Pollutants of Concern Potential pollutants associated with Urban Runoff from the proposed project must be identified. Exhibit B of the WQMP provides brief descriptions of typical pollutants associated with lJrban Runoff and a table that associates typical potential pollutants with types of development (land use). It should be noted that at the Co- Permittees discretion, the Co-Permittees may also accept updated studies from the California Association of Stormwater Quality Agencies (CASQA), USEPA, SWRCB and/or other commonly accepted agencies/associations acceptable to the Co-Permittee for determination of Pollutants of Concern associated with given land use. Additionally, in identifying Pollutants of Concern, the presence of ]egacy pesticides, n�trients, or hazardous substances in the site s soils as a result of past uses and their potential for exposure to Urban Runoff must be addressed in project-specific WQMPs. The Co-Permittee may also require specific pollutants commonly associated with urban runoff to be addressed based on known problems in the watershed. The ]ist of potential Urban Runoff pollutants identified for the project must be compared with the pollufants identified as causing an impairment of Receiving Waters, if any. To identify pollutants impairi�g proximate Receiving Waters, each project proponent preparing a project-specific WQMP shall, at a minimum, do Che following: l. For each of the proposed project discharge points, identify the pro�imate Receiving Water for each discharge point, using hydrologic unit basin numbers as identified in the mosf recent version of the Water Quality Control Plan for the Santa Ana River Basin or the San Diego Region. 2. Identify each proximate identified above that is listed on the most recent list of Clean Water Act Section 303(d) ]ist of impaired water bodies, which can be found at website wwwswreb.ca.gov/tmdl/303d_Iists.htmL List all pollutants for which the proximate Receiving Waters • are impaired. 3. The culvert design/installation includes headwalls and aprons at the inlet and outlet control points to eliminate adverse impacts. The outlet will also incorporate an energy dissipater to slow the flow down to pre-construction condition� thereby eliminating any erosion concern. Pipe capacity is 368 cubic feet per second (cfs). The attached exhibit titled "Proposed City Constructed Public Improvements (ROripaugh Ranch CFD) shows the limits of the proposed City improvements. In addition, the attached photographs taken on Tuesday, July 22, 2008, show existing conditions. 3 In terms of ownerships within the Panhandle area (Tract 29661), per our GIS records and to the best of our knowledge, the individual owners involved in this area are as follows: phase 1- Wingsweep Corp; Phase 2— BHT Roripaugh WB99; Phase 3 and 4— HRA Roripaugh 1& 2; final phase —Sunwood Roripaugh Ranch. Regarding Ashby USA LLC's interest, the • latest title report dated 9/23/10 on this property shows 2 entities in which title is vested....Temecula Land Partners I, LLC and Temecula Land Partners II, LLC . As you can see, this property's change of ownerships and notes have become convoluted and complicated. However, as it relates to the City project, the City is almost complete with the bid package for Phase I and expects to go out to bid by the end of the year. We have obtained the regulatory agencies' clearances on the construction of BSR and understand that Ashby USA, LLC or a future developer is still obligated to mitigate, as previously conditioned and/or spelied out in the existing permits. The City will work with the regulatory agencies to ensure that this occurs, as conditioned. Please note that Pete Olah is not a representative of the City or our City project. He has been retained by a developer, who has been negotiating and/or is interested in developing the "Pan" area of Roripaugh Ranch Development. As I understand it, his il/16 meeting with the RB is on behalf of his employer, in hopes to determine what their outstanding obligations and mitigations are for their project. Please review this information, as necessary. If you need additional info, let me know. I hope this relieves you of your initial concerns over our City project.
