RESOLUTION NO. 10 -05
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMECULA ESTABLISHING A REVISED AND
UPDATED FEE SCHEDULE APPLICABLE UNDER THE
WESTERN RIVERSIDE COUNTY TRANSPORTATION
UNIFORM MITIGATION FEE (TUMF) PROGRAM
THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. Title and Findings. The City Council of the City of Temecula does
hereby find, determine and declare that:
A. This Resolution shall be known as the "Western Riverside County
Transportation Uniform Mitigation Fee Program Resolution of 2009" "Resolution
B. On January 12, 2010, the City Council held a duly noticed public hearing
pursuant to California Government Code sections 66000 et seq. (the "Mitigation Fee
Act on the 2009 Nexus Study described in Chapter 15.08 as adopted by Ordinance
No. 10 -02, adopted on January 26, 2010 and this Resolution.
C. At least ten (10) days prior to this hearing, the City Council made the 2009
Nexus Study, the TUMF Resolution and this Ordinance available for public review.
D. At the Public Hearing, the City Council duly considered data and
information provided by the public relative to the cost of the improvements and facilities
for which the fees are proposed and all other comments, whether written or oral,
submitted prior to the conclusion of the hearing.
E. Pursuant to the Mitigation Fee Act (Government Code 66000 et seq.)
the City Council hereby readopts all findings included in Chapter 15.08 as adopted by
Ordinance No. 10 -02, adopted on January 26, 2010, including those findings made in
the 2009 Nexus Study.
Section 2. Establishment of the Transportation Uniform Mitigation Fee
Schedule
A. In accordance with Chapter 15.08 of the Temecula Municipal Code, the
City Council adopts the following TUMF schedule applicable to all new development
projects, beginning March 27, 2010:
(1) $8,873.00 per single family residential unit
(2) $6,231.00 per multi family residential unit
(3) 1.73 per square foot of an industrial project
(4) $10.49 per square foot of a retail commercial project

(5) 4.19 per square foot of a service commercial project
(6) 2.19 per square foot of a service Class A and B Office
B. No provision of this Resolution shall entitle any person who has already
paid the TUMF to receive a refund, credit or reimbursement of such payment. This
Resolution does not create any new TUMF.
Section 3. Severability. If any one or more of the terms, provisions or
sections of this Resolution shall to any extent be judged invalid, unenforceable and/or
voidable for any reason whatsoever by a court of competent jurisdiction, then each and
all of the remaining terms, provisions and sections of this Resolution shall not be
affected thereby and shall be valid and enforceable.
Section 4. Effective Date. This Resolution shall take effect on the effective
date of Ordinance No. 10 -02.

PASSED, APPROVED, AND ADOPTED by the City Council of the City of
Temecula this 12th day of January, 2010.
