A RESOLUTION OF THE RF~EVELOPMENT AGENCY OF
TEMECULA ESTABLISHING BY-LAWS FOR THE OPERATION
OF THE AGENCY
WBrEREAS, the Redevelopment Agency of Temecula was activated pursuant to Ordinance
Nos. 91-08 and 91-14, effective April of 1991 and was created pursuant to the provisions of the
Community Redevelopment Law (Health and Safety Code Section 33000 et mq.); and,
WBEREAS, Health and Safety Code Section 33125 authorizes a redevelopment agency
to make by-laws to carry into effect the operations and maintenance of the agency.
NOW, THEREFORE, THE RE!~EVELOPMENT AGENCY OF TEMECULA DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the attached By-Laws of the Redevelopment Agency of Temecula are
hereby adopted.
Section 2. The Secretary of the Agency Shall certify the adoption of this Resolution.

OF THE REDEVELOPMENT AGENCY
OF
THE CITY OF TEMECULA
ARTICLE I
Section 100. Formation Df Redevelopment Aqency
The Redevelopment Agency of the City of Temecula was formed
pursuant to the provisions of the Community Redevelopment
Law ("CRL#) contained in Health and Safety Code Section
33000 et seq. by Ordinances Nos. 91-08 and 91-14.
Section 102. Redevelopment Aqency Members
Pursuant to Ordinance Nos. 91-08 and 91-14, the members of
the City Council shall be the members of the Redevelopment
Agency and shall hold terms as members of the Agency
concurrent with their terms as city councilmembers.
Section 104. Purpose of Redevelopment Agency
The Redevelopment Agency of the City of Temecula is
established principally for the preparation and
implementation of plans for the improvement, rehabilitation
and redevelopment of blighted areas in accordance with the
provisions of the CRL. The Redevelopment Agency shall meet
regularly and shall consider effective means to carry out
redevelopment plans for various redevelopment project
areas. The Redevelopment Agency shall strive to efficiently
receive and spend property tax revenues from the increase in
assessed value occurring as a result of redevelopment
activities.
ARTICLE II
Section 200. Designation of Officers
The officers of the Redevelopment Agency shall be the
chairperson, the vice chairperson, the executive director,
the secretary and the general counsel.
The chairperson and vice chairperson shall be elected each
year from among the members of the Redevelopment Agency.
The term of the offices of chairperson and vice chairperson
are for the calendar year or for the portion thereof
remaining after election to office.
The executive director, secretary and general counsel shall
be appointed to the positions by the Agency members subject
to the terms of office as determined by the Agency.
The Agency members may appoint such other officers
(permanent, acting or temporary) as may be appropriate. The
Agency members may fix ahd determine the qualifications and
duties of the officers of the Redevelopment Agency.
Section 202. Vacancies in Office
The offices designated above shall be vacated whenever any
of the following occur:
A. By death of an officer
B. By resignation of an officer
C. By termination of the officer by the Agency
Should either of the offices of chairperson, vice
chairperson, executive director, secretary or general
counsel become vacant, the Redevelopment Agency members at
the next special meeting shall elect a successor for the
unexpired term of that office. Where possible, the vacated
officeholder shall continue in office until successors are
elected and assume office.
Section 204. Duties of Officers
The chairperson shall preside at the Redevelopment Agency
meetings and perform such other duties as are appropriate.
The vice chairperson, in the absence or incapacity of the
chairperson, shall perform the duties of the chairperson.
Should the office of the chairperson become vacant, the vice
chairperson shall perform the duties of the chairperson
until the Redevelopment Agency members elect a new
chairperson.
The secretary shall keep and maintain records of the
Redevelopment Agency and the minutes of the Agency
meetings. The secretary shall give written notice of
Redevelopment Agency meetings whenever such notice is
required. The secretary shall also perform all other duties
incident to the office of secretary.

The general counsel for the Agency shall advise on legal
matters coming before the Agency and shall coordinate Agency
litigation.
The executive director shall be the chief administrative
officer for the Agency. The executive director's duties
include, without limitation, the implementation of
directives issued by the Agency, coordination of various
staff reports prepared in furtherance of Agency objectives,
and managing Redevelopment Agency employees, finances and
document production.
Section 206.
Compensation of Members and Reimbursement of
Expenses
By resolution of the City Council, the compensation for
Redevelopment Agency members shall be Thirty Dollars
($30.00), per member for each meeting of the Agency attended
by that member. No member shall receive compensation for
attending more than four meetings of the Agency during any
calendar month. The foregoing compensation is allowed
pursuant to Health and Safety Code Section 33114.5.
Redevelopment Agency members shall receive their actual and
necessary expenses, including travelling expenses incurred
in the discharge of their duties.
Section 208. Political Reform Act Compliance
The members of the Agency and officers employed by the
Agency shall comply with the disclosure and disqualification
provisions of the Political Reform Act (Government Code
Section 87100 et seq.).
ARTICLE III
Section 300. EmDlovees and Aqents
The Agency may select, appoint and employ such permanent and
temporary officers, agents, employees and consultants as it
requires and determine their qualifications, duties,
benefits and compensation subject only to the conditions
imposed by the City Council on the expenditure of the
budgetary funds appropriated to the Agency.

ARTICLE IV
Section 400. Meetings
Meetings of the Redevelopment Agency of the City of Temecula
shall be held twice a month on the second and fourth Tuesday
of every month; provided, however, that should such date be
a legal holiday, then that regular meeting shall be held on
the next business day w~ich is not a legal holiday.
A quorum of three (3) members is required to conduct a
meeting; any meeting failing to achieve a quorum shall be
adjourned. A majority vote of the quorum shall be necessary
to pass any resolution of the Agency.
The Agency shall be subject to and abide by the open meeting
provisions found in the Brown Act (Government Code Section
54950 et seq.), including those provisions governing the
holding of special meetings and closed session meetings.
The protocol for all meetings shall be conducted pursuant to
the same rules applicable to the City Council.
Section 402. Notice
All meetings shall be noticed to the general public by
publication in The Californian, a paper of general
circulation within the Redevelopment Agency's jurisdictional
area. Resolutions passed by the Agency shall similarly be
published.
ARTICLE V
Section 500. Amendment of By-Laws
These by-laws of the Redevelopment Agency of the City of
Temecula may be amended only by resolution of the Agency.
No amendment shall be adopted unless written notice of the
general nature thereof has been sent at least seven days in
advance to all members of the Redevelopment Agency.
