principal Planner Patrick Richardson presiding. Also present were, Senior Planner Stuart Fisk, Assistant Planner Katie Le Comte, Associate Planner Matt Peters, and Minute Clerk Cynthia Lariccia. Item No.1: Planninq Application PA07-0187, a Tentative Parcel Map for condominium purposes with a final map waiver. located at the southeast corner of Madison Avenue and Buekinq Drive Principal Planner Richardson convened the meeting at 1 :30 p.m. Planner Le Comte presented an overview of the project and staff recommendations. The proposed Tentative Parcel Map would create five air-space condominium units on a 1.54 gross acre lot. The units would be established within an existing building that was approved by the Planning Commission on August 17, 2005. The proposed project would not create new lots or change the existing lot size. Project is categorical exempt from further environmental review per CEQA Section 15301, Class 1 Existing Facilities. The project is consistent with all applicable City ordinances, standards, guidelines, and policies including the Sub-division Map Act. Principal Planner asked if the applicant was present. Hector Correa, 28465 Old Town Front Street, Temecula stated he had reviewed the Conditions of Approval and is in acceptance of them. Principal Planner cited that there were no speakers in support or opposition of the project, and approved PA07-0187 subject to the Conditions of Approval. Item No.2: Planninq Application PA07-0177, an Extension of Time to operate a pre-school and construct an administrative buildinq and three modular classroom buildinqs totalinq 6,048 square feet on 2.39 acres. located at 39960 Calle Girasol Planner Peters presented an overview of the project and staff recommendations. This application is for a one-year Extension of Time for a previously approved Development Plan and Conditional Use Permit for Cassatt Academy to operate a pre-school. The Planning Commission original denied this application on May 4, 2005; however, on appeal, it was approved by City Council in June of 2005. Expiration of this approval was June 14,2007. The applicant filed an Extension of Time prior to the expiration date of the original approval. The extension was necessary due to the amount of time needed to obtain permits and other unforeseen complications with the construction process. There are no changes to the originally approved project. Principal Planner asked if the applicant was present. Faith Evarts, 25061 Calle Viejo, Murrieta stated she had reviewed the Conditions of Approval. She also commented on their inexperience in the process. Dennis Fitz, 39910 Jeffrey Heights Road, Temecula stated that in 2005, he and his neighbors presented a petition with opposition to this pre-school. He felt that the pre-school did not fit the rural preservation designation the City Council had given the neighborhood. The lot is covered with weeds and someone is living in a travel trailer on the property. He stated that he and his neighbors were against this Extension of Time and that the applicant and the applicant's banker were not honest with the City Council regarding financial resources when the project was approved on appeal. The applicant responded that she and her partners are working on investment packages for the project. The trailer was on the property for security purposes. Principal Planner advised the applicant that someone living on the property is not allowed. Applicant stated that she spoke with someone from the City who advised her that as long as they had a grading permit that security was allowed on the property. Principal Planner stated that if the applicant was not actively grading, no one should be staying on the property. The applicant needs to secure the property with another method. Planner Peters stated that he received a phone call from an adjacent property owner, Mike Connolly, with a request to read into the record the following comments: . Why would we allow when they are trying to sell the property? . Property is a mess, dumping dirt on property trailer with someone living in it . What is timing to construct? . Traffic counts being conducted but not when school was in session . Code Enforcement to go out regarding trailer Planner Peters also received an e-mail from Code Enforcement stating that they have created a case for an office to investigate. Applicant stated that she will remove the trailer. Principal Planner stated that under the Municipal Code when a Conditional Use Permit is granted and unless conditions have changed substantially, the City is limited in terms of what its ability to do in terms of not granting an extension. By filing the application and having it approved, an entitlement is established on the property. Principal Planner approved Planning Application No. PA07-0177 for an additional year. He asked the applicant on her intentions on the property. Applicant stated that she is deciding on whether to go through the investor route or to sell the property and become the tenant. He first asked to speak to Matt Peters, then he finally ended up reporting that someone was living in a trailer on that property. I created a case for an officer to investigate, but Mike requested a call back from you at 714-231-5304 today so he could comment on the extension of the Conditional Use Penmit. . Can he do that?
