APPLICANT NAME: Dennis Janda Incorporated
PROJECT Planning Application Number PA08-0103, the Second Extension of
SUMMARY: Time for a previously approved Tentative Parcel Map (No. 32158) to
subdivide a 1.97 acre parcel into two industrial lots totaling 0.98 and
0.99 acres, located at 27447 Bostic Court and generally located off
Winchester Road west of Jefferson Avenue and east of Via
Industria
CEQA: Categorically Exempt
Section 15315 Class 15 Minor Land Divisions
RECOMMENDATION: Staff has determined that the proposed Extension of Time, as
conditioned, is consistent with the City's General Plan, Development
Code, and all applicable ordinances, standards, guidelines, and
policies. Therefore, staff recommends that the Planning Director
approve the Extension of Time, Planning Application No. PA08-
0103, based upon staff's findings and attached Conditions of
Approval.
BACKGROUND SUMMARY
Staff has worked with the applicant to ensure that all concerns have been addressed, and the
applicant concurs with the recommended Conditions of Approval.
ANALYSIS
Planning Application No. PA08-0103, submitted by Dennis Janda Incorporated, is a request for
the second one-year Extension of Time for previously approved Parcel Map 32158 (Planning
Application No. PA04-0075). The Planning Director approved the first Extension of Time on
December 20, 2007 (Planning Application No. PA07-0138). The first Extension of Time was
approved with an expiration date of May 6, 2008. Pursuant to Section 16.09.200, the applicant
filed an Extension of Time application on May 01, 2008, which was prior to the expiration date.
No changes to the originally approved project are proposed as part of this application.
The applicant has requested the Extension of Time due to the property owner's inability to
return the signed Mylars back to Dennis Janda, Inc. for submittal to the City of Temecula.
LEGAL NOTICING REQUIREMENTS
Notice of the public hearing was published in the Californian on June 28, 2008 and mailed to the
property owners within the required 600-foot radius.

ENVIRONMENTAL DETERMINATION
In accordance with the California Environmental Quality Act, the proposed project has been
deemed to be categorically exempt from further environmental review. Section 15315, Class 15
Minor Land Divisions
FINDINGS
Extension of Time/Findings of Approval of Tentative Maps, Temecula Subdivision Ordinance
Section 16.09.140
The proposed subdivision and the design and improvements of the subdivision is consistent
with the Development Code, General Plan, any applicable Specific Plan and the City of
Temecula Municipal Code.
Staff finds that the Tentative Map No 32158, as previously approved and conditioned, is
consistent with the General Plan, the Subdivision Ordinance, the Development Code, and the
Municipal Code because the project meets design standards as required in the General Plan,
Subdivision Ordinance, Development Code and the Municipal Code
The Tentative Map does not propose to divide land which is subject to a contract entered into
pursuant to the California Land Conservation Act of 1965, or the land is subject to a Land
Conservation Act contract but the resulting parcels following division of the land will not be too
small to sustain their agricultural use.
The proposed land division is not land designated for conservation or agricultural use.
The site is physically suitable for the type and proposed density of the development proposed
by the Tentative Map.
The project consists of a Parcel Map that is consistent with the General Plan zoning designation
of the Industrial Park. The Tentative Parcel Map will not result in changes to the site plan or
building elevations approved for the site by the Planning Commission.
The design of the subdivision and the proposed improvements, with Conditions of Approval are
not likely to cause significant environmental damage or substantially and avoidably injure fish or
wildlife or their habitat.
No impacts beyond those already identified for the previously approved Tentative Map are
anticipated from the creation of the two parcels.
The design of the subdivision and the type of improvements are not likely to cause serious
public health problems.
The project has been reviewed by the Fire Prevention Department, Public Works Department
and the Building and Safety Department. As a result, the project has been conditioned to
address their concerns. Further, provisions are made in the General Plan and the Development
Code to ensure that the public health and welfare are safeguarded. The project is consistent
with these documents.

The design of the subdivision provides for future passive or natural heating or cooling
opportunities in the subdivision to the extent feasible.
The Tentative Parcel Map will allow the design of the subdivision to provide future passive or
natural heating or cooling opportunities.
The design of the subdivision and the type of improvements will not conflict with easements
acquired by the public at large for access through or use of property within the proposed
subdivision, or the design of the alternate easements which are substantially equivalent to those
previously acquired by the public will be provided.
All required rights -of -way and easements have been provided on the Tentative Map. The City
of Temecula has reviewed these easements and has found no potential conflicts.
The subdivision is consistent with the City's parkland dedication requirements (Quimby)
This is a map for a non-residential use and will not be subject to Quimby fees.

A RESOLUTION OF THE DIRECTOR OF PLANNING OF
THE CITY OF TEMECULA APPROVING PLANNING
APPLICATION NUMBER PA08-0103, A REQUEST FOR
THE SECOND ONE-YEAR EXTENSION OF TIME FOR A
PREVIOUSLY APPROVED TENTATIVE PARCEL MAP
(NO. 32158) TO SUBDIVIDE A 1.97 ACRE PARCEL INTO
TWO INDUSTRIAL LOTS TOTALING 0.98 AND 0.99
ACRES (APN 909-360-037)
Section 1. Procedural Findings. The Director of Planning of the City of
Temecula does hereby find, determine and declare that:
A. On May 1, 2008 Dennis Janda, Incorporated, filed Planning Application
No. PA08-0103 an Extension of Time in a manner in accord with the City of Temecula
General Plan and Development Code.
B. The Application was processed including, but not limited to a public notice,
in the time and manner prescribed by State and local law.
C. The Director of Planning, at a regular meeting, considered the Application
and environmental review on July 10, 2008, at a duly noticed public hearing as
prescribed by law, at which time the City staff and interested persons had an
opportunity to and did testify either in support or in opposition to this matter.
D. At the conclusion of the Director's Hearing and after due consideration of
the testimony, the Director of Planning approved Planning Application No. PA08-0103
subject to Conditions of Approval, after finding that the project proposed in Planning
Application No. PA08-0103, conformed to the City of Temecula's General Plan
Development Code (Subdivision, Development Agreement).
Section 2. Further Findings. The Director of Planning, in approving Planning
Application No. PA08-0103, hereby makes the following findings as required by Section
16.09.140 (Findings of Approval of Tentative Maps) of the Temecula Subdivision
Ordinance.
A. The proposed subdivision and the design and improvements of the
subdivision is consistent with the Development Code, General Plan, any applicable

Section 3. Environmental Findings. The Director of Planning hereby makes
the following environmental findings and determinations in connection with the approval
of the Extension of Time application:
A. In accordance with the California Environmental Quality Act, the proposed
project has been deemed to be categorically exempt from further environmental review
(Section 15315, Class 15 Minor Land Divisions).
The project consists of the division of property in an urbanized area zoned for
light industrial use into two parcels. The division is in conformance with the
General Plan and Zoning Ordinance. No variances or exceptions are required
and all services and access to the parcels to local standards are available. In
addition, the parcel has not been involved in a division of a larger parcel within
the previous two years and the parcel does not have a slope greater than 20
percent.
Section 4. Conditions. The Director of Planning of the City of Temecula
approves Planning Application No. PA08-0103, the Second Extension of Time for a
previously approved Tentative Parcel Map (No. 32158) to subdivide a 1.97 acre parcel
into two industrial lots totaling 0.98 and 0.99 acres, located at 27447 Bostic Court and
generally located off Winchester Road west of Jefferson Avenue and east of Via
Industria , subject to the Conditions of Approval set forth on Exhibit A, attached hereto,
and incorporated herein by this reference.

Within 48 Hours of the Approval of This Project
PL-1. The applicant/developer shall deliver to the Planning Department a cashier's check or
money order made payable to the County Clerk in the amount of Sixty -Four Dollars
($64.00) for the County administrative fee, to enable the City to file the Notice of
Exemption as provided under Public Resources Code Section 21152 and California
Code of Regulations Section 15062. If within said 48-hour period the applicant/
developer has not delivered to the Planning Department the check as required above,
the approval for the project granted shall be void by reason of failure of condition (Fish
and Game Code Section 711.4(c)).
PL-2. The applicant shall review and sign the Acceptance of Conditions of Approval document
that will be provided by the Planning Department staff and return the document with an
original signature to the Planning Department.
