A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TEMECULA RECOMMENDING THAT THE
CITY COUNCIL DENY PLANNING APPLICATION NO.
PA11-0277, A TENTATIVE TRACT MAP TO CREATE 57
LOTS FROM THREE EXISTING PARCELS, GENERALLY
LOCATED AT THE NORTHEAST CORNER OF
PECHANGA PARKWAY AND LOMA LINDA ROAD (APN
961-450-012, 961-450-013, AN D 961-450-003)
Section 1. Procedural Findings. The Planning Commission of the City of
Temecula does hereby find, determine and declare that:
A. On October 27, 2011, Larry Markham, on behalf of Coyne Development,
filed Planning Application Nos. PA11-0276, a Zone Change and Planned Development
Overlay; PA11-0277, a Tentative Tract Map; and PA11-0275, a Development Plan, in a
manner in accord with the City of Temecula General Plan and Development Code.
B. The Application was processed including, but not limited to a public notice,
in the time and manner prescribed by State and local law.
C. The Planning Commission, at a regular meeting, considered the
Application and environmental review on March 20, 2013, at a duly noticed public
hearing as prescribed by law, at which time the City staff and interested persons had an
opportunity to and did testify either in support or in opposition to this matter. At the
Commission's request, the item was continued to the April 3, 2013 meeting to allow the
applicant to address the construction schedule for the age-restricted, single-family
housing, architectural enhancements, and overall project density.
D. At the Commission's request, the project was continued at the April 3,
2013 hearing to the April 17, 2013 hearing to again address issues related to the
construction schedule for the age-restricted, single-family housing, architectural
enhancements, and overall project density.
E. The Planning Commission, at a regular meeting, considered the
Application on April 17, 2013 and after due consideration of the testimony, the Planning
Commission recommended that the City Council deny Planning Application Nos. PA11-
0276, a Zone Change and Planned Development Overlay; PA11-0277, a Tentative
Tract Map; and PAl2-0275, a Development Plan subject to and based upon the findings
set forth hereunder.
F. All legal preconditions to the adoption of this Resolution have occurred.
Section 2. Further Findings. The Planning Commission, in recommending
denial of the Tentative Tract Map Application hereby finds, determines and declares that
Tentative Tract Map Application PA11-0277 is not in conformance with the General Plan
for Temecula and with all applicable requirements of State law and other Ordinances of
the City:
A. The proposed subdivision and the design and improvements of the
subdivision is consistent with the Development Code, General Plan, any applicable
Specific Plan and the City of Temecula Municipal Code;
As designed, the multi-family portion of the proposed map is not consistent with
the Subdivision Ordinance, Temecula General Plan, and the City of Temecula
Municipal Code because the proposed project exceeds the density range allowed
per the Temecula Genera/ Plan. The High Density (H) designation of the General
Plan provides for a density range of 13 — 20 dwelling units per acre. The multi-
family component of the project totals 24.27 dwelling units per acre.
B. The site is physically suitable for the type and proposed density of
development proposed by the Tentative Map;
The proposed map subdivides 22.73 acres to allow for 325 apartments and 49
lots for age restricted single-family homes. The proposed Tentative Tract Map
design does not meet the General Plan High Density (H) range of 13 — 20
dwelling units per acre for High Density (H) units. The proposed density for the
multi-family component of the project is 24.27 dwelling units per acre. The
proposed density for the project exceeds the General High Density (H) range and
therefore does not allow the project to be physically suitable for the site.
Section 3. The Planning Commission hereby recommends that the City of
Temecula City Council deny Planning Application PA11-0277, a Tentative Tract Map to
create 57 lots from three existing parcels, generally located at the northeast corner of
Pechanga Parkway and Loma Linda Road.
Section 4. RECOMMENDED FOR CITY COUNCIL DENIAL by the City of
Temecula Planning Commission this 17 day of April, 2013.
