Senior Planner Meyer stated this would be researched.
Rich Tate stated that Texaco would comply with a condition regarding hours
of sales if this is the City's standard procedure.
Commissioner Slaven expressed concern that this item has come before the
Commission for a second time and requested that the applicant demonstrate
the finding for convenience since several locations exist along this route that
sell beer and wine.
Rich Tate responded that he did not know the proximity of other beer and
wine sale locations.
Commissioner Soltysiak recommended a more detailed policy be developed on
Convenience or Necessity findings for future use by the Commission, He
recommended this project permit no sales of alcohol between 12:00 midnight.
and 6:00 a.m.
Assistant Attorney Greg Diaz responded the Commission could condition the
hours of sale at this meeting if the applicant agreed.
Commissioner Miller stated that since a finding for convenience was approved
for the Union and Shell Stations, and does see any logical bases for not
making the same finding in the Texaco case.
Chairperson Fahey agreed but recommended a policy be developed for
consistency.
Commissioner Webster stated that a convenience finding was reasonable
since this project included gas, a food mart, and other businesses which made
it unique and created a one-stop shopping opportunity.
