HomeMy WebLinkAbout032708 DH MinutesMINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA DIRECTOR'S HEARING MARCH 27, 2008 A regular meeting of the City of Temecula Director's Hearing was called to order on Thursday, March 27, 2008 at 1:30 p.m. in the Main Conference Room, located at 43200 Business Park Drive, Temecula, California. Planning Director Debbie Ubnoske presiding. Also present were Principal Planner Patrick Richardson, Senior Planner Stuart Fisk, Assistant Planner Katie Le Comte, and Minute Clerk Cynthia Lariccia. Item No. 1: Planning Application Numbers PA07-0123 and PA07-0124, a Development Plan to construct a 5,660 square foot commercial building and Conditional Use Permit to authorize aType-47 (on-sale general) ABC license allowing for the sale of beer wine and distilled spirits (Ruby Tuesday) located south of Overland Drive and West of Nicole Lane in the Creekside Centre shopping center Planning Director opened the public hearing at 1:30 p.m. Assistant Planner presented an overview of the project and staff recommendations. The 5,660 square foot restaurant is proposed to be constructed on the vacant pad located on the northernmost portion of the site within the Creekside Centre shopping center. Per the Development Code, restaurants selling beer, wine and distilled spirits require the approval of a Conditional Use Permit and shall not be located within 500 feet of any religious institutions, schools or public parks. Staff has consulted with the City's Geographic Information Systems Department and determined that the project meets this requirement. The surrounding land uses are all commercial and include other restaurants. Staff has worked closely with the applicant on the architecture of the building to ensure that the building will be complimentary to the existing buildings on site. Materials include three stucco colors, EI Dorado stone, black metal seamed hip roof, decorative lighting and an aluminum canopy feature. Parking for the project meets Development Code requirements for a shopping center. Staff received correspondence from the owner of Wahoo's Fish Taco expressing concern about construction traffic along Nicole Lane. Staff recommends adding a condition to the Conditions of Approval to contain all the construction traffic on site. The owner also had concern that this project would obstruct his signage and the view of the mountains from his patio Planning Director stated for the record that there are no guarantees that anyone maintains a view when they purchase property in the City and that there was a development proposed for this sight. The Planning Director concurred that a condition should be added to address the construction traffic. Planner Director asked if the applicant would state his name for the record and if he had reviewed the Conditions of Approval. Applicant Jeff Howie, 33671 Marigold, Murrieta, stated he had reviewed the Conditions of Approval and was in agreement with the content. Planner Director closed the public hearing and approved Planning Application No. PA07-0123 subject to the modified Conditions of Approval to include all construction traffic will be on site.
