Recommend the City Council adopt an Ordinance amending Section 10.16.200 of the Temecula Municipal Code Prohibiting the Parking of Vehicles Under Certain Conditions at Parking Lots Owned or Controlled by the City. BACKGROUND: A request was received to review the feasibility of implementing parking restrictions at City owned parking lots to prohibit overnight and long term parking. The purpose of the request is to address the on-going problem of long term vehicular parking in the Senior Center lot, the parking lot adjacent to the History Museum, and the parking structure located adjacent to the Civic Center. The public has been notified of the Public/Traffic Safety Commission's consideration of this issue through the agenda notification process. Currently, Section 10.16.200, "Parking and Driving on City Property', of the Temecula Municipal Code, authorizes the City Manager to examine and survey all City owned parking facilities and implement regulations to insure the appropriate use of the facilities and prevent interferences with the day-to-day operation of City business. This section also authorizes the City Manager to promulgate the regulations with a written statement or graphic depiction filed with the City Clerk. The City Council has the option to formally review the proposed regulation, if deemed necessary. The existing section does not however designate a specific authority for enforcement of the established regulations at City owned parking facilities nor does it provide the authority for removal of vehicles that violate the established regulations. Also, there are no provisions for the establishment of time limited parking restrictions at city owned parking facilities. The proposed Ordinance amending Section 10.16.200, defines the restrictions, violations, establishes time limited parking restrictions at certain City owned parking facilities, designates the authority for enforcement of parking restrictions, and delegates to and authorizes the City Manager to adopt regulations and procedures for the removal of vehicles violating parking restrictions on City owned parking facilities. Staff recommends the Commission approve the recommendation that the City Council adopt an Ordinance amending Section 10.16.200 of the Temecula Municipal Code. 1 FISCAL IMPACT: Adequate funds are available for installation of signs in the Public Works, Traffic Engineering Division's Operating Budget. Attachment: 1. Exhibit "A" — Ordinance Amending Section 10.13.200 of the Temecula Municipal Code, Prohibiting the Parking of Vehicles Under Certain Conditions at Parking Lots Owned or Controlled by the City z EXHIBIT "A" ORDINANCE AMENDING SECTION 10.13.200 OF THE TEMECULA MUNICIPAL CODE, PROHIBITING THE PARKING OF VEHICLES UNDER CERTAIN CONDITIONS AT PARKING LOTS OWNED OR CONTROLLED BY THE CITY 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMECULA AMENDING SECTION 10.16.200 OF THE TEMECULA MUNICIPAL CODE PROHIBITING THE PARKING OF VEHICLES UNDER CERTAIN CONDITIONS AT PARKING LOTS OWNED OR CONTROLLED BY THE CITY THE CITY COUNCIL OF THE CITY OF TEMECULA DOES ORDAIN AS FOLLOWS: Section 1. Section 10.16.200 of the Temecula Municipal Code is hereby amended to read as follows: 10.16.200 Parking Restrictions on City Parking Lots A. This section shall apply to all real property owned, lease, or otherwise controlled by the City for the purpose of providing off-street public parking ("City Parking Lots"). It shall be presumptive evidence that a parking lot is a City Parking Lot subject to the provisions of this Section if the parking lot is designated as a City Parking Lot on a resolution adopted by the City Council. B. No vehicle shall be parked or left standing on a City Parking Lot in violation of any of the following requirements: 1) Adjacent to a red curb or line painted red: 2) In any parking space or area marked with a sign or pavement markings stating"No Parking;" 3) Within two or more designated parking spaces; 4) In violation of applicable time restrictions on the time allowed for parking vehicles within the City Parking Lot as set forth in this Section or by resolution of the City Council; 5) In violation of the times when parking at the City Parking Lot is prohibited as set forth in this Section or by resolution of the City Council; 6) In violation of such other parking restrictions as may be set forth in this Section or by resolution of the City Council limiting parking at a City Parking Lot to patrons of an adjacent or near-by City facility; 7) In violation of any applicable requirements of the California Vehicle Code, including without limitation, restrictions on parking in parking space reserved for persons with disabled placards; or 8) Such other parking restrictions as may be set forth in this Section or by resolution of the City Council. 1955463.1 C. Pursuant to Subsections B.4), B.5)and B.6)of this Section and in addition to the parking restrictions set forth in Subsection B,the following specific parking restrictions shall apply to the City Parking Lots and vehicles parking in violation of these provisions may be removed as provided in Subsection F. of this Section: 1) City Parking Lot adjacent to the History Museum and Mary Philips Senior Center as depicted on Exhibit A,attached to this Ordinance: a) No vehicles shall be parked or left standing on this City Parking Lot between the hours of 11 p.m. on one day and 5 a.m. on the next day. b) No vehicles shall be parked or left standing on this City Parking Lot unless the driver and occupants of such vehicle are patronizing the adjacent History Museum or Mary Philips Senior Center. 2) D. The parking restrictions set forth in Subsections B.4), B.5) and B.6) shall be posted on signs in plain view at all vehicle entrances at the City Parking Lot each E. The parking restrictions set forth in Subsection C. allowing the removal of vehicles in violation of Subsection C shall be posted on signs at the City Parking Lot in accordance with the following requirements: I) A sign shall be displayed, in plain view at all vehicle entrances to the City Parking Lot; 2) Each sign shall be not less than seventeen inches (17") by twenty two inches (22") in size with red lettering not less than one inch (I") in height, describing the parking restrictions; 3) Each sign shall indicate that vehicles violating the parking restrictions may be removed at the owner's expense; and 4) Each sign shall contain the telephone number of the local traffic law enforcement agency where a person whose vehicle has been removed from a City Parking Lot may find out the status of the vehicle and the location to which it has been removed. F. In addition to the grounds for removal specified in the California Vehicle Code, and pursuant to California Vehicle Code section 22651(n), vehicles parked in violation of Subsection C. of this Section, shall be subject to removal from a City Parking Lot within the City. I) Such vehicles may be removed by any peace officer, as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the Penal Code, or may be removed by any regularly employed and salaried employee of 1955463.1 the City who is engaged in directing traffic or enforcing parking laws and regulations of the City. Vehicles removed from City Parking Lots shall be removed to such locations as approved in writing by the City Manager. 2) The City Council hereby delegates to and authorizes the City Manager to adopt such written regulations and procedures as necessary to implement the removal of vehicles parked or left standing on a City Parking Lot in violation of this Section. 3) The City Council hereby delegates to and authorizes the City Manager to enter into such agreements with tow services as may be necessary to implement the removal remedies of this Section. G. The provisions of this Section shall not be applicable to license agreements, encroachment permits or other agreements entered into by the City Council or City Manager for the use of a City Parking Lot for purposes other than parking. The City Manager is hereby authorized to temporarily suspend the parking restrictions on one or more City Parking Lots when necessary or convenient for special events approved or authorized by the City. Section 2. The City Clerk shall certify to the adoption of this Ordinance and shall cause it to be published in the manner required by law. 1955463.1 ITEM NO. 3 Consideration of Multi-Way Stop Signs — McCabe Drive at Montelegro Way AGENDA REPORT TO: Public/Traffic Safety Commission 1989 . FROM: `��Tom Garcia, Director of Public Works/City Engineer DATE: June 23, 2016 SUBJECT: Item 3 Consideration of Multi-Way Stop Signs — McCabe Drive at Amarita Way/Montelegro Way PREPARED BY: Jerry Gonzalez, Associate Engineer- Traffic RECOMMENDATION: That the Public/Traffic Safety Commission: 1. Maintain the present level of right-of-way control at the intersection of McCabe Drive at Amarita Way/Montelegro Way; and 2. Direct Staff to install additional pedestrian crossing signs at the marked school crosswalk located at the intersection of McCabe Drive and Amarita Way/Montelegro Way. BACKGROUND: A request was received to consider the feasibility of installing multi-way stop signs at the intersection of McCabe Drive at Amarita Way/Montelegro Way to provide right-of-way control and enhance pedestrian visibility at a marked school crosswalk. The public has been notified of the Public/Traffic Safety Commission's consideration of this issue through the agenda notification process. McCabe Drive is a forty-four(44)foot wide residential collector roadway, which provides access to the arterial roadway network for numerous residential units. McCabe Drive is striped for one travel lane in each direction with parking on both sides of the roadway. The vehicular traffic shares the road with bicycles, which is designated by a series of "sharrows" along McCabe Drive. McCabe Drive carries approximately 1,800 ADT. The speed limit is posted at 35 MPH on McCabe Drive. Amarita Way/Montelegro Way is a forty-eight (48) foot wide residential collector roadway, which provides access for numerous residential enclaves in the Paseo Del Sol subdivision to the arterial roadway network. Amarita Way/Montelegro Way is striped for one travel lane in each direction, a painted median and a striped bike lane on both sides of the roadway. On-street parking is prohibited along Amarita Way and Montelegro Way. Amarita Way/Montelegro Way carries approximately 3,000 ADT at McCabe Drive. The speed limit is posted at 40 MPH on Amarita Way and Montelegro Way. A review of conditions was performed at the intersection which included an evaluation of sight distance, accident history, a multi-way stop warrant analysis and review of existing school area signing. The sight distance evaluation determined the visibility looking north and south from McCabe Drive is appropriate for conditions and prevailing vehicular speeds. The evaluation determined the sight distance is approximately 400 feet looking northwest on Amarita Way and 750 feet looking southeast on Montelegro Way. An unobstructed sight distance of approximately 300 feet is required for the posted speed limit of 40 MPH on Amarita Way and Montelegro Way. A review of the accident history for the twelve(12) month period from June 1, 2015 to May 31, 2016, indicates there were no reported collisions at the intersection. This favorable record can be attributed to motorists exercising due care when entering the intersection. The California Manual on Uniform Traffic Control Devices(California MUTCD)indicates that a Multi- Way Stop installation may be useful at locations where the volume of traffic on intersecting roads is approximately equal and/or where a combination of high speed, restricted sight distance and an accident history indicates that assignment of right-of-way is necessary. There are four(4) criteria that the MUTCD has established for the evaluation of Multi-Way Stop signs. These criteria are as follows: A. Where traffic signal controls are justified, the multi-way stop is an interim measure that can be installed quickly to control traffic while arrangements are being made for the installation of the traffic control signal. B. An accident problem, as indicated by five (5) or more reported accidents in a twelve(12) month period that are susceptible to correction by a multi-way stop installation. Such accidents include right and left-turn collisions as well as right-angle collisions. C. Minimum Volumes 1. The vehicular volume entering the intersection from the major street approaches (total both approaches) averages at least 300 vehicles per hour for any eight (8) hours of an average day, and 2. The combined vehicular, pedestrian and bicycle volume entering the intersection from the minor street approaches (total of both approaches) averages at least 200 units per hour for the same eight(8) hours, with an average delay to minor street vehicular traffic of at least 30 seconds per vehicle during the maximum hour, but 3. If the 85-percentile approach speed of the major street traffic exceeds 40 miles per hour, the minimum vehicular volume warrants are 70 percent of the above values. D. Where no single criterion is satisfied, but where Criteria B, C.1, and C.2 are all satisfied to 80 percent of the minimum values, Criterion C.3 is excluded from this condition. Other criteria that may be considered when evaluating the need for multi-way stops include: E. The need to control left-turn conflicts, F. The need to control vehicle/pedestrian conflicts near locations that generate high pedestrian volumes; G. Locations where a motorist, after stopping, cannot see conflicting traffic and is not able to reasonably safely negotiate the intersection unless conflicting cross traffic is also required to stop; and H. An intersection of two residential neighborhood collector streets of similardesign and operating characteristics where multi-way stop controls would improve the traffic operational characteristics of the intersection. The multi-way stop warrant analysis performed found that existing volumes are lower than the applicable criteria and multi-way stop signs would not be justified. Moreover, there are no special circumstances that justify the need for additional right-of-way control. Staff recommends maintaining the present level of right-of-way control at the intersection of McCabe Drive at Amarita Way/Montelegro Way. As previously mentioned Staff was asked to consider the feasibility of enhancing the visibility of the marked school crossing located on the northwest leg of the intersection. A review of the current signing indicates that the sign placement complies with the requirements set forth in the Caltrans MUTCD for school area traffic control devices. However, our review of conditions did reveal that the visibility of the marked crosswalk location could be improved by the addition of two (2) pedestrian crossing signs at the crosswalk. The proposed signs would be placed on the back side of the existing crosswalk signs to provide an additional sign for each direction of travel. FISCAL IMPACT: Minor cost associated with installing signs. Adequate funds are available in the Traffic Division's operating budget. ATTACHMENT: 1. Exhibit "A" — Location Map 2.
