RDA 91-02 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TEMECULA APPROVING AN OWNER PARTICIPATION AGREEMENT BETWEEN THE AGENCY AND COSTCO WHOLESALE CORPORATION THE REDEVELOPMENT AGENCY OF THE CITY OF TEMECULA DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Redevelopment Agency of the City of Temecula ("Agency") does hereby find, determine and declare that: A. The proposed Owner Participation Agreement would provide for Agency assistance in the redevelopment of the property located at the intersection of Winchester and Margarita in the City of Temecula as a major retail and wholesale warehouse sales facility. B. Completing the redevelopment on the site pursuant to the proposed agreement is in the vital and best interest of the City of Temecula and the health, safety and general welfare of its residents and is in accord with the public purposes and provisions of the redevelopment plan for the Temecula Redevelopment Project Area. C. The agreement pertains to and affects the ability of the Agency to finance its statutory obligations and for all parties to finance and carry out the purposes of this agreement and the goals of the plan and is intended to be a contract within the meaning of Government Code Section 53511. Section 2. An Initial Study of Environmental Impact and a Negative Declaration have been prepared for the project proposed in the agreement at the time the project was approved pursuant to Parcel Map No. 26852 and Plot Plan No. 224. Said review and approval of the project by the City of Temecula was completed on June 25, 1991. Additionally, the Redevelopment Agency of the County of Riverside and the Board of Supervisors of the County of Riverside, as the predecessors in interest to the Agency and City with respect to the Plan approved an environmental impact report for the Plan which addressed environmental issues in the Project Area and impacts related to areas immediately surrounding the project area and specifically the location of the proposed project. Since the adoption of the Negative Declaration on this specific project and the EIR for the Redevelopment Project, there has been (1) no new information of substantial importance to the project which has become available, (2) no subsequent changes in the proposed project have not been made since the Negative Declaration was approved and (3) substantial changes have not occurred with respect to the circumstances under which the project is undertaken which will require important revisions in the previous EIR and Negative Declaration due to the involvement of new significant environmental impacts not covered in a previous EIR or the Resos.RDA\91-02 1 Negative Declaration. Moreover, the project will (1) not have one or more significant effects not disclosed previously in the Negative Declaration or EIR, (2) significant effects previously examined in the Negative Declaration or EIR will not be substantially more severe than shown in the EIR, (3) mitigation measures or alternatives previously found not to be feasible continue to be infeasible and (4) there are no mitigation measures or alternatives which were not previously considered in the Negative Declaration or EIR which would substantially lessen one or more significant effects on the environment. Accordingly, pursuant to the provisions of 14 Cal. Code of Regulations Sections 15162 and 15163, neither a subsequent EIR nor a supplement to an EIR is required and pursuant to Section 15180, the EIR previously prepared for the redevelopment project and the Negative Declaration are sufficient for this project given the findings made herein. Section 3. The Redevelopment Agency of the City of Temecula hereby approves that certain agreement dated as of July 23, 1991 entitled "Owner Participation Agreement" by and between the Redevelopment Agency of the City of Temecula and Costco Wholesale Corporation" and authorizes the Chairperson of the Agency to execute said agreement in substantially the form attached hereto as Exhibit A. Section 4. The Secretary shall certify the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 23rd day of July, 1991.
