INTRODUCTION The Roripaugh Ranch property occupies 804.7 acres adjacent to the northeast corner of the City of Temecula in western Riverside County. Figure' 1 shows the regional location of the site, while Figure 2 shows the actual site location. Ashby USA, Inc. ("Developer") has proposed to develop the property into 2,015 residential units, 15 acres of commercial uses, 2 school sites, 2 public park sites, and 262.1 total acres of open space, including habitat, flood control areas, and landscaped slopes. The proposed land development plan for the project is shown in Figure 3. In January of 2001, the U.S. Fish and Wildlife Service (USF&WS) approved an incidental take ' permit for the Assessment District 161 Multiple Species Sub -Area Habitat Conservation Plan (AD 161 SHCP). This conservation plan area includes 201 acres of the Roripaugh Ranch property that has been incorporated into the proposed development plan (Figure 3). On ' [DATE], the developer entered into an agreement with the Riverside County Regional Park and Open -Space District (RCRPOSD) to assume ownership and management of the AD 161 SHCP lands within the Roripaugh Ranch Specific Plan boundaries. 1 I 1 11 I 1 In the summer of 2002, the City of Temecula, as the Lead Agency under CEQA, circulated a 2°' Revised Draft Environmental Impact Report (DEIR — State Clearinghouse # 97121030). Mitigation Measure 3.7-5 from the DEIR required the developer to prepare a Habitat Management Plan (HMP) to assure effective implementation of the AD 161 MSHCP on the Roripaugh property. This document is intended.to fulfill the requirements of that measure. The HMP is intended to show how development of the project site, as outlined in the Roripaugh Ranch Specific Plan, will interface with and minimize impacts on the adjacent land within the AD 161 SHCP. HMP REQUIREMENTS The HMP is intended to accomplish the following, as outlined in Mitigation Measure 3.7-5 of the Roripaugh Ranch Specific Plan EIR: ' The open space in Planning Areas 8, 9A, 9B, and 13 will be managed by a conservation organization authorized by the most current AD 161 SHCP Agreement. Prior to tentative map approval, the developer shall provide the City with a Habitat Management Plan (HMP) t signed by the appropriate resource agency, covering activities related to the AD 161 Habitat area on the project site (Planning Areas 8, 9A, 9B, and 13). The HMP will address the exact boundaries of the area, fencing, lighting, landscaping, fuel modification, access ' roads for fire equipment, pedestrian and equestrian trails, and access gates to the preserve area, including public access to the Johnson Ranch and UCR property. ' The Developer shall comply with all applicable requirements of the AD 161 SHCP and the approved HMP, including but not limited to the following: (a) Roadways in or adjacent to the open space areas, including security and maintenance ' roads, shall have highly visible signs notifying drivers of the potential for wildlife (e.g. "WARNING - WILDLIFE XING"). Speed laws near corridors should be strictly enforced. ' (b) No fences shall impede movement within the corridor. If a fence is necessary in these areas, it should be a two -strand smooth -wire or split -rail type. The bottom strand or rail should occur no lower than 20 inches above the ground, with the second strand or rail occurring no higher than 40 inches above the ground. ' (c) Fencing shall be installed and maintained along the perimeter of the open space areas (Planning Areas 8-10) to minimize intrusion by humans, pets, etc. (d) Habitat or corridors shall be screened from the direct view of adjacent homes, roads, ' etc. by trees and shrubs. Dense vegetative screening is required for the edge of any developed areas adjacent to corridors. (e) If night-time lighting is necessary in the area of wildlife corridors, only appropriate restrictive lighting pointed away from the corridor should be allowed. In addition, streets should not terminate at the edge of the corridor because this may promote ' turning of automobiles that would flood the corridor with headlight illumination. Streets that do terminate shall have fencing or other visual screening to limit light intrusion into the habitat area. (f) During the vegetation clearing or grading, all areas of Riversidian sage scrub proposed to be preserved in the vicinity of construction activities shall be protected through the ' construction of temporary fencing. No construction access, parking or storage will be permitted within the fenced area. Vehicle transportation routes between cut -and -fill locations will be restricted. 1 ' Habitat Management Plan — Roripaugh Ranch Property ' Failure of the developer to abide by the guidelines of AD 161 SHCP and the HMP will be grounds for suspension of grading and building permits for the project, as well as the ' recordation of all maps, regardless of phase. The City's Mitigation Monitoring and Reporting Plan for the Roripaugh project requires the ' developer to prepare and submit this HMP to the USF&WS and the California Department of Fish and Game (CDF&G) for review and approval. In addition, the City Planning Department shall have approval authority over this measure, which must be approved before approval of ' any tentative map for the Roripaugh project. This action is appealable to -the City Council in disputed cases. ' The open space in Planning Areas 8, 9A, 9B, and 13 will be managed by RCRPOSD as the County's designated conservation organization as authorized by the most current AD 161 SHCP Agreement. t2. Approvals ' Prior to tentative map approval, the developer shall provide the City with a Habitat Management Plan (HMP) signed by the RCRPOSD covering activities related to the AD 161 Habitat area on the project site (Planning Areas 8, 9A, 96, and 13). ' 3. Boundaries ' 6 C. MANAGEMENT GOALS Management of the onsite AD 161 SHCP lands will be conducted in accordance with the following biological goals and objectives: ' 1. Preserve native vegetation on the AD 161 SHCP land within the Roipaugh Ranch property in a natural, undisturbed state, ' 2. Maintain appropriate connections through the project area that will benefit animal movement, 3. Create and maintain riparian and wetand habitats that meet the goals set forth in the mitigation plan for wetland impacts and the operations and management plan prepared in ' connection with the CWA 404 Permit and SAA for the Roripaugh project, 4. Create upland habitat (i.e., sage scrub) that meets the goals set forth in the revegetation ' plan for the project area as outlined in the CWA 404 Permit and its associated Section 7 Consultation with the U.S. Fish and Wildife Service; 5. Control non-native, exotic vegetation in area of conserved habitat especially in sage ' scrub revegetabon areas; and 6. Control access of people, vehicles, and pets to the adjacent AD 161 SHCP habitat land. 1 D. HMP IMPLEMENTATION ' 1. Approvals ' Prior to tentative map approval, the developer shall provide the City with a Habitat Management Plan (HMP) signed by the RCRPOSD covering activities related to the AD 161 Habitat area on the project site (Planning Areas 8, 9A, 96, and 13). ' 3. Boundaries ' 6 H 1 C 1 1 II 1 Habitat Management Plan — Roripaugh Ranch Property The general boundaries of the HMP are shown in Figure 4, while the exact boundaries are provided in Exhibit A of the Conveyance Agreement with RCRPOSD entitled "Dedication of Habitat AD -161 -SHOP." The Roripaugh project is divided into two main areas, the "Plateau" area along Murrieta Hot Springs Road west of Butterfield Stage Road, and the "Valley' area along Butterfield Stage Road south of Murrieta Hot Springs Road. 4. Grading/Phasing The proposed grading plan for the project around the habitat areas is shown in Figure 5, which also shows the phasing of the grading improvements relative to the habitat areas. The developer will be responsible for grading and related improvements until such time as a master Home Owners Association (HOA) is formed. 5. Roads/Signage The location, width, and cross-sections for the onsite roads adjacent to the habitat areas are shown in Figures 6 and 7. Roadways in or adjacent to the open space areas, including security and maintenance roads, shall have highly visible signs notifying drivers of the potential for wildlife (i.e., "WARNING - WILDLIFE XING"). Speed laws near corridors will be strictly enforced. In addition, signs prohibiting access will be installed along fences adjacent to sidewalks along habitat land (i.e., "NO TRESSPASSING — HABITAT MANAGEMENT AREA"). The proposed locations for the wildlife signs are shown in Figure 8. All signage will be maintained by the master Home Owners Association (HOA). Appendix A contains a copy of the Planning and Development Standards for the habitat areas (Planning Areas 8, 9A, 9B, and 13). 6. Vehicular Access The project will have 8 locked vehicular access gates to the preserve area, as shown in Figure 8, including access to the Johnson Ranch and UCR property. All gates and roadways will be maintained by the, master Home Owners Association (HOA). A 24 -foot wide road with a decomposed granite surface will be constructed along the south side of Planning Area 13 only for access by the local fire department (see Section 10 on "Fuel Modification/Access"). 7. Non -Vehicular Access The project will have a network of sidewalks and multi -use trails, including several for equestrian use, to allow project residents access to the area without the use of vehicles. However, none of these improvements will be located within the habitat areas (Planning Areas 8, 9A, 9B, 10, and 13). A curb -separated sidewalk is planned along the north side of Murrieta Hot Springs Road, next to Planning Areas 8, 9A, and 9B, that will be separated from the habitat .areas by a 6 -foot wide parkway with landscaping. Fencing/Screening ' Special chain link "habitat' fencing shall be installed and maintained along the perimeter of the habitat areas (Planning Areas 8, 9A, 96, and 13) to minimize intrusion by humans, pets, etc. The location and type of fencing to be installed is shown in Figures 11 and 12. ' No fences shall impede wildlife movement within the habitat area. If a fence is necessary in these areas, it should be a two -strand smooth -wire or split -rail type. The bottom strand or rail ' should occur no lower than 20 inches above the ground, with the second strand or rail occurring no higher than 40 inches above the ground. Habitat or corridors shall be screened from the direct view of adjacent homes, roads, etc. by trees and shrubs. Dense vegetative screening is required for the edge of any developed areas adjacent to corridors. 9. Lighting ' If night-time lighting is necessary near the habitat areas or near wildlife corridors, only appropriate restrictive lighting pointed away from the corridor should be allowed. In addition, streets should not terminate at the edge of the corridor because this may promote turning of ' automobiles that would flood the corridor with headlight illumination. Streets that do terminate shall have fencing or other visual screening to limit light intrusion into the habitat area. Areas where streetlights are prohibited are shown in Figure 13. Locations where landscaping, fencing, or other screening will be installed to prevent vehicle headlights from spilling into the '. habitat areas are also shown in Figure 13. U 10. Fuel Modification/Access A 100 -foot wide fuel modification zone (FMZ) must be established at the interface of the AD 161 SHCP habitat land and the developed portions of the Roripaugh project. The locations of the FMZ are shown in Figures 14 and 15, while Figure 16 shows a cross section of the FMZ along the south side of Planning Area 13. 11. Protection of Vegetation During the vegetation clearing or grading, all areas of Riversidian sage scrub (RSS) proposed to be preserved in the vicinity of construction activities shall be protected through the construction of temporary fencing. No construction access, parking or storage will be permitted within the fenced area. Vehicle transportation routes between cut -and -fill locations will be restricted or rerouted where it passes through undisturbed RSS areas. Native vegetation shall be protected from invasion by non-native and weedy species including but not limited to giant reed, Australian saftbush, brome grasses. hottentot fig, red valerian. bull thistle, pampas grass, broom, filaree, storksbill. Eucalyptus, sweet fennel, ivy, short - podded mustard, Japanese honeysuckle, tree tobacco, castor bean, pepper tree, tamarisk, and periwinkle. Changed Circumstances The following events will trigger an evaluation of whether "changed circumstances" as defined in federal and state regulations. have occurred. The three events are: Extensive invasion of exotic species (as observed in the course of managing of onsde open space), 2. Destruction of conserved habitat by fires that exceed the natural regime beneficial to Riversidian sage scrub, riparian habitat, wetlands, and 3. The listing of species that potentially occur in the habitat land (Planning Areas 8, 9A, 9B, and 13) that are not covered by the AD 161 SHCP. If such events occur, the RCRPOSD will consult with USF&WS and CDF&G and implement remedial measures determined in cooperation with the agencies. 15. Unforseeen Circumstances If the USFWS makes a finding that "unforeseen circumstances" have occurred, the implementation of additional measures by RCRPOSD, the Developer, HOA, and/or the City of Temecula may be warranted. Provided that the AD 161 SHCP is in effect and is being properly implemented by the RCRPOSD in accordance with the approved AD 161 SHCP, the USFWS will not require the commitment of additional land, water, or financial compensation, and will not impose additional restrictions on the use of land, water, or other natural resources beyond the level and/or amounts specified in the AD 161 SHCP and the project EIR. ' Twelve months after HMP approval, and every twelve months thereafter, an annual report on AD 161 SHCP implementation will be prepared and provided to USFWS and CDFG by the RCRCOSD. ' 16. This includes 190.2 acres of open space. These areas contain topo and drainage features that characterize the Roripaugh Ranch planned community. This trail system will link residential planning areas within the Valley Neighborhood) to the Sports Park (Planning Area 27), the Mega Center (Planning Area 30) and the two schools ( (Planning Areas 28 and 29).
