PA14-0175, a Development Plan and SUMMARY: PA14-0187, a Conditional Use Permit for American Tire Depot to construct a 7,303 square foot building to be used for tire retail and repair, as well as minor auto repair services, located at the southwest corner of Ynez Road and DLR Drive RECOMMENDATION: Adopt a Resolution approving the project subject to Conditions of Approval CEQA: Categorically Exempt Section 15332, Class 32, In-Fill Development Projects PROJECT DATA SUMMARY Name of Applicant: Bedros Darkjian General Plan Community Commercial (CC) Designation: Zoning Designation: Community Commercial (CC) Existing Conditions/ Land Use: Site: Vacant Land North: DLR Drive, Temporary Vehicle Storage Lot / Service Commercial (SC) South: Vacant Land / Community Commercial (CC) East: Ynez Road, Vacant Land, Commercial Center / Community Commercial (CC) West: Vacant Land / Community Commercial (CC) Existing/Proposed Min/Max Allowable or Required Lot Area: 1.2 Acres 0.69 Acres Total Floor Area/Ratio: 71303 Square Feet/ 0.14 0.30 Landscape Area/Coverage: 36.2% 20.0% Minimum X:\Planning\2014\PA14-0175 American Tire Depot DP-CUP\Planning\Public Hearing\14-0175 Staff Report.doc Parking Provided/Required: 26 Parking Spaces 24 Parking Spaces BACKGROUND SUMMARY On August 7, 2014, Bedros Darkjian submitted Planning Applications PA14-0175, a Development Plan and PA14-0187, a Conditional Use Permit for American Tire Depot to construct a 7,303 square foot building to be used for tire retail and repair, as well as minor auto repair services, located at the southwest corner of Ynez Road and DLR Drive. Automobile repair service shops are a conditionally permitted use in the Community Commercial zone upon the approval of a Development Plan. Staff has worked with the applicant to ensure that all concerns have been addressed, and the applicant concurs with the recommended Conditions of Approval. ANALYSIS Site Plan The project is located in the Community Commercial (CC) zoning district at the southwest corner of Ynez Road and DLR Drive on an undeveloped parcel of land. In the retail area, the project would provide a showroom for display of retail items, a sales area, an area for customers to wait while their cars are being serviced, and restrooms. In addition, the project would also contain a repair area containing six service bays and a warehouse for the storage of parts. The project is consistent with the City of Temecula Design Guidelines in that that roll up doors and trash enclosure are screened or located at the rear of the property and the service are is located at the rear of the building and not facing a public street. There are two points of vehicular access to the project site with limited right in/right out access off of Ynez Road and limited right in/right out access off of DLR Drive. The proposed 26 parking spaces exceed Table 17.24.040 of the City of Temecula Development Code requirement of four spaces per service bay. The project would also meet the requirement of two disabled parking spaces. Architecture The architectural design of the project features a tower element on the corner of Ynez Road and DLR Drive that contains ledger stone, and a mission tile roof. The rest of building has variations in roof lines on all four sides of the building and has earth toned stucco and ledger stone. In addition, the project contains four-roll up service doors that provide access to the service bays and a loading/unloading area for parts. Landscaping The project would provide 36.2% landscaping which exceeds the 20% minimum landscape requirements of the Development Code. Planting types include fruitless olive, red crape myrtle, London plane trees, hopseed bushes, blue hibiscus, and kangaroo paw. LEGAL NOTICING REQUIREMENTS Notice of the public hearing was published in the U-T San Diego on August 2, 2016 and mailed to the property owners within a 1,350-foot radius. X:\Planning\2014\PA14-0175 American Tire Depot DP-CUP\Planning\Public Hearing\14-0175 Staff Report.doc ENVIRONMENTAL DETERMINATION In accordance with the California Environmental Quality Act, the proposed project has been deemed to be categorically exempt from further environmental review (Section 15332, Class 32, In-Fill Development Projects). The project site has no value as habitat for endangered, rare or threatened species. The site is also surrounded by development and is able to be serviced by all required utilities and public services. The project is not anticipated to result in any significant effects relating to traffic, noise, air quality, or water quality. The numerals shall be painted with a standard nine-inch paint roller using fluorescent yellow paint applied over a contrasting background. The address shall be oriented to the street and placed as closely as possible to the edge of the building closest to the street. 122. Public Telephones. Any public telephones located on the exterior of the buildings shall be placed in a well-lit, highly visible area, and installed with a "call-out only" feature to deter loitering. This feature is not required for public telephones installed within the interior of the buildings. 123. ADA Parking. All disabled parking stalls on the premises shall be marked in accordance with Section 22511.8 of the California Vehicle Code. 124. Employee Training. Employee training regarding retail/credit card theft, citizens' arrest procedures, personal safety, business security, shoplifting or any other related crime prevention training procedures is also available through the Crime Prevention Unit. 125. Crime Prevention Through Environmental Desiq . Crime prevention through environmental design as developed by the National Crime Prevention Institute (NCPI) supports the concept that"the proper design and effective use of the built environment can lead to a reduction in the fear and incidence of crime and an improvement in the quality of life." The nine primary strategies that support this concept are included as conditions below: a. Provide clear border definition of controlled space. Examples of border definition may include fences, shrubbery or signs in exterior areas. Within a building, the arrangement of furniture and color definition can serve as a means of identifying controlled space. b. Provide clearly marked transitional zones. Persons need to be able to identify when they are moving from public to semi-public to private space. c. Gathering or congregating areas to be located or designated in locations where there is good surveillance and access control. d. Place safe activities in unsafe locations. Safe activities attract normal users to a location and subsequently render the location less attractive to abnormal users due to observation and possible intervention. e. Place unsafe activities in safe locations. Placing unsafe activities in areas of natural surveillance or controlled access will help overcome risk and make the users of the areas feel safer. f. Redesign the use of space to provide natural barriers. Separate activities that may conflict with each other (outdoor basketball court and children's play area, for example) by distance, natural terrain or other functions to avoid such conflict. g. Improve scheduling of space. The timing in the use of space can reduce the risk for normal users and cause abnormal users to be of greater risk of surveillance and intervention. h. Redesign space to increase the perception of natural surveillance. Abnormal users need to be award of the risk of detection and possible intervention. Windows and clear lines-of-sight serve to provide such a perception of surveillance. i. Overcome distance and isolation. This strategy may be accomplished through improved communications (portable two-way radios, for example) and design efficiencies, such as the location of restrooms in a public building. 126.
