HomeMy WebLinkAbout062608 DH Minutes MINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA DIRECTOR'S HEARING JUNE 26, 2008 A regular meeting of the City of Temecula Director's Hearing was called to order on Thursday, June 26, 2008 at 1:30 p.m. in the Main Conference Room, located at 43200 Business Park Drive, Temecula, California. Planning Director Debbie Ubnoske presiding. Also present were, Senior Planner Stuart Fisk and Minute Clerk Cynthia Lariccia. Item No. 1: Planning Application Number PA08-0099 a Minor Conditional Use Permit to authorize Taste of China restaurant to upgrade their existing Type-41 ABC license (on-sale beer and wine-eating place to a Type-47 ABC license (on sale general-eating place located at 32413 Temecula Parkwav Suite 210 Planning Director opened the public hearing at 1:31 p.m. Senior Planner presented an overview of the project and staff recommendations. The restaurant is located in the Vail Ranch Specific Plan zoning district. The subject property is located within Commercial Area B. Since this Specific Plan refers to an obsolete Riverside County zoning ordinance, it has been determined that the underlying land use of Highway Tourist Commercial is the applicable zoning for this project. Business selling alcoholic beverages in this zone are required an approval of a Conditional Use Permit. A Finding of Public Convenience or Necessity is not required due to the fact that the restaurant has an existing Type 41 ABC license and the Type 47 requested will not increase the number of existing on-sale general-eating licenses within the census tract. The supplemental development standards also require that businesses selling alcoholic beverages shall not be located within 500 feet of a religious institution, school or park. The closest sensitive use is approximately 2,500 feet away. In accordance with the California Environmental Quality Act, the project has been deemed categorically exempt from further environmental review per Section 15301, Class 1 Existing Facilities. Planning Director asked the applicant to state his name for the record and if he had read and agreed with the Conditions of Approval. An-Bang Shann, 32413 Temecula Parkway, Temecula and had one question on Condition Number 7 regarding a separate building permit for the patio addition. Mr. Shann noted that he had already applied for the permit. He also agreed with the Conditions of Approval. Planning Director stated that he had met that Condition and that nothing additional was required. No other persons were in attendance to speak in opposition or support of the project. Planning Director closed the public hearing and approved Planning Application No. PA08-0099 subject to the Conditions of Approval as modified.
