HomeMy WebLinkAbout08-095 CC Resolution RESOLUTION NO. 08-95 ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA AMENDING THE CITY'S CONFLICT OF INTEREST CODE THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council finds, determines and declares that: A. Members of the City Council, members of the Planning Commission, the City Manager, the City Attorney, and the City Treasurer are all specifically required by Government Code Section 87200 to file economic disclosure forms each year. B. The City Council is required by Government Code Section 87300 to adopt a Conflict of Interest Code for the City that designates those other City officers and employees that must file economic disclosure forms because their work involves significant decision making. C. The City Council of the City of Temecula has previously adopted a Conflict of Interest Code to apply to certain officers and employees of the City. D. The City Council of the City of Temecula desires to amend the Conflict of Interest Code to update its provisions as required by Government Code Section 87306. Section 2. The Conflict of Interest Code for the City of Temecula is hereby amended in full to read as set forth in Exhibit A, attached hereto and incorporated herein by this reference. Section 3. " Consultants shall be included in the list of designated employees and shall disclose all of the information required to be disclosed by designated employees subject to the following limitations: The City Manager or his designee may determine in writing that a particular consultant, although a designated position, is hired to perform a range of duties that is limited in scope and ' thus is not required to fully comply with the disclosure requirement described in this Section. Such written disclosure shall include a description and based upon that description, a statement of the extent of disclosure requirements. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as this Conflict of Interest Code. The Mayor, City Council, Members of the Planning Commission, City Manager, City Attorney, City Treasurer, and Director of Finance are all required to file disclosure statements pursuant to State Law and are thus not included herein. 1
