HomeMy WebLinkAbout94-069 CC ResolutionRESOLUTION NO. 94-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TI~IF_.CIR.A DENYING PLANNING APPLICATION NO. 94-0035 - APPEAL UPHOLDING THE PLANNING COMMISSIONS DECISION TO APPROVE A THIRTY (30) FOOT HIGH, ONE HUNDRl~ FIFFY (150) SQUARE FEET IN AREA FREEWAY ORIENTED SIGN LOCATED AT THE REAR PORTION OF THE YNEZ CAR CARE CENTER AND KNOWN AS ASSESSOR'S PARCEL NUMBER 921-720-008. WHEREAS, Larry Gabde fried Planning Application No. 940035 in accordance with the City of Temecula General Plan and Riverside County Land Use and Subdivision Ordinances, which the City has adopted by reference; WHEREAS, Planning Application No. 94-0035 was processed in the time and manner prescribed by State and local law; WItlEREAS, the Planning Commission considered Planning Application No. 94-0035 on May 2, 1994; WHEREAS, the Commission considered all facts relating to Planning Application No. 94- 0035; WHEREAS, at the conclusion of the Commission hearing, the Commission approved Planning Application No. 94-0035 for a thirty (30) foot high freeway oriented sign; WHEREAS, Larry Gabele filed an appeal of the Planning Commission's decision regarding Planning Application No. 94-0035 in accordance with the City of Temecula General Plan and Riverside County Land Use and Subdivision Ordinances, which the City has adopted by reference; WHEREAS, the City Council received a copy of the Commission proceedings and Staff Report regarding Planning Application No. 94-0035; WIIEREAS, the City Council considered Planning Application No. 94-0035 on June 28, 1994; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ~ DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: 94-69 1 Section 1. Findirlgs. That the Temecula City Council hereby makes the following findings: 1. The project is consistent with the City's General Plan. The sign provides design excellence in signage, and it serves to preserve and enhance the positive qualities of individual districts. Further, it contributes to a streetscape system that provides cohesiveness and enhances community image. 2. The overall development of the land is designed for the protection of the public health, safety and general welfare. The height selected for the sign is the minimum necessary for effective identification of the site. 3. The project conforms to the logical development of the land and is compatible with the present and future logical development of the surrounding property. The forty (40) foot high freeway oriented sign is the minimum necessary for effective identification of the site. A. As conditioned pursuant to Section 4, Planning Application No. 94-0035 as proposed, conforms to the logical development of its proposed site, and is compatible with the present and future development of the surrounding property. Section 3. Environmental Compliance. This project is a Categorical Exemption per Article 19, Section 15311 of the California Environmental Quality Act Guidelines. This Exemption states: "Class 11 consists of construction, or placement of minor structures accessory to existing commercial facilities, including but not limited to on-premise signs.' Section 4. The City Clerk shall certify the adoption of this Resolution. Section 5. PASSED, APPROVED AND ADOPTED this 28th day of June, 1994.
