Commissioner Arbogast made the motion; it was seconded by Commissioner Hagel;

RECOMMENDATION:
1.1 Approve the Action Minutes of January 28, 2010.
COMMISSION BUSINESS
2. Traffic Conditions on Seraphina Road— Proposed Traffic Calming Measures -
Approved staff recommendation with the addition of posting "No Passing"
signs — (5 -0 -0) — Commissioner Arbogast made the motion; it was seconded
by Commissioner Hagel; and voice vote reflected unanimous approval.
RECOMMENDATION:
2.1 That the Public/Traffic Safety Commission:
1. Deny the request for access restrictions on Murrieta Hot Springs Road and
Willow Avenue;
2. Deny the request for closure of Seraphina Road at Jons Place;
3. Direct Staff to install interim striping which simulates the Raised Median Entry
Treatment concept and propose the raised median improvements in the City's
Capital Improvement Program for future construction;

4. Direct Staff to install VCalm Signs on a rotating basis for monitoring and reducing
vehicular speeds on Seraphina Road;
5. Direct Staff to install a speed reduction sign on Rita Way, install "fine" placards,
and increase the size of the speed limit signs on Seraphina Road;
6. Deny the request for multi -way stop signs at the intersection of Seraphina Road
and Eastgate Parkway;
7. Direct Staff to install interim striping to reduce the existing roadway section until
development of Tract 32346 occurs and roadway improvements are
implemented on Rita Way.

3. Revisions to Citv's Disaster Ordinance — Approved staff recommendation.
RECOMMENDATION:
3.1 That the Public/Traffic Safety Commission review revisions to Temecula Municipal

RECOMMENDATION:
That the Public/Traffic Safety Commission review recommended revisions to Temecula
Municipal Code Section 10.22, Enforcement of California Vehicle Code on Private Property
(Mall Ring Road),before final City Council review.
BACKGROUND:
On March 5, 2010, Jeff Kurtz, General Manager of the Promenade Mall, made an official
request that the Temecula Police Department enforce the California Vehicle Code on the Mall
property to include the Ring Road. In order to provide the Police Department the formal
authority to enforce the vehicle code, the City Council must adopt an Ordinance amending the
City's Municipal Code.
One of the most effective public safety tools the City has is to provide police enforcement and
this Ordinance will create safer traffic circulation around the Ring Road and all parking areas
around the mall.
The attached Ordinance will need to be adopted by the City Council to take effect. The action
tonight is for the Commission to review and discuss this proposed Ordinance and if applicable,
recommend it be forwarded to the City Council.
FISCAL IMPACT:
This action is relating to public safety and enforcement costs and associated Vehicle Code Fine
Revenues will be included in the annual operating budget.

vehicle codes on the private property of The Promenade. This authority is requested for the private roads and
parking fields surrounding the mall and owned by Forest City. We feel that by giving this authority the
Temecula Police Department can continue to make the mall a safe environment for our shoppers. As you
know we work very closely with the Temecula PD Sub - Station and it is important that the Police Officers have
the tools and authority necessary to be successful.

CITY OF TEMECULA ADDING CHAPTER 10.22 TO
THE TEMECULA MUNICIPAL CODE PROVIDING
FOR THE ENFORCEMENT OF THE CALIFORNIA
VEHICLE CODE ON PRIVATE COMMERCIAL
PROPERTY LOCATED ON APPROXIMATELY
ACRES AT THE SOUTHEAST CORNER OF
WINCHESTER ROAD AND YNE7 ROAD
(REGIONAL MALL) PURSUANT TO VEHICLE
CODE SECTION 21107.6
THE CITY COUNCIL OF THE CITY OF TEMECULA DOES
ORDAIN AS FOLLOWS:
Section 1. Chapter 10.22, Enforcement of California Vehicle Code on
Private Commercial Property, is hereby added to the Temecula Municipal Code to read as
follows:
CHAPTER 10.22 ENFORCEMENT OF CALIFORNIA VEHICLE CODE
ON PRIVATE PROPERTY
Sec. 10.22.010 Enforcement of Vehicle Code on Roads at the Regional
Mall Located at the Southeast Corner of Winchester Road
and Ynez Road.
A. Pursuant to the provisions of California Vehicle Code
Section 21107. 1, the City Council hereby finds, determines and declares
that:
L There exists in the City of Temecula an area of
approximately _ acres located southeasterly of Winchester Road and
Ynez Road, which known as the Regional Mall. A map depicting the
Regional Mall and the privately owned and maintained roads within the
Regional Mall is set forth herein as Illustration 10.22.010.
2. California Vehicle Code Section 21107.6 authorizes
the City of Temecula to adopt an ordinance providing for the enforcement
of the California Vehicle Code by the City on private streets generally
open to public use following notice to the property owner and a public
hearing unless the property owner posts signs that the provisions of the
Vehicle Code will not apply to the privately owned and maintained streets.
The owners of the Regional Mall have requested the adoption of an
ordinance enacting this section of the Temecula Municipal Code.

3. On 2010 the City
Council of the City of Temecula held a duly noticed public hearing
pursuant to the requirements of California Vehicle Code Section 21107.6
to consider whether to authorize the enforcement of the Vehicle Code on
the privately owned and maintained streets within the Regional Mall and
adopt the ordinance enacting this section of the Temecula Municipal
Code. The owners of the Regional Mall property were notified in writing
of the public hearing. The public was given the opportunity to speak at
the public hearing on the proposed ordinance. Following the public
hearing and after due consideration of the information presented at the
hearing, the City Council adopted the ordinance enacting this section of
the Temecula Municipal Code.
4. The privately owned and maintained roads within
the Regional Mall are generally held open to the public for the purposes of
vehicular travel to serve the Regional Mall and other commercial
establishments.
B. The provisions of the California Vehicle Code shall apply
to the privately owned and maintained roads in the Regional Mall and the
City of Temecula shall have the authority to enforce the provisions of the
California Vehicle Code on said roads.
Section 2. Illustration 10.22.010 referenced in Section I of this Ordinance is
attached hereto as Exhibit A and incorporated herein as though set forth in full.
Illustration 10.22.010 shall be codified in the Temecula Municipal Code immediately
following Section 10.22.010.
Section 3. If any sentence, clause or phrase of this ordinance is for any reason
held to be unconstitutional or otherwise invalid, such decision shall not affect the validity
of the remaining provisions of this ordinance. The City Council hereby declares that it
would have passed this ordinance and each sentence, clause or phrase thereof irrespective
of the fact that any one or more sentences, clauses or phrases be declared unconstitutional
or otherwise invalid.
Section 4. The City Clerk shall certify to the adoption of this Ordinance and
cause it to be published in the manner required by law.

Also, City Maintenance staff responded to 90 service order requests ranging from weed abatement, tree trimming, sign repair,
A.C. failures, litter removal, and catch basin cleanings. This is compared to 123 service order requests for the month of
January. 2010.
The Maintenance Crew has also put in 55 hours of overtime which includes standby time, special events and response to street
emergencies.
The total cost for Street Maintenance performed by Contractors for the month of February 2010 was $43.652.00 compared to
$131.788.00 for the month of January. 2010
