I Minutes of July 24, 2008 MINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA PUBLIC/TRAFFIC SAFETY COMMISSION JULY 24, 2008 CALL TO ORDER The City of Temecula Public/Traffic Safety Commission convened in a regular meeting at 6:00 p.m. on Thursday, July 24, 2008, in the City Council Chambers of Temecula City Hall, 43200 Business Park Drive, Temecula, California. FLAG SALUTE Commissioner Youmans led the audience in the Flag salute ROLL CALL Present: Commissioners: Hagel, 'Curran, Youmans and Chairperson Arbogast Absent: Ramos PRESENTATION Senior Management Analyst Middlecamp, by way of DVD, highlighted the City's produced safety vignette for the cable channel, informing that the safety vignette airs three times a day on Channel 3 and is posted on the City's website; and noted that the safety vignette was professionally produced The Public Traffic Safety Commission thanked Ms. Middlecamp for her presentation. PUBLIC COMMENTS No comments at this time. COMMISSION REPORTS No reports at this time. COMMISSION CONSENT CALENDAR Minutes of June 26, 2008 RECOMMENDATION: 1.1 Approve the Minutes of June 26, 2008. R:\Minutes\PublicTrafficSafetyCommission072408 1 MOTION: Commissioner Hagel moved to approve the Consent Calendar. Commissioner Youmans seconded the motion and voice vote reflected approval with the exception of Commissioner Ramos and Commissioner Curran who were both absent. COMMISSION BUSINESS 2. Request for Crosswalk— Deer Hollow Wav RECOMMENDATION: 2.1 That the Public/Traffic Safety Commission deny the request for a marked crosswalk on Deer Hollow Way in front of Great Oak High School. By way of overheads, Principal Engineer Moghadam provided a brief staff report (per agenda packet, advising that the distance between the marked midblock crosswalk request and the signal light on Pechanga Parkway would be around 600 feet. At this time, the public hearing was opened. A. Ms. Cinday Whritenour, Temecula, relayed her concern with the amount of traffic on Deer Hollow Way, and requested that the Public/Traffic Safety Commission consider the feasibility of installing a marked midblock crosswalk on Deer Hollow Way to provide a safe crossing for students between Birdsall Sports Park and Great Oak High School. At this time, the public hearing was closed. Understanding Ms. Whritenour's concern with safety, Chairperson Arbogast noted that although the controlled signal would be 600 feet away, students should be crossing at the controlled signal, not midblock; that staff has identified that Great Oak High School has adequate on-site parking and that there would be no valid reason for students or parents to use Birdsall Park to cross Deer Hollow Way; and that it would be her opinion that motor officers should be patrolling the school area to ensure that no gridlock is occurring. For Commissioner Hagel, Ms. Whritenour advised that a variety of drop-off scenarios have been explored and have been moved several times in order to secure safety. In response to Chairperson Arbogast's query, Principal Engineer Moghadam advised that staff met with the school officials over a year ago to address issues regarding modification to driveways, parking, and bike lanes, noting that the issue of crossing Deer Hollow Way did not come up at that time. Chairperson Arbogast relayed that it would be her opinion that staff should meet with the school officials to discuss and explore safe drop-off points for students. After listening to the concerns of Ms. Whritenour and understanding staff's report, Commission Youmans noted that it would be his opinion that the parents dropping of students may need to be made aware of the dangers of their drop-off choices; and concurred with Chairperson Arbogast that staff work with school officials to explore safer alternatives and discuss these concerns with parents. R:Wlinutes\PublicTraffoSafetyCommission072408 2 Having spent some time driving and exploring the area, Commissioner Hagel stated that up by Via Colorada is an entrance to the school that exits onto another street, noting that this may be a better drop-off location for students, entering one direction and exiting onto another street; and relayed his support of staff working with school officials to explore safer drop-off points for parents. MOTION: Commissioner Youmans moved to approve staff recommendation and deny the request for marked midblock crosswalk on Deer Hollow Way in front of Great Oak High School; and requested that staff work with school officials to seek safe drop off routes. Commissioner Hagel seconded the motion and voice vote reflected approval with the exception of Commissioner Curran and Ramos who were both absent. 3. Traffic Conditions—Solana Way and Motor Car Parkway RECOMMENDATION: 3.1 That the Public/Traffic Safety Commission recommend maintaining the present level of control and direct Staff to continue monitoring conditions at the intersection of Solana Way and Motor Car Parkway. Principal Engineer Moghadam provided a staff report (of record). At this time, the public hearing was opened. A. Representing Paradise Chevrolet Cadillac, Mr. Jesse Slagill, relayed concerns of drivers losing control of their vehicles causing damage to private property due to collisions with the raised median; and requested that a sign be posted at Motor Car Parkway making it illegal to turn left onto Solana Way and noted Paradise Cadillac's desire to have Motor Car Parkway and Solana Way made into a four-way stop. At this time, the public hearing was closed. For the Public Traffic Safety Commission, Principal Engineer Moghadam advised that a left turn restriction or a four-way stop would not be feasible on a major arterial; advising that Motor Car Parkway would be a privately owned street. Relaying her opinion, Chairperson Arbogast noted that perhaps closing the island completely would be the best situation, noting that this will force drivers to make a right- hand turn making a u-turn at the light. In response to Commissioner Youman's query, Principal Engineer Moghadam noted that it would not be the City's intention of installing a No left-hand turn off Motor Car Parkway onto Solana Way; and advised that it would be important to understand why accidents are occurring on Solana Way before signs could be installed; relayed that the median on Solana Way would be the exact length of any other median in the City; and noted that any changes to the roadway would need to be the benefit of the roadway in its entirety as well as its surrounding businesses. R:\Minutes\PublicTraffcSafetyCommission072408 3 Having driven Solana Way and Motor Car Parkway on many occasions, Commissioner Hagel noted that it would be his opinion that the design of the median on Motor Car Parkway would not be adequate and noted that the median should be extended. Chairperson Arbogast noted that because Motor Car Parkway is a private road, the City at this time, cannot make changes to Motor Car Parkway; but would be in favor of extending the median on Solana Way noting that drivers can make a u-turn at either end of Solana Way. For the Public/Traffic Safety Commission, Principal Engineer Moghadam noted that several businesses own Motor Car Parkway; advising that if the owners of Motor Car Parkway were interested in changing the design of the street, an application to do so would be necessary. Adding some clarification, Director of Public Works Hughes noted that if the City were to make any changes to the design and/or controls of a street, it would need to be based on activity that would be within the boundaries or normal driving behavior; that any corrective measure taken would be a normal measure, not accommodating an excessive driving situation; that closing the median would affect many property owners in the area; that if the Commission were desirous of closing the median, property owners would need to be notified; and that all impacts and turning movements at that location would need to be examined carefully; and stated that it would be his opinion that if Paradise Chevrolet Cadillac were to install permanent barricades along that section of Solana Way, this would help to deter reckless drivers from ending up on the property in question. Concurring with Mr. Hughes' comments, the Public Traffic/Safety Commission requested that this issue be explored. 'Commissioner Curran arrived at 6:59 p.m. For Mr. Slagill, Principal Engineer Moghadam requested that copies of the tapes be forwarded to the City's Public Works Department for review. Because of the time span and hours of the incidents in the area, Police Chief Williams noted that that area would be difficult to patrol, noting that the cause of accidents would be important. Stating that staff would be happy to monitor the present level of control at the intersections of Solana Way and Motor Car Parkway, review tapes issued by Paradise Chevrolet Cadillac, and return with a report in four to six months, Director of Public Works Hughes clarified that the median in question would not be a design deficiency issue, but rather a "driver behavior issue". MOTION: Commissioner Youmans directed staff to continue to monitor the present level of control, that staff review the tapes provided by Paradise Chevrolet Cadillac, and that this issue be brought back in four months to review staff's statistics. Traffic Engineer's Report Principal Engineer Moghadam advised that due to safety concerns, a No Parking sign will be placed on Old Town Front Street, west side of the street south of Arch (near Starbucks), per the request of Chairperson Arbogast. 5. Police Chief's Report By way of handout, Police Chief Williams provided a brief staff report with respect to standard citations for the month of June, 2008. Commissioner Youmans commended the Temecula Police Department for their efforts with respect to the SLAP program. For Deputy City Manager Yates, Chairperson Arbogast noted that she will forward information to him with respect to a designated driver (breathalyzer) program when she receives the information from a colleague in Madera County. 6. Fire Chiefs Report Chief Fulcher, by way of handout, provided a brief staff report with respect to the May and June 2008 monthly statistics as well as update to the recent fires. Chairperson Arbogast requested that an update with respect to the Emergency Operation and Communications Update be provided. For the Public Traffic/Safety Commission, Deputy City Manager Yates advised that an update with respect to the Emergency Operation and Communication will be brought forward for review. BACKGROUND: At their meeting of July 22, 2008,the City Council approved the Planning staffs recommendation to continue the development of a City Sustainability Plan and directed staff to appoint a volunteerfrom each of the Commissions to serve on an implementation committee. The plan is in the early draft stages and the incumbent P/TSC representative will provide input to the transportation element of the plan. Attachment: 1. Provide staff direction to continue with the development of a City Sustainability Plan as outlined by staff 2. Adopt a resolution entitled: RESOLUTION NO. - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA ENDORSING THE CALIFORNIA GREEN BUILDER PROGRAM (CGB) FOR NEW SINGLE-FAMILY RESIDENTIAL PRODUCTION HOMES, AND REQUIRING ALL NEW CONSTRUCTION AND ADDITIONS TO CITY OWNED FACILITIES TO BE DESIGNED AND CONSTRUCTED TO ACHIEVE A MINIMUM LEADERSHIP IN ENERGY AND ENVIRONMENTAL DESIGN(LEED)CERTIFIED RATING(LONG RANGE PLANNING PROJECT NUMBER LR08-0001) BACKGROUND: Staff has attended conferences, workshops, and meetings to understand the implementation and development of"green" programs. Staff has also researched "green"efforts by other organizations and municipalities. "Green"program objectives maintain the social and economic well being of the community by promoting sustainable practices and protection of the environment. Staff has recently developed a framework for a Sustainability Plan for Temecula. The future Plan will include measurable goals, policies,and implementation programs. It will also include a reporting process to evaluate the success of meeting the Plan's goals. ANALYSIS: Temecula Sustainability Plan The Sustainability Plan is intended to act as a policy and implementation document that guides the City to comprehensively operate in a more sustainable manner. The objective of the Plan is to ensure that the City can meet its current needs (environmental, economic and social) without compromising the ability of future generations to do the same. The Sustainability Plan is foreseen to include a Vision Statement and Guiding Principles (see attached draft). These will provide the basis for the development of the Plan. The City's Vision is to strive to be a community that uses its local resources effectively and efficiently, safeguards human health and the environment, maintains a healthy and diverse economy, and improves the livability and quality of life for all its community members. The Guiding Principles include the following: • The concept of sustainability and its effect on City policy • The protection of our natural environment and its mutual dependency on economic health and social equity • A sense of community awareness and responsibility • A prioritization of sustainability programs balanced with the costs associated with these programs The Plan would include seven categories: • Energy • Water • Air Quality • Materials and Resources • Site and Community • Open Space • Transportation Specific goals would be established for each category. For each goal,indicators would be identified to provide a means of measurement. Targets or milestones would also be identified to measure progress toward meeting the goals. These goals and targets provide the impetus for creating strategies to implement the Plan. Finally,the draft goals, indicators and implementation strategies will be developed by a technical advisory committee made up of City staff from the Departments of Planning, Building and Safety, Public Works, Information Systems, and Community Services. AB 32 Related to the Temecula's sustainable planning efforts, is the Global Warming Solutions Act of 2006, otherwise known as AB 32. AB 32 outlines a comprehensive, multi-year program to reduce green house gas emission back to 1990 levels by 2020. Led by the Air Resource Board, under the direction of the Climate Action Team, the program includes the creation of a Scoping Plan. The Scoping Plan includes strategies and measures to reduce greenhouse gas emissions. The strategies identified in the AB 32 Scoping Plan will ultimately impact local jurisdictions. The strategies within the Scoping Plan include additional energy conservation through the following measures: Tougher building standards • Quantifying local green house gas emissions • Identifying greenhouse gas emissions reduction strategies • Linking land-use and transportation planning Strategies to move the State toward zero-waste The strategies in the Scoping Plan will undergo further analysis in the near future. The strategies will be developed into more detailed regulatory proposals over the next few years. Like the AB 32 Scoping Plan,the Temecula Sustainability Plan will require time for staff to analyze and develop appropriate goals, indicators, and targets. Prior to the completion of the Sustainability Plan, early action strategies can be pursued by the City. The first steps includes the adoption of a voluntary green building rating system for single-family residential homes,a green building policyfor municipally owned buildings and an update to the City's Water Efficient Landscape Ordinance.(The Water Efficient Landscape Ordinance is a separate agenda item). The adoption of these preliminary strategies will help conserve energy, water and other natural resources resulting in positive benefits to the environment and the community. Green Building Programs—Residential and Municipal Buildings Staff is proposing that the City endorse the California Green Builder Program(CGB),which focuses on production single-family residential homes. The CGB Program is a voluntary program which includes a uniform set of design and construction.standards. These standards allow developers and builders to qualify their production homes as"green"homes. The program focuses on the following categories: • Energy efficiency • Water efficiency • Advanced ventilation systems • Wood conservation • Construction waste diversion It is also recommended that the City show its commitment to sustainability by adopting a policy to require City owned facilities be constructed using the Leadership in Energy and Environmental Design (LEED) rating system. By adopting this policy the City should emerge as a leader for sustainable building practices. It is recommended that the "LEED Certified" level of certification should be adopted as the minimum standard for all new municipal construction. These initial steps in adopting a voluntary Green Building Program for single-family residential production homes and a Municipal Green Building Policy for City owned buildings will allow staff to evaluate bringing forward recommendations for additional Green Building Program elements in the future,which could potentially include: • Incentives for builders to construct green homes/buildings • Training for plan check • InspectionNerification of green building designs and systems • Expansion of voluntary green standards for commercial buildings At the May 21, 2008 and June 18, 2008 Planning Commission meetings,the following items were discussed: • Proposed framework for the Temecula Sustainable Plan • Importance of establishing measurable goals • Residential Green Building Program and endorsement of the California Green Builder Program • Cost implications to homeowners in light of the suggested strategies under the water conservation goals • Logistical concerns of replacing inefficient water fixtures when property changes ownership • The Municipal Green Building Program recommendation;questioning why the Citywould not be required to complete the LEED certification process In light of the Commission's comments, staff indicated that the goals and strategies identified were not staff recommendations, but were intended to provide an example of the possible structure of Sustainability Plan. Should staff recommend such a program in the future,staff would work with the water agencies, utility companies and other agencies to establish incentive programs Staff also responded to the Commission's concerns regarding LEED certification for municipal facilities indicating that staff is pursuing training and certification to review, evaluate and inspect projects. This will enable staff to determine if project has been designed and constructed to meet the green program standards used for the project. No recommendation was requested from the Planning Commission for the Temecula Sustainability Program. The Planning Commission voted 5-0 in favor of the Green Building Program recommendations. Implementation and Legislation Following the June 18,2008 Planning Commission meeting,staff has identified several mechanisms by which the implication concerns expressed by the Commission can potentially be addressed. One potential mechanism that will assist existing building owners is AB 811. This legislation authorizes a City to establish financing districts allowing City officials and willing property owners to enter into contractual assessments to finance the installation of energy efficiency improvements and renewable energy generation systems (solar). This bill has passed both Committees and is on its way to the Governor for signature. Staff is also evaluating a program being used by the City of Big Bear Lake and Berkley, which requires that certain improvements be made at the time the property is sold. Additionally, staff is evaluating a program that would require energy and water efficiency improvements when improvements to a property are made. This type of program is similar to one used for upgrading an existing property to be in compliance with disabled access requirements. As additional programs are identified and evaluated by staff fortheir cost effectiveness,they will be incorporated into the draft Temecula Sustainability Plan. The intent is to have a draft Sustainability Plan ready for Council's consideration this time next year. FISCAL IMPACT: The fiscal impacts associated with the implementation of the Temecula Sustainability Plan strategies are undetermined at this time, but will be evaluated as strategies are identified. The fiscal impact associated with the implementation of the Green Building Program includes staff training for review, inspection, and verification of proposed projects. The Planning and Building and Safety Departments have adequate funds available for staff training for the 2008109 fiscal year. The fiscal impact associated with the mandatory Municipal Green Building policy could result in annual operating cost savings to a facility. The annual operating costs will be evaluated on a case by case basis. The cost associated with the design and construction of a LEED Certified building typically does not exceed one percent of the overall project costs.
