RECOMMENDATION: That the City Council appoint Gary Youmans to the Planning
Commission and authorize the recruitment for the Public/Traffic Safety Commission, as
necessary.
BACKGROUND: On June 9, 2015, the City Council unanimously extended the
recruitment period for a position on the Planning Commission due to former Planning
Commissioner Pat Kight's application withdrawal and relocation outside of the City's jurisdiction.
The extended application period ran from June 10 — June 30, 2015. Existing applications
already received for the previous recruitment were considered jointly with any new applications
received during the extended time period. Fifteen applications were forwarded to the committee
comprised of Mayor Comerchero and Council Member Nagger for review and recommendation.
Both Mayor Comerchero and Council Member Nagger have recommended the appointment of
Gary Youmans to serve a full three -year term through June 15, 2018. All applicants are
registered voters and live within the city limits of the City of Temecula.
If the City Council ratifies the recommendation of the committee by appointing Mr. Youmans to
the Planning Commission, a vacancy results on the Public/Traffic Safety Commission of which
Mr. Youmans is currently a member. As such, staff also asks for authorization to recruit for the
resulting vacancy on the Public/Traffic Safety Commission. The recruitment period would be
July 20 — August 10, 2015. The appointment to fill that vacancy for the remaining term expiring
on October 10, 2017 will likely be made at the August 25, 2015 meeting.

BACKGROUND SUMMARY AND ANALYSIS
On August 13, 2015, Kimberly Gross submitted Planning Application No.PA15 -1214 for a
Finding of Public Convenience or Necessity for Fairfield Inn & Suites to operate under a Type
20 ABC License (Off Sale Beer & Wine) located at 27416 Jefferson Avenue. This acquisition
will allow the applicant to sell beer and wine within the designated Marketplace, to hotel guests,
located off the lobby area and was part of the original construction. This will allow the applicant
to stay competitive with other hotels in the area as it is a convenience that travelers have come
to expect when making the accommodation arrangements. The Conditional Use Permit for the
Type 20 ABC License was approved under PA15 -0402 on July 15, 2015. However, the Public
Convenience or Necessity was not applied for and not recognized by City Staff that it was
required as part of the approval of the Type 20 ABC License for this location.
While the sale of beer and wine is an incidental or conditionally permitted use, the Census Tract
is "over- concentrated" with Type 20 Licenses and requires a Finding of Public Convenience or
Necessity for an additional license. Per ABC, there are two off -sale licenses allowed and
sixteen existing within the Census Tract.
LEGAL NOTICING REQUIREMENTS
Notice of the public hearing was mailed to the property owners within 1,000 -foot radius on
August 20, 2015, and published in the U -T San Diego on August 23, 2015.
ENVIRONMENTAL DETERMINATION
In accordance with the California Environmental Quality Act, the proposed project has been
deemed to be categorically exempt from further environmental review (Section 15301, Class 1
Existing Facilities).
The request for a Finding of Public Convenience or Necessity for Fairfield Inn & Suites to allow
the off sale of beer and wine within the designated marketplace will be conducted in an existing
hotel. All access and public utilities are available to the site. The proposed use, with prior
issuance of a Conditional Use Permit, is in conformance with all zoning requirements of the
Development Code.
FINDINGS
Finding of Public Convenience or Necessity (Section 17.10.020)
Whether or not the proposed use is consistent with the General Plan and Development Code.
Fairfield Inn & Suites operates as a hotel. The proposed use is consistent with the City of
Temecula General Plan which specifies that the Highway Tourist (HT) designation includes
hotels serving the entire community. The off sale of beer and wine would serve as an incidental
use to the establishment operations.
Whether or not the proposed use is compatible with the nature, condition and character of
adjacent land uses.
Fairfield Inn & Suites is an existing hotel within the Highway Tourist zone. As previously
conditioned, the proposed use is compatible with the nature, condition and development of
adjacent uses, buildings and structures, and the proposed use will not adversely affect the
adjacent uses, buildings or structures.
Whether or not the proposed use would have an adverse effect on adjacent land uses.
Fairfield Inn & Suites is an existing hotel within the Highway Tourist zone. As previously
conditioned, the proposed use is compatible with the nature, condition and development of
adjacent uses, buildings and structures, and the proposed use will not adversely affect the
adjacent uses, buildings or structures. In addition, the site will remain unaltered, and adequate
in size and shape to accommodate the yards, walls, fences, parking and loading facilities, buffer
areas, landscaping, and other development features prescribed in the Development Code. The
addition of the proposed use does not impact any of the site requirements.
Whether or not the proposed use would result in an excessive number of similar establishments
in close proximity.
The Fairfield Inn & Suites is located in a Census Tract which ABC considers "over -
concentrated" with off -sale licenses. Per ABC, two off -sale licenses are allowed in this tract,
and sixteen currently exist. Therefore, a Finding of Public Convenience or Necessity is required
for Fairfield Inn & Suites to be the seventeenth establishment with an off -sale ABC License.
The finding will allow the applicant to stay competitive with other hotels in the area, as it is a
convenience that travelers have come to expect when making the accommodation
arrangements. The Findings of Public Convenience or Necessity will not result in an excessive
number of similar establishments in close proximity as the Springhill Suites being the any other
hotel that operates under a Type 20 ABC License within the Census Tract.

Section 1. Procedural Findings. The Planning Commission of the City of
Temecula does hereby find, determine and declare that:
A. On August 13, 2015, Kimberly Gross filed Planning Application No. PA15-
1214 a Finding of Public Convenience or Necessity Application, in a manner in accord
with the City of Temecula General Plan and Development Code.
B. The Application was processed including, but not limited to a public notice,
in the time and manner prescribed by State and local law.
C. The Planning Commission, at a regular meeting, considered the
Application and environmental review on September 2, 2015, at a duly noticed public
hearing as prescribed by law, at which time the City staff and interested persons had an
opportunity to and did testify either in support or in opposition to this matter.
D. At the conclusion of the Planning Commission hearing and after due
consideration of the testimony, the Planning Commission approved Planning Application
No. PA15 -1214, subject to and based upon the findings set forth hereunder.
E. All legal preconditions to the adoption of the Resolution have occurred.
Section 2. Further Findings. The Planning Commission, in approving the
Application hereby finds, determines and declares that:

areas, landscaping, and other development features prescribed in the
Development Code. The addition of the proposed use does not impact any of
the site requirements.
D. Whether or not the proposed use would result in an excessive number of
similar establishments in close proximity;
The Fairfield Inn & Suites is located in a Census Tract, which ABC considers
"over- concentrated" with off -sale licenses. Per ABC, two off -sale licenses are
allowed in this tract, and sixteen currently exist. Therefore, a Finding of Public
Convenience or Necessity is required for Fairfield Inn & Suites to be the
seventeenth establishment with an off -sale ABC License. The finding will allow
the applicant to stay competitive with other hotels in the area as it is a
convenience that travelers have come to expect when making the
accommodation arrangements The Findings of Public Convenience or Necessity
will not result in an excessive number of similar establishments in close proximity
as only the Springhill Suites being the other hotel that operates under a Type 20
ABC License within the Census Tract.
Section 3. Environmental Findings. The Planning Commission hereby makes
the following environmental findings and determinations in connection with the approval
of the Major Modification:
A. In accordance with the California Environmental Quality Act, the proposed
project has been deemed to be categorically exempt from further environmental review
(Section 15301, Existing Facilities);
The request for a finding of Public Convenience or Necessity for Fairfield Inn &
Suites to allow the sale of beer and wine within the designated marketplace will
be conducted in an existing hotel. All access and public utilities are available to
the site. The proposed use, with prior issuance of a Conditional Use Permit, is in
conformance with all zoning requirements of the Development Code.
Section 4. Conditions. The Planning Commission of the City of Temecula
approves Planning Application No. PA15 -1214, subject to the Findings for Public
Convenience or Necessity with no conditions of approval. No other application is
required.

We are applying for a Certification of Public Convenience or Necessity for our Type 20 license which is
required by our Franchise to sell beer and wine to our hotel guests. Alcoholic beverages for sale, for
guest consumption on the property, will be available in our designated Marketplace which is located
off our lobby and part of the original building construction.
• The hotel is open 24 hours, 7 days a week operation
There are approximately 25 employees
• Total of 92 parking spaces
• Average daily peak trips will vary from 25 to 35 percentage of occupancy
• Structures to be used are reach -in refrigerators which are housed on -site and owned by the
property, and will be monitored by trained front desk staff

This letter is to serve as an initial Statement of Justification for the sale of beer and wine with respect
to the referenced property as required and set forth by the City of Temecula in the Public Convenience
or Necessity Application Submittal Requirements.
Many lodging establishments offer alcoholic beverages to their guests for on -site consumption and it is
a convenience that travelers have come to expect when making their accommodation arrangements.
It is our goal at the Fairfield Inn to provide travelers with full amenities to ensure a relaxing and
convenient stay. The approval of this license will not create any negative impact on the surrounding
community.
We are aware of the concerns regarding the operation of the location associated with the alcoholic
beverage sales. Our request to sell alcoholic beverages for on -site consumption will not in any way
endanger or constitute a menace to the general welfare of safety of public health nor will there be a
substantial adverse effect on traffic circulation. Our site is suitable and adequate for the sales of
alcoholic beverages for the personal comfort and convenience of our guests at their leisure. Please
note the following in regards to business use:
• There are no unique features. This is a small 5' x 12' area with reach -in refrigerators for cold
items and shelving for dry good items such as toiletries and snacks, in the lobby of our hotel.
• Our establishment caters only to over -night guests who use our accommodations.
• The service to provide alcoholic beverages is consistent and compatible with the community
and only seeks to ensure that all levels of amenities are comparable with that of the other
locations nearby.
• Our establishment is located in the corner area of two main roads (Jefferson & Winchester) and
has small entrance /exit ways that allows traffic to flow amongst the other establishments (Jack -
in- the -Box, Chin's Gourmet) that are located in the same vicinity.
• There is not a significant influx of population during any certain seasonal period.
• It is unknown if there is a proliferation of licensed establishments within the Census Tract.
• There are no sensitive uses within close proximity.
• Our location is in a business area; there is no concern of interfering with any local resident's
quiet enjoyment.
• This will not add to law enforcement problems in the area.
We respectfully request that the City of Temecula find that the Certification of Public Convenience or
Necessity to be served by the issuance of our license.
